The Wilmington District Corps of Engineers (Corps) has received an application from
Mr Joe Tate Jr of the Lincolnton Lincoln County Regional Airport Authority seeking
Department of the Army authorization to impact 1 510 linear feet of stream channel associated
with the construction of runway safety improvements in Iron Station North Carolina
Specific plans and location information are described below and shown on the attached plans

the proposed work pursuant to applicable procedures of Section 404 of the Clean Water Act (33
US C 1344)
Location
The Lincolnton Lincoln County Regional Airport (Airport) is located at 714 Jack Dellinger
Drive (Airport Road) Iron Station North Carolina 28080 The proposed project is located
adjacent to the southwestern portion of the existing runway This site is located in the Santee
River Basin (8 Digit Cataloging Unit 0305010 1) and the coordinates (in decimal degrees) for the
site are 35 478 north 81 17 west (North American Datum 1983) (See Figure 1)
Existing Site Conditions
The airport facility is a general aviation airport utilized by business and recreational aircraft The
nearest surface waters are unnamed tributaries to Lick Run The proposed project area is located
on existing airport property The area immediately adjacent to the southwest end of the existing
runway includes maintained fields and a mixed hardwood forest buffer alongside each stream
Beyond the airport property is Jack Dellinger Road The land use in the surrounding area is rural
in nature and consists mainly of a mix of undeveloped forested tracts single family residential
and agricultural use
Applicant's Stated Purpose
The purpose of the proposed project is to construct runway safety improvements to
accommodate increased levels of operations and to comply with changes in FAA requirements
Protect Description
The Airport proposes to address safety issues by extending Runway 05 end 200 feet and
installing a new localizer The runway extension will utilize the existing blast pad at the end of
Runway 05 as new runway A partial parallel taxiway will be extended to the new end of
Runway 05 to address safety concerns that involve back taxiing for takeoffs on Runway 05
Finally installation of a new localizer/DME and shelter will be required to maintain compliance
with FAA Order 6750 16D — Site Criteria for Instrument Landing Systems replacing an existing
16 year old system Approximately 1 510 linear feet of unnamed tributaries to Lick Run would
be permanently impacted as a result of the construction of the parallel taxiway and new localizer
antenna The applicant has proposed to mitigate for the anticipated impacts through payment to
the NC Ecosystem Enhancement Program s (EEP) in lieu fee program at a 1 1 ratio based on the
quality of the features proposed to be impacted (see Figure 3)
Other Required Authorizations
This notice and all applicable application materials are being forwarded to the appropriate State
agencies for review The Corps will generally not make a final permit decision until the
North Carolina Division of Water Quality ( NCDWQ) issues denies or waives State certification
required by Section 401 of the Clean Water Act (PL 92 500) The receipt of the application and
this public notice combined with appropriate application fee at the North Carolina Division of
Water Quality central office in Raleigh will constitute initial receipt of an application for a 401
Water Quality Certification A waiver will be deemed to occur if the NCDWQ falls to act on
this request for certification within sixty days of the date of the receipt of this notice in the
NCDWQ Central Office Additional information regarding the Clean Water Act certification
may be reviewed at the NCDWQ Central Office 401 Oversight and Express Permits Unit 512

