J Pretreatment Director 2/12/2021 ign e of Town ial Title of Official Date NARRATIVE GENERAL INFORMATION: • The information database has been updated to reflect the most current AT. • All information in the historical SNC report is accurate. • Valdese Water Recycling (The Centralized Waste Treatment facility) within Valdese is fully on-line. • Dental amalgam one time compliance report responses were received. PERMIT INFORMATION: • 7 SIU's performed well in 2020. • 1 CIU (Valdese Water Recycling) was on a compliance order for BOD during the period January 1 to June 30, 2020. Which led to a modification of their permit after the compliance order was satisfied. SIU INFORMATION (SNC): • No SIU was in SNC for either period in the calendar year of 2020, therefore no Public notice was issued. GENERAL SIU INFORMATION: • Good year for pretreatment program • All permits for SIU/CIU will expired December 2020, new permits were submitted by January 1, 2021. • Industrial Waste Survey was submitted before November 1, 2020: there were no new SIUs in this finding and one was removed due to the company shuttering the business. • 1 CIU (Valdese Water Recycling) was placed on a Compliance Order (April 1 to June 30) following several BOD NOVs and a meeting on March 16, 2020 to address the issue. Fees associated with the compliance order were on a graduating scale and were collected per month in the period April 1, 2020 to June 30, 2020. Monetary fines were assessed and received according to the compliance order. The Town Of Valdese participates in the following recycling activities: Curbside recycling for plastic, glass, aluminum and newspaper. Public awareness campaign continues for the fats, oils and grease ordinance and currently implemented by Food Service Establishments. Stormwater monitoring continues based upon collection system permit requirements. The WWTP is also maintaining efforts for enhanced record keeping (W13) and designated wash areas (W 19). The POTW Director and VWR hereby stipulate to the following: A. That VWR located at 936 Main Street West, Valdese, NC, holds Pretreatment Permit No. 027 for discharge of wastewater into the Town of Valdese Lake Rhodhiss Wastewater Treatment Plant, NPDES Permit NC0041696, and it has repeatedly failed to comply with its BOD limits Requirements. B. That VWR was in Significant Non -Compliance with limit for BOD Requirements for both the Report Period January to June 2019 and June to December 2019. Resulting in two 6 month periods of SNC that were published in the newspaper. C. That VWR is Non -Compliant with its discharge permit, which constitutes a violation of the Town's Sewer Use Ordinance and the terms of that Permit. D. That VWR was issued numerous NOV letters and asked to correct the stated problems and comply with its discharge permit. E. Taking into consideration that VWR's continued efforts have not shown to rectify its non-compliance, the POTW Director has determined that it is appropriate to enter into this Consent Order, during which, VWR will be allowed to operate and achieve permit compliance until June 30, 2020. F. The effective period of this Consent Order shall be from April 1, 2020 to June 30, 2020, at which time the POTW Director shall determine the overall compliance status of VWR and either modify, suspend or terminate Pretreatment Permit No. 027. G. Furthermore, should it be determined that full compliance cannot be achieved by the stipulated date, for violations during the 6 — month period of January June 2020, based upon mathematical percentages within North Carolina Pretreatment Guidelines.... greater than or equal to 66% of the regular permit limit of 500 mg/L , OR greater than or equal to 33 % of the Technical Review Criteria of 700 mg/L, suspension or termination of Pretreatment Permit No. 27 will occur. II. VWR, desiring to comply with the conditions of its Pretreatment Permit, does hereby agree to do and perform all of the following: A. During the effective period of this Consent Order, VWR shall take such actions as required in order to meet and comply with BOD limits as specified below. All self -monitoring requirements from Pretreatment Permit No. 027 shall continue during the Consent Order period, WITH EXCEPTION TO BOD MONITORING. All BOD sampling, testing, analysis and data will be collected and performed by the Town of Valdese during this timeframe. Limited Daily Sample Monitoring Parameter Maximum Type Frequency BOD 500 mg / 1 Composite 5 x / Week *The Town of Valdese shall take and test 5 samples per week, through the composite sampler located at the permitted site. B. VWR will operate and discharge weekly, Monday through Friday, with discharge to cease by each Friday, of each respective week by 3:00 PM. No discharge is permitted from that point into and over the weekend. Discharge may resume at 6:00 AM the next calendar Monday. Should VWR desire to discharge over a given weekend, prior knowledge and notification must be made to the Pretreatment Director and a fee of $ 500/day of discharge will be assessed to cover employee time, over -time, call-back, equipment setup, sampling, testing, etc. III. For each day during the effective period of this Consent Order that VWR exceeds the BOD limits established by this Consent Order, VWR shall pay to the Town of Valdese a monetary fine as follows: VIOLATION NUMBER FINE 1-5 $ 250 per exceedance of 500 mg/L daily BOD limit $ 500 per exceedance of 700 mg/L daily BOD limit $1000 per exceedance of 1000 mg/L daily BOD limit 6 -10 $ 500 per exceedance of 500 mg/L daily BOD limit $1000 per exceedance of 700 mg/L daily BOD limit $ 2000 per exceedance of 1000 mg/L daily BOD limit 11-15 $1000 per exceedance of 500 mg/L daily BOD limit $ 2000 per exceedance of 700 mg/L daily BOD limit $ 4000 per exceedance of 1000 mg/L daily BOD limit 16 - 20 $ 2000 per exceedance of 500 mg/L daily BOD limit $ 4000 per exceedance of 700 mg/L daily BOD limit $ 8000 per exceedance of 1000 mg/L daily BOD limit 21 and up $ 25,000 per exceedance of 500 mg/L daily BOD limit VWR shall be billed for and pay such fine(s) on a monthly basis. The Town of Valdese shall mail a bill for the month's fine(s) by the 7th day of the following month and the Town of Valdese must receive payment for such fine(s) by the 20th day of that month. In the event payment of such fine(s) is not received by the Town of Valdese on or before the 20th day of the month during which the bill for such fine(s) was sent, VWR shall pay an additional penalty in the amount of 10% of the delinquent fine(s). IV. This Consent Order does not relieve VWR from any liability, responsibility, penalty or damages, incurred or otherwise, involving operations, discharges, sampling, reporting, non-compliance or other actions pertaining to the Pretreatment Permit No. 027, prior to and during the effective date of this Consent Order. V. This Consent Order is entered into and effective as of the 1st day of April 2020, and has been signed by the POTW Director and signed on behalf of VWR by a duly authorized representative. The Town Manager, of the Town of Valdese, has also signed this Consent Order to evidence his consent.
