The parcel in question is 21304101 as described by our GIS records and begins at the corner of Hwy 51 and Alexander
Road. There is no address tied to the parcel in my records.

Dear Mr. Waters:
On May 30, 2012, Michael Burkhard and Alan Johnson of this office met with you at the subject
site to clarify a stream origin determination that is in dispute. A lengthy discussion on the site was not
able to completely resolve all the issues. In an effort to provide written guidance and clarification on the
requirements to reach compliance, the following is provided:
Based on the information you provided and our field observations, we have determined that over
150 linear feet of stream had been impacted due to fill and the installation of the culvert. If you
disagree with our determination, please have your surveyor submit to us, on his letterhead and his
seal, the coordinates of the stream origin. To expedite this process, we would be like to be
present when your surveyor flags the origin determination. Please call or email us to coordinate
the determination.
■ A complete PCN form (application), and fee, is required and must be submitted to the Division of
Water Quality for the impacts at the site. You failed to adhere to the plan approved by the Army
Corp of Engineers and by Rule are in violation of the deemed approved General Certification
#3 821. For information please see our website:

Please submit a copy of the original subdivision plan and the modified subdivision plan. Please
overlay the new subdivision plan over the jurisdictional stream cal' approved by Steve Chapin
with the Army Corps of Engineers.

Please submit. a post construction. stormwater work shect completed and approved by a certified
engineer verifying that .the impervious footprint per drainage area is less than 24%.-, If the
impervious area is 24% or more, then post construction stormwater BMPs are required for that
drainage area.
ff Please provide construction details for the installed culvert.
The stormwater outlets discharging to the culvert must be permanently and properly plugged.
Please provide details of how this is to be accomplished.

® The Notice of Violation issued on March 20, 2012 is still in force.
It is requested that you respond in writing to the requested information within 15 days of receipt of
this Notice.
Pursuant to G.S. 143- 215.6A, these violations and any future violations are subject to a civil penalty
assessment of up to a maximum of $25,000.00 per day for each violation. Your above- mentioned
response to this correspondence, the degree and extent of harm to the environment and the duration
and gravity of the violation(s) will be considered in any civil penalty assessment process that may
occur.
It is requested that the City. f. Charlotte LDS and Mecklenburg.County Code Enforcement hold all
permits /approvals'for ibis development_until this Notice of Violation is resolved. -If you have any
