Dear Mr. Shaw:
The Division of Water Quality (DWQ) received your application fora 401 Water Quality Certification for
the subject project on May 10, 2007. Mr. Alan Johnson of this office has reviewed the application and visited
the site. However, on April 30, 2007 a Notice of Violation (NOV) was issued for unapproved impacts at the
site. Pursuant to 15A NCAC 2H .0507(h), this project will be placed on hold until such time that the NOV has
been resolved. In addition, this office is requesting that the Army Corps of Engineers withhold processing the
404 permit until the requested information is provided.
