I've also made them aware that the Corps would consider separating the Apex Peakway impacts from Salem Village and reviewing them under NWP14, if the Town of Apex is the applicant. They have discussed this and I'm told the Town is not willing to be the applicant. So, the owner has directed us to proceed with the IP application. We're compiling the application and hope to have it to you early next week. Given the uncertainty that remains in the real estate markets now, the owner intends to request a 10 year permit life assuming the IP is approved. They plan to build this piped crossing shortly after the IP is approved, but some of the previously permitted impacts under the 2010 NWP will most likely not occur by March 2013, so they will be requesting approval under the IP for all impacts that have not yet occurred within the development. We're confirming available mitigation with EEP. It does not appear that there are any private banks with stream credits available in this HUC. The current owner and applicant will be Salem Village of the Carolinas, LLC. think that has it for now. Feel free to contact me if you have any questions. Lauren: Sorry for not discussing this with you sooner, but the owner was considering their options. The owner will be applying for an IP to change one of the three proposed bridges at Salem Village (DWQ 06- 1151) to a pipe. The bridge proposed to be changed to a pipe, is the large bridge shown for Apex Peakway on Impact Sheet "I" in the 2010 application. The reason being that the bridge would have cost over $700k at today's prices vs. approximately 1/10th of that for a pipe. They have provided me written justification of this which I will include the application. They have also reviewed the costs for the two other proposed bridges and find them to be acceptable and have committed to building those, stating that they will not be coming back in the future asking for changes to them. These bridges have a shorter span and are exponentially less expensive. I'll be in touch next week. The project has always been proposed to be developed in several phases. During the initial permitting process we only had complete designs for a small portion of the project. As the project has progress detailed designs were finalized. One of the proposed stream crossing locations experienced significant profile/height changes, from those originally anticipated. During the design process we determined that the previously proposed b(idge would become excessive in length. This excess length has created two substantial issues. First, the Town of Apex became concerned with the long term maintenance costs of said structure. Second the cost of the structure became project prohibitive. After some analysis, we established a cost estimate of $750,000 for a bridge structure sufficient to span the entire creek at the required road height. By comparison a 66 pipe culvert with headwalls is sufficient to accommodate the drainage and provide aquatic passage as normally prescribed. Our estimate for this drainage structure was found to be $80,000. Given these two factors, we advised our client, Standard Pacific Homes that additional impacts and mitigation should be diligently pursued. These factors are similar to the "Evaluation Factors" listed on Page 8 of the U.S. Army Corps of Engineers, Regulatory Program, Application Information document datcd May 1985. The Tow of Apex Engineering Department administers the erosion control program within the Town limits and extraterritorial jurisdictional area. This program operates under the direction of the Land Quality Section of the North Carolina Department of Environment and Natural Resources (NCDENR) which enforces the requirements of the Sedimentation Pollution Control Act of 1973 on a statewide basis. Properly designed and located sediment control structures would be utilized to prevent sedimentation of undisturbed waters. The project would avoid approximately 2.95 acres of on-site wetlands and 7,415 feet of streams. Economics (33CFR320.4(1)): The applicant would be the primary beneficiary with the sale of residential homes and lots within the project. Aesthetics: The project would be designed to be aesthetically pleasing, matching typical architectural styles of the area, and the avoidance of streams and riparian corridors would provide additional open space for the future residents to enjoy. General Environmental Concerns (33CFR320.4(p)): The overall impact to the environment as a result of the construction of the project would be minimal. Temporary increases in sediment, construction noise, traffic levels, etc., would be expected during construction of the project. Any potential long-term impacts to wetlands, streams, and fish and wildlife would be somewhat offset by the mitigation offered by the applicant. Consideration was also given to the environmental justice of the proposed project. The project would not result in negative impacts to persons living or owning land in the,�icinity of the project. Wetlands (33CFR320.4(b)): The project would result in the cumulative, permanent loss of 0.293 acres of headwaters, riparian wetlands and 506 feet of streams that currently provide some nutrient filtering, sediment removal, and aquatic habitat. The applicant has already mitigated for the previously approved unavoidable permanent impacts through payment into the N.C. Ecosystem Enhancement Program (EEP) to offset the impacts associated with this project. The applicant would mitigate for the additional proposed unavoidable pennanent impacts (237 feet of stream) through payment into EEP to offset the additional impacts associated with this project. 