Dear Mr James
The Division of Water Quality (DWQ) has reviewed your submittal for a 401 Water Quality Certification for the
aforementioned project A review of your request revealed it is lacking the necessary information required for
making an informed permit decision The permit application was deficient in the following areas
1 A 10 x 10 double box culvert is proposed to replace the existing bridge The average width of the
stream in the vicinity of the bridge is approximately 10 feet The plans depict the stream flowing through
both culverts and what appears to be Class I riprap at the outlet end to narrow the stream at the outer
edges of the culverts It is unclear from the plans what type of stabilization is proposed at the inlet of
the culverts The stream must flow through a single barrel of the double box culvert in order to maintain
the natural stream dimension DWQ will require the construction of floodplain benches at both the inlet
and outlet end of one of the culverts In order to maintain the normal stream dimension Floodplain
benches are typically excavated backfilled with native material to the bankfull bench elevation and
stabilized with coir fiber and a riparian seed mix The face of the floodplain bench must be stabilized
using Class 11 riprap or shot rock to provide initial bench stability Plans must be revised to depict the
construction of floodplain benches to include a detail of their construction
2 The plans indicate that the culverts will be buried one (1) foot A site visit indicates a visible bedrock
layer under the existing bridge and bedrock visible for approximately 15 feet downstream Please
advise how the culvert will be installed in bedrock DWQ does not typically authorize the blasting of
bedrock for culvert installation
The plans indicate that the intermittent stream located on the northeast side of the stream will be
filled DWQ does not authorize the filling of jurisdictional streams without providing for continued
conveyance of water Will the water be directed to the lateral base ditch ? If the water is being
conveyed to the lateral base ditch the detail provided for the base ditch does not indicate any type of
stabilization DWQ requires that the base ditch be lined with coir fiber matting and stabilized with a
riparian seed mix if the jurisdictional stream is being relocated to the base ditch Please indicate how
the water from the intermittent channel will continue be conveyed to the perennial stream
4 Provide a detail of how the lateral base ditch will tie into the perennial stream This should include the
change in elevation of the ditch at the confluence with the perennial stream and the slope of the
proposed base ditch

Therefore pursuant to 15A NCAC 2H 0507(a)(5) we will have to place the permit modification request on hold
until we are supplied with the necessary information You have 21 days to respond in writing with the requested
information or notification to this office that the information is forthcoming If at the end of the 21 days this
office has not received this information in writing we will assume you are withdrawing your application and it will
be returned Furthermore until the information is received by the NC Division of Water Quality we request by
copy of this letter that the US Army Corps of Engineers place the permit modification request on hold If you
