Dear Counsel:
The observation portion of the color perception study Blue Ridge Paper Products agreed
to do in Paragraph B.1, of the Partial Settlement Agreement is complete. Independent observers
viewed eight river sites on June 30, September 15 and November 10, 2012, The study began
later than anticipated as EPA and DWQ approval of the study protocol was not received until
June 1, 2012, The last observation event was delayed twice due to predicted rain events, and did
not take place until November 10, 2012.
Drs. Prestrude and Cherry, the leaders of the study, have begun work on a report. The
Partial Settlement Agreement requires Blue Ridge Paper to exercise "best efforts" to complete
the study and submit a report to DWQ and the NPDES Committee before January 1, 2013. Blue
Ridge, with the assistance of Drs. Cherry and Prestrude, has been working diligently on the
study, however, the report will not be finished in time for submittal before January 1, 2013.
Given the delays in starting and completing the observation events and allowing sufficient time

for report preparation and review, Blue Ridge expects to submit the report no later than January
21S`, 2013 in electronic format. Copies will be provided all counsel.

sending a copy of this letter to Judge Randall May as well to advise him of this development.
