Dear Mr. Kichefski and Ms. Higgins:
This letter is in reference to the Piedmont Natural Gas (PNG) Line # 170 Project. The
project entails construction of approximately 8.8 miles of natural gas transmission
pipeline in Cabarrus, Iredell and Mecklenburg Counties, North Carolina. The proposed
pipeline originates approximately 850 linear feet west of the intersection of Mecklenburg
Highway (NC 115) and Presbyterian Road in Iredell County (35.515375 °N,
80.842222 °W) and ultimately ties into an existing natural gas line located approximately
0.2 miles south of Davidson - Concord Road (35.439426 °N, 80.774642 °W). The location
of the project corridor and proposed re- routed segments is depicted on the Site Vicinity
Map (Figure A).
PROJECT BACKGROUND
A Pre - construction Notification (PCN) for impacts to waters of the U.S. in accordance
with Nationwide Permit (NWP) No. 12 and the corresponding North Carolina Water
Quality Certification (WQC) No. 3819 was submitted to the U.S. Army Corps of
Engineers (USACE) and the North Carolina Division of Water Quality ( NCDWQ) on
January 25, 2012. The project was granted authorization by NCDWQ on February 7,
2012 (DWQ Project No. 12- 0072), but in a decision by the USACE, was placed on hold
until the viability of potential alternate routes was explored.
This revision request involves relocation of three distinct segments of the pipeline route,
and will increase the proposed wetland impacts by 0.06 acre (of which 0.01 acre will
consist of permanent conversion, while the remainder is temporary). The re- routes will
reduce the overall amount of temporary stream impact by 51 linear feet (If).

Two of the proposed re- routes are necessary in order to accommodate concerns expressed
by area stakeholders. The third is intended to promote the safety of workers during
construction by preventing potential exposure to buried materials that may have migrated
from a former landfill recently identified up- gradient of the original route.
The location of the proposed current pipeline route is depicted on the revised USGS
Topographic Maps (Figures B1 -3rev) and 2010 Aerial Photographs (Figures C1- 3rev).
The first proposed re -route (Re -route 1) is located principally on land owned by
Davidson College (the College). Following submission of PNG's January 25, 2012
permit application, the College expressed opposition to the original pipeline route, which
crossed an area the College considers an "ecological preserve." Although the property is
not subject to a conservation easement or similar protective mechanism, professors and
students routinely use the site to conduct research. The College was concerned that the
pipeline would negatively affect long -term studies that were underway there, and
proposed Re -route 1 as a potential alternate.
The second re -route (Re -route 2) proposed by this submittal is necessary to avoid a
historic asbestos landfill located on the east side of Grey Road. Although information
regarding the historic landfill is sparse, the site is identified by the North Carolina
Department of Environment and Natural Resources (NCDENR) Pre - regulatory (Pre -
1983) Landfill Tracking System as the "Davidson Landfill," located on the east side of
Grey Road, northeast of its intersection with Charden Road. S &ME and PNG personnel
visited the site on February 27, 2012, where an area resident with knowledge of the
landfill identified its former location, which is directly upslope of the original pipeline
route. To avoid potential exposure to workers during construction of the pipeline, PNG
elected to relocate the affected segment of pipeline to an adjacent property upslope of the
former landfill.
The third re -route (Re -route 3) was proposed by a group of area stakeholders that
included the Town of Davidson, Mecklenburg County Parks and Recreation and the
Davidson Lands Conservancy. These stakeholders requested that PNG relocate a portion
of the pipeline from the south side of the West Branch of Rocky River, where it would
have passed through an area comprised of mature forest, to the north side of the river,
through an area of open, maintained field located on the Fisher Farm property. This
alternate route would significantly reduce the pipeline's impact to mature tree canopy
along the river, and ultimately tie back into the original route further east.
As PNG became aware of the stakeholder concerns and the potential safety risks
associated with construction of the proposed pipeline down - gradient of the former
landfill, measures were taken to relocate the relevant pipeline segments in order to
accommodate the respective concerns.
ASSESSMENT OF THE PROPOSED RE- ROUTES
On the morning of February 16, 2012, S &ME met PNG and College personnel on -site
and reviewed Re -route 1, which would avoid the ecological preserve. This re -route
follows an existing pipeline right -of -way (ROW) further south, then traverses east
through pastureland that adjoins the wooded portion of the College property. The site

was assessed during a February 16, 2012 visit by Mr. Steve Kichefski with the USACE
and Mr. Alan Johnson with the NCDWQ. They concluded that Re -route 1 would result
in less impacts to jurisdictional areas, and should be given consideration if
constructability, engineering or similar constraints were not prohibitive.
Although Re- routes 2 and 3 were not assessed in the field by regulatory personnel,
S &ME conducted jurisdictional delineation, protected species and cultural resources
assessments of these areas on March 15, 2012 and April 18 -19, 2012, respectively. The
purpose of the jurisdictional delineation was to identify new stream channels or wetland
areas within the re- routed project corridor. The features delineated there were
subsequently surveyed by McKim & Creed and depicted on the revised Jurisdictional
Waters of the U.S. Impact Plan Drawings (Appendix I).
The cultural resources assessment involved shovel -test excavation at approximately 100 -
foot intervals, along with an architectural reconnaissance of the proposed re- routes by
S &ME archaeologists. The assessment concluded that no cultural and archeological
resources or structures greater than 50 years old would likely be affected by the proposed
re- routes. Similarly, the protected species assessments did not identify evidence that the
proposed re- routes would affect federally threatened or endangered species. Mr. Chris
Matthews with Mecklenburg County Parks and Recreation also provided S &ME with a
2002 Initial Biodiversity Assessment of the Fisher Farm property (Re -route 2). The
report did not identify protected species in connection with the property. Mr. Matthews
informed S &ME of the County's preference for the pipeline relocation as currently
proposed, in that it would avoid impacts to forested areas south of the river.
REVISED IMPACTS
As a result of the proposed reroutes, previously proposed impacts to three wetland areas
(Wetlands WA and WA.1 and WC) will be avoided. The crossing of Stream S 1 and a
second stream originally identified as S3.1 will be avoided entirely, while the crossing of
Stream 3 will occur at a new location. The re- routes will result in temporary impacts to
two new streams (S3.lrev and S3.2). To accommodate the proposed crossing of Stream
S3.2, a portion of which was proposed for restoration by the North Carolina Ecosystem
Enhancement Program ( NCEEP), the Town of Davidson and Mecklenburg County will
grant an expansion of the subject property currently held under the State easement.
Personnel with the Town of Davidson, Mecklenburg County and the NCEEP anticipate
that the transaction will be complete prior to start of construction.
The project as currently revised will result in 6461f of temporary stream impact
(reduced from the 6971f previously proposed), 0.317 acre of temporary wetland
impact (increased from the 0.257 acre previously proposed) and 0.145 acre of
permanent wetland conversion (increased from the 0.135 acre that was previously
proposed).

MITIGATION
Following construction, stream and wetland crossings will be restored to their original
grade and contour. The proposed project will not result in permanent changes in pre -
construction elevation contours or stream dimension, pattern or profile. Cleared areas
and temporarily- affected streambanks will be restored in accordance with the Restoration
Plan submitted with the original permit application.
To adequately mitigate for the conversion of 0.145 acre of forested wetlands to
herbaceous wetlands, PNG plans to purchase 0.25 acre of mitigation credit from the
NCEEP (see attached acceptance letter in Appendix III).

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state federal or local government permits regulations or authorizations associated
with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011 -343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required for this impact is determined by permitting agencies.