'The project would avoid approximately 2.95 acres of on-site wetlands and 7,415 feet of streams. f. Historic and Cultural Resources (33CRF320.4(e)): As stated in the 2010 application; "Records checks at the State Historic Preservation Office or the Office ofStatc,4rcheology were notperjormed. No structures were noticed during the wetland evaluation. Yheproject is consistent with adjacent land uses. Further, the National Register ofpoints produced by the NC SHPO (utilizing Google Earth) does not show any historic or archeological resources on theproject site," The NWP verification for this application was approved, and as such it is the assumption of the applicant that n1,..,11 R: orrespondence with SBPO is necessary. Fish & Wildlife Values (33CFR320.4(c)): The project would not be expected to result in permanent adverse effects to the overall fish or wildlife value of the site. During construction, it is Uely that some aquatic and terrestrial animals might be lost, along with their habitat. Following construction, the remaining natural areas and wetlands would continue to provide habitat for fish and migratory bird species. AM It was within 2 miles of the ccnter of theproject area. The NIAT additional corresyondence with NAIP FWS or WRC is the applicant certainly welcomes any comments from these agencies at this time, and will request comments if requested to do so by the agencies. Flood Hazard: The project would not be expected to have an impact on the overall hazard of flooding downstream of the project site. The development would result in increases to impervious surface within the watershed, but some of this increase would be offset by the retention of storm water runoff by the remaining natural wetlands and riparian corridors in addition to the post -construction stormwater management devices proposed for the development. 9. Floodplain Value (33CFR320.4(i)): Pursuant to Executive Order 11988, consideration is also given here to the effect that the proposed project may have in reducing the risk of flood loss, minimizing the impact of floods on human sa health and welfare, and restoring and preserving the natural and beneficial values served by floodplains. The project is not located within the 100 -year floodplain. The FEMA designated Salem Village June 2012 PA Project No. 913 floodplain is more than a mile downstream of the project site. Accordingly, consideration of the project's effec) on navigation is not applicable. r 2. Shore Erosion& Accretion: This public interest issue is not applicable to this application as the project is not located in an area where shoreline erosion or accretion is problematic. Terrestrial erosion and potential sedimentation to surface waters would be addressed through the Division of Land Resources — Land Quality Section's required Sedimentation and Erosion Control Plan. 13. Recreation: No existing public or private recreational facilities would be negatively affected by the development. Residents would be able to enjoy the recreational activities within the subdivision, including but not limited the neighborhood recreation facility (pool, clubhouse, etc.), sidewalks, outdoor and natural areas, and retained riparian areas. Any potential turbidity that is generated during construction would likely be carried into Big Branch creek (Class "C", "NSW" by N.C. DWQ), but would be minimized due to the approved Erosion and Sediment Control Plan. Class "C" waters are protected for secondaf)� recreation, fishing, wildlife, fish and aquatic life propagation and survival, agriculture and other uses suitable for Class C. Secondary recreation includes wading, boating, and other uses involving human body contact with water where such activities take place in an infrequent, unorganized, or incidental manner. 14. Water Supply (33CFR320.4(m)): The project is not located within a classified water supply watershed. The development would comply with all surface water standards for "C - NSW" waters. As such, it is not anticipated that the development of the site and the resulting water needs would adversely affect any existing off-site water supplies. 15. Water Quality (33CFR320.4(d)): A North Carolina Division of Water Quality certification, as required for the issuance of this requested Individual Permit from the USACE, has been applied for in association with this permit application. Special conditions are anticipated, and a copy of these conditions will be provided to the USACE. No major impacts to water quality are expected. However, increases in turbidity during construction, loss of nutrient removal capacity of the filled wetland, and some discharge of pollutants and nutrients in the runoff could result. The deNices required under the Sedimentation and Erosion Control Plan would assist in the protection of water • A Town ♦ Apex approved ♦ management plan will be required for each phase of the development. Safety: All entrances to the development along existing state roads have already or will meet the standards of the North Carolina Department of Transportation (NCDOT).