Essential Fish Habitat
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the
Magnuson Stevens Fishery Conservation and Management Act The Corps initial determination
is that the proposed project will not adversely impact EFH or associated fisheries managed by
the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine
Fisheries Service
Cultural Resources
The Corps has consulted the latest published version of the National Register of Historic Places
and is not aware that any registered properties or properties listed as being eligible for inclusion
therein are located within the project area or will be affected by the proposed work Presently
unknown archeological scientific prehistoric or historical data may be located within the
project area and/or could be affected by the proposed work
Endangered Species
The Corps has reviewed the project area examined all information provided by the applicant and
consulted the latest North Carolina Natural Heritage Database Based on available information
the Corps is not aware of the presence of species listed as threatened or endangered or their
critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA)
within the project area A final determination on the effects of the proposed project will be made
upon additional review of the project and completion of any necessary biological assessment
and/or consultation with the U S Fish and Wildlife Service and/or National Marine Fisheries
Service
Evaluation
The decision whether to issue a permit will be based on an evaluation of the probable impacts
including cumulative impacts of the proposed activity on the public interest That decision will
reflect the national concern for both protection and utilization of important resources The
benefit which reasonably may be expected to accrue from the proposal must be balanced against
its reasonably foreseeable detriments All factors which may be relevant to the proposal will be
considered including the cumulative effects thereof among those are conservation economics
aesthetics general environmental concerns wetlands historic properties fish and wildlife
values flood hazards flood plain values (in accordance with Executive Order 11988) land use
navigation shoreline erosion and accretion recreation water supply and conservation water
quality energy needs safety food and fiber production mineral needs considerations of
property ownership and in general the needs and welfare of the people For activities involving
the discharge of dredged or fill materials in waters of the United States the evaluation of the
impact of the activity on the public interest will include application of the Environmental
Protection Agency s 404(b)(1) guidelines
Commenting Information
The Corps of Engineers is soliciting comments from the public Federal State and local agencies
and officials including any consolidate State Viewpoint or written position of the Governor
Indian Tribes and other interested parties in order to consider and evaluate the impacts of this
proposed activity Any comments received will be considered by the Corps of Engineers to
determine whether to issue modify condition or deny a permit for this proposal To make this
decision comments are used to assess impacts on endangered species historic properties water
quality general environmental effects and the other public interest factors listed above
Comments are used in the preparation of an Environmental Assessment (EA) and/or an
Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act
(NEPA) Comments are also used to determine the need for a public hearing and to determine
the overall public interest of the proposed activity
Any person may request in writing within the comment period specified in this notice that a
public hearing be held to consider the application Requests for public hearings shall state with
particularity the reasons for holding a public hearing Requests for a public hearing shall be
granted unless the District Engineer determines that the issues raised are insubstantial or there is
otherwise no valid interest to be served by a hearing
Written comments pertinent to the proposed work as outlined above will be received by the
Corps of Engineers Wilmington District until 5pm June 25 2012 Comments should be

HDR Engineering Inc of the Carolinas (HDR) on behalf Talbert & Bright Inc (TBI) is requesting authorization
under an Individual Section 404 Permit and Section 401 Water Quality Certification to construct the proposed
Runway Safety Area Improvements at the Lincolnton Lincoln County Regional Airport (Airport) in Lincoln
County North Carolina (Figure 1 and Figure 2)
Block 18 — Nature of the Activity
The Proposed Action will address safety issues by extending Runway 05 by 200 feet and installing a new
localizer antenna system The runway extension will utilize the existing blast pad at the end of Runway 05 as
new runway A partial parallel taxiway will be extended to the new end of Runway 05 to address safety
concerns that involve back taxiing for takeoffs on Runway 05 Finally installation of a new localizeddistance
measuring equipment (DME) and shelter will be required to maintain compliance with the Federal Aviation
Administration s (FAA) Order 675016D — Site Criteria for Instrument Landing Systems replacing an existing
16 year old system
Installation of the new runway extension and localizer will require installing sod embankments and a new
drainage system over existing jurisdictional stream channels The new drainage system will result in the
placement of a 640 linear foot (If) 72 inch reinforced concrete pipe (RCP) a 104 If 72 inch dual RCP a 108 If
60 inch RCP and a 312 If 36 inch RCP in unnamed tributaries to Lick Run Creek Additional impacts will result
from the installation of approximately 297 If of np rap aprons for the proposed pipe system (Figure 5, Grading
and Drainage Plans, and Storm Drainage Profiles)

