I sincerely apologize for the confusion, and hope to sort that out for you. The project will incur a total of 0.191 acres
permanent impact— however the 0.175 acres should be referencing the total size of Wetland 15 which is included in the
total impact calculation. During our delineation the wetlands appeared to have been historically disturbed from the
surrounding city development resulting in isolated impoundments (not stormwater ponds), and we thought would be
non -jurisdictional. However the USACE has claimed jurisdiction on the wetlands and the 0.191 acres of impact will be
mitigated for. We received approval for the nationwide permit this afternoon, and have already contacted DMS to
purchase credits.

In reviewing the PCN application, I had a few questions. Based on your application it states that there are isolated
wetlands and that they are to be impacted, but you applying for a regular 401 application? I don't see in the application
where these isolated wetlands are on the your table of impacted wetlands. Can you please clarify this? Similarly, in the
table you mention 0.191 acres of impacts, but in the comments only state 0.175 acres of impact, so which one is it? In
looking at Google Earth, I did not see any sediment/erosion control and/or stormwater ponds, yet you state that is what
is on the property. Are you impacting just isolated wetlands or isolated wetlands AND 404/401 wetlands? If so, how
much are you proposing to impact for each? If they are just 404/401 wetlands, then you are over the threshold and must
apply for mitigation. If you could clarify these issues, that would be most appreciated.
