Subject: Response to letter regarding waste discharge at DC Mills Farm (AWS520013)

Dear Mr. May:
By this letter, Smithfield Foods, Inc. ("Smithfield") is providing the information you requested in
the attached January 20th letter to Smithfield (the "Request") regarding the waste discharge incident (the
"Incident") that occurred at DC Mills Farm located at 387 Lee Mills Road, Trenton, NC, 28585 (Permit
AWS520013) (the "Farm") owned by DC Mills Farms, Inc. ("Owner"). Since Smithfield neither owns
nor operates the Farm, I want to express our appreciation for the Department's acknowledgement of our
voluntary response to the Incident, including our efforts to help the Owner mitigate the impacts of the
discharge from the Farm's lagoon ("Lagoon") and to prevent further accumulation of waste in the
Lagoon by removal of animals from the Farm.
The second paragraph of the Request makes reference to difficulties encountered during
construction of the lagoon in 1994 and actions taken at that time to mitigate issues related to an
identified limestone formation at the site. Unfortunately, Smithfield has not been able to locate any
information related to the lagoon design or construction details, background data related to structural
issues, or any other site data that would be applicable to review of conditions that would have
contributed to the incident. Because Smithfield does not own or operate the farm, nor was it involved in
the design or construction of the lagoon, it would not normally retain such information.
The third paragraph of the Request notes that the key information that DEQ is seeking at this
time is the recorded waste/freeboard levels in the storage pond and requests any and all records
associated with waste management/freeboard levels at the Farm that have been collected and/or
maintained by Smithfield in the months leading up to the discharge. Attachment 1 is a copy of a report
aggregating weekly recorded waste/freeboard level observations for 2020 as reported by the Owner via a

telephone call -in system. Given that the information is not collected by company personnel, Smithfield
cannot attest to the accuracy of the attached freeboard observations.
Smithfield appreciates the Department's oversight of the lagoon repair plan and work.
Smithfield will not put animals back into the facility unless or until the lagoon is repaired and certified.