Block 19 — Proposed Proiect Purpose
The positive aviation growth at the Airport has rendered many of the existing facilities Inadequate with respect
to runway safety FAA standards and guidelines and facility development Runway safety improvements are
required to accommodate increased levels of operations and to comply with the changes in FAA requirements
The Airport is only minutes from downtown Llncolnton The lighted runway length is 5 500 feet (6 000 feet with
over runs) Services include aircraft rental aircraft maintenance aircraft storage tie down space and aircraft
charter service Many local businesses and industries house their corporate aircraft at the Airport for fast and
convenient access
Lincoln County is a growing community In the Charlotte region the nation s thirty fourth largest metropolitan
area Lincoln County has a diverse workforce with a strong emphasis on manufacturing Wages for Lincoln
County s dependable and trained workforce are below the state and national average Manufacturing
employment in the County increased from 1980 to 1990 and 1990 to 2000 despite losses in the region state
and country
The Airport was constructed In 1985 and has provided an extended runway safety area (ERSA) length of 300
feet on the Runway 23 end Currently the Airport has a usable takeoff runway length of 5 500 feet due to a
series of intermediate runway extensions in the 1990s and early 2000s and most recently with the recapture of
a 300 foot landing threshold displacement However a 200 foot displaced landing threshold still exists on the
Runway 23 end due to an ERSA length deficiency of 200 feet from the end of the existing runway pavement to
the end of the ERSA The Airport must extend Runway 05 to meet the existing needs and projected growth to
accommodate corporate air traffic and comply with FAA requirements
The existing ERSA for Runway 23 extends 100 feet beyond the end of the runway pavement The Runway 23
threshold has been displaced 200 feet in order to comply with FAA Advisory Circular 15015300 13 — Airport
Design (as amended)
Runway safety Improvements are scheduled to begin construction once all necessary permits and approvals
are acquired It is anticipated that construction activities will take a minimum of 8 months
Block 20 — Reason for Discharge & Block 22 Surface Areas or Wetlands to Other Waters Filled
Jurisdictional waters of the U S were venfied in the field by the U S Army Corp of Engineers (USACE)
personnel on November 3 2011 (Figure 3) Construction of the parallel taxiway and new localizer antenna as
part of the proposed action will result in 1510 If of permanent stream impacts (Figure 5) Impact lengths were
calculated using the centerline of the surveyed stream to account for the natural sinuosity of the stream
channel Table 1 is a summary of jurisdictional waters and associated impacts No jurisdictional wetlands or
other waters of the U S will be impacted There will be no additional temporary impacts to jurisdictional waters
due to placement of temporary erosion control devices or temporary stream crossings (all temporary impacts
will occur within the permanent impact footprint)

Block 21— Types of Material Being Discharged and the Amount of Each Type in Cubic Yards
Approximately 800 cubic yards of stone will be discharged into jurisdictional waters In order to construct the
proposed np rap aprons Approximately 700 cubic yards of clean fill material will be placed into jurisdictional
waters to install the drainage system Standard earth moving equipment including dump trucks pans and
bulldozers will be used for grading activities
Block 23 — Description of Avoidance. Minimization, and Compensation
Avoidance
An alternatives analysis was completed as part of the Airports Runway Safety Area Improvements
Environmental Assessment (EA) submitted to the N C Department of Transportation Division of Aviation
(NCDOA) in January 2012 Alternatives were selected in order to determine If Impacts to environmental
resources could be avoided Impacts were minimized where avoidance was not practical Based on this
analysis Alternative 2 was Identified as the Proposed Action The following summarizes the five alternatives
as detailed In the EA
• Alternative 1— Extend Runway 23 ERSA 200 feet toward Lick Run Creek
• Wetlands and Streams Alternative 1 is anticipated to result In significant impacts to Lick
Run Creek (totaling approximately 1590 If) and two adjacent wetlands (totaling
approximately 1 acre) An onsite consultation with USACE and the N C Division of Water
Quality (DWQ) representatives revealed that installing a permanent culvert along Lick Run
Creek under the proposed ERSA embankment would cause considerable impacts to aquatic
habitat and would not be accepted as a practical alternative Relocation of Lick Run Creek
would require mitigation and Increased design costs
• Federally listed species Alternative 1 could cause direct Impacts to a population of dwarf
flowered heartleaf (federally threatened) located along the western slopes of Lick Run
Creek
• Cost Estimated total cost is $7 469 399

Alternative 2 (Proposed Action) — Extend Runway 05 end 200 feet and install new localizer
without relocating Jack Dellinger Drive
• Wetlands and Streams — Alternative 2 (Proposed Action) is anticipated to result in
approximately 1 150 If of impacts to tributaries to Lick Run Creek
• Federally listed Species — Alternative 2 (Proposed Action) contains suitable habitat for
dwarf flowered heartleaf On September 12 and October 11 2011 S &ME Inc conducted
pedestrian surveys for dwarf flowered heartleaf within the proposed action area No dwarf
flowered heartleaf was observed during these surveys The North Carolina Natural Heritage
Element Occurrence (NHEO) data indicates that the nearest dwarf flowered heartleaf
population is located approximately 50 feet west of Jack Dellinger Drive approximately 200
feet upstream of the Proposed Action In Appendix B (Biotic Communities) of the 2011 EA it
states that based on previous experience in the area the individuals of dwarf flowered
heartleaf lust west of the Airport Road [aka Jack Dellinger Drive] were transplanted to an off
site location in 2006
• Cost — Estimated total cost is $4 370 766 25
• Alternative 3 — Extend Runway 05 end 200 feet, install new localizer with relocation of Jack
Dellinger Drive
• Wetlands and Streams — Alternative 3 is anticipated to result in over 1 500 If of impacts to
tnbutanes to Lick Run Creek Additional stream impacts would be realized from the
proposed relocation of Jack Dellinger Drive
• Federally listed Species — See Alternative 2 (Proposed Action) for a description of dwarf
flowered heartleaf populations located to the west of Jack Dellinger Drive Re locating Jack
Dellinger Drive to the west could potentially cause direct impacts to known populations of
dwarf flowered heartleaf
• Cost — Estimated total cost is $4 887 423 75
Alternative 4 — Extend Runway 05 end 700 feet and install new localizer with relocation of Jack
Dellinger Drive
• Wetlands and Streams — Alternative 4 is anticipated to result in over 1 500 If of impacts to
tributaries to Lick Run Creek Additional stream impacts would be realized from the
proposed relocation of Jack Dellinger Drive It is estimated that this alternative would have
the greatest amount of impacts to jurisdictional waters of the U S
• Federally listed Species — See Alternative 2 (Proposed Action) for a description of dwarf
flowered heartleaf populations located to the west of Jack Dellinger Drive Re locating Jack
Dellinger Drive to the west would likely cause direct impacts to known populations of dwarf
flowered heartleaf
• Cost — Estimated total cost is $8 882 793 75
• Alternative 5 — Extend Runway 05 end 500 feet, construction 300 foot wide by 600 foot long
ERSAs on both runway ends, and install new localizer with relocation of Jack Dellinger Drive
o The estimated project cost for Alternative 5 was in excess of $10 000 000 With the
excessive cost a detailed analysis of Alternative 5 was deemed unnecessary as part of the
EA

• No Action Alternative — The No Action Alternative assumes that the existing Airport would have a
useable takeoff runway length of 5 500 feet with a 200 foot displaced landing threshold on the
Runway 23 end The No Action Alternative would not improve the ERSA to meet FAA standards and
therefore would not accomplish the purpose of the proposed project
Minimization
Minimization strategies were Incorporated as part of the design Jurisdictional waters were delineated and
surveyed within the proposed project area and the preliminary design was adjusted to minimize Impacts Best
Management Practices (BMPs) will be Implemented throughout project construction Individual minimization
Items are listed below
• Culverts were designed to be placed below one foot below the elevation of the stream bed for all
culverts greater than 48 Inches in diameter and 20 percent of the culvert diameter for culverts having
a diameter less than or equal to 48 Inches to allow for low flow passage of water and aquatic life
• The Airport will employ sediment and erosion control structures during construction that may Include
diversion ditches and dikes temporary sediment traps sediment basins straw bale dikes and rock
dams to retain sediment on the construction site and prevent sedimentation to jurisdictional waters
• The Airport will avoid placing erosion control structures in jurisdictional waters
• Grass swales will be utilized where feasible to provide stormwater treatment
• Culverts have been sized and will be Installed at elevations not to Impede low flow passage of water
and migration of aquatic life
• Rip rap aprons will be buned at the original stream bed elevation and Installed to dissipate flows and
prevent downcutting during high flow events
• All work in or adjacent to stream(s) will be conducted in a dry work area
• The Airport will minimize long term water quality Impacts using the most recent BMPs as required by
the NC DOA
• The Airport has implemented a long term water quality Spill Prevention Control and
Countermeasures Plan (SPCC) as described in the National Pollution Discharge System (NPDES)
permit to protect water quality from possible oil and grease spills during construction Undetected
leakage would be absorbed and /or filtered by slopes and ditches before reaching jurisdictional
waters
Compensation
The Proposed Action design has avoided and minimized Impacts to jurisdictional resources to the greatest
extent possible Jurisdictional wetlands will not be Impacted and will not require mitigation Jurisdictional
stream impacts requiring mitigation total 1 510 If Stream impacts will be offset by payment to the N C
Ecosystem Enhancement Programs (EEP) in lieu fee program Current fees for HUC 03050101 are
$349 00/If A copy of the EEP Acceptance Letter is attached

The construction of the proposed runway safety area Improvements is estimated to contribute 12 percent of
additional Impervious surface area (Impervious Exhibit) to the project area The site plan and drainage
strategy was discussed with Alan Johnson with the NCDWQ on January 4 2012 It was determined that a
Stormwater Management Plan (SMP) Is not required for the project

Structure LC 1 dates to around 1905 and is a two story frame residence Significant alterations including vinyl
siding and additions have compromised the resources integrity Structure LC 2 is a simple single story
vernacular frame residence that dates to around 1900 Structure LC is a single story frame cottage that dates
to the mid 1950s Both Structures LC 2 and LC 3 are relatively common examples of rural vernacular
architecture and do not represent a particular time period or architectural style All three structures are
recommended as ineligible for inclusion in the National Register of Historic Places (NRHP)
Based on the Phase 1 investigation no archeological or historic properties will be affected by the proposed
project Correspondence was sent to the N C State Historic Preservation Office (SHPO) requesting

Suitable habitat for the dwarf flowered heartleaf Georgia aster and Michaux s sumac is present within the
Proposed Action study area A pedestrian survey for the respective protected species revealed that no
individuals were present The proposed project is anticipated to have no effect on these species A Protected
Species Assessment produced by S &ME Inc biologists was forwarded to the USFWS for review on comment
(dated October 14 2011) The USFWS reviewed (Log No 4 2 12 024) and concurred with the determination
that the proposed project will have no effect on federally listed species (dated November 16 2011)
Indirect and Cumulative Impacts
The Airports Runway Safety Area Improvements EA considers the indirect and cumulative impacts created by
the Proposed Action and the consequences of subsequent related actions Indirect impacts may include
growth of the community and changes in land use demographics and socioeconomics that are created as a
by product of the Proposed Action Cumulative impacts could result from several individual actions that are
each minor in nature but together create a combined effect that may be considered significant Indirect and
cumulative impacts were discussed in greater detail in the EA submitted in January 2012

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced protect as indicated in the table below Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for protect impacts It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved You must also comply with all other state federal or Iocal government.permits regulations or authonzations associated
with the proposed activity including SL 2009 337 An Act to Promote the Use of Compensatory Mitigation Banks as amended by

This acceptance is valid for six months from the date of this letter and is not transferable If we have not received a copy of the

comments on the subject project We have reviewed the information you presented and are
providing the following comments in accordance with the provisions of the Fish and Wildlife
Coordination Act, as amended (16 U S C 661 667e) and section 7 of the Endangered Species
Act of 1973, as amended (16 U S C 1531 1543) (Act)
Endangered Species — According to the information in your letter, you conducted field surveys
on September 12 2011 and October 11 2011 for species federally listed as endangered or
threatened on the project site You state that no endangered or threatened species that occur
within Lincoln County were found during the field surveys Based on the information provided,
we agree that no listed species occur on the site and we concur with your determination that the
proposed project will have no effect on federally listed species Therefore we believe the
requirements under section 7 of the Act are fulfilled However obligations under section 7 of
the Act must be reconsidered if (1) new information reveals impacts of this identified action
that may affect listed species or critical habitat in a manner not previously considered, (2) this
action is subsequently modified in a manner that was not considered in this review or (3) a new
species is listed or critical habitat is determined that may be affected by the identified action
