Subject: RE: Town of Swansboro, SAW- 2012 - 00829, CAMA Major App, NWP1 (UNCLASSIFIED) Good afternoon, I believe that this correspondence refers to the no wake zone already established in the North Carolina Administrative Code by statutory authority of the NC Wildlife Resources Commission: 15A NCAC 10F.0369 TOWN OF SWANSBORO (a) Regulated Area. This Rule applies to the waters of the White Oak River from the Highway 24 bridge southward toward Casper's Marina, approximately 50 yards from the east shoreline of the Swansboro Town limits and marked by buoys. (b) Speed Limit. No person shall operate any motorboat or vessel at greater than no wake speed within any of the regulated area described in Paragraph (a) of this Rule. (c) Placement and Maintenance of Markers. The Town of Swansboro is designated a suitable agency for placement and maintenance of the markers implementing this Rule. History Note: Authority G.S. 71A -15; 72A -3; Eff. October 1, 2004; Amended Eff. June 1, 2005. In 2010 our Engineering Services Division and this office worked with Swansboro officials and with USACE to determine best placement of no wake buoys along the waterfront pursuant to this Rule, while not encroaching on the federal channel and setback area. I have attached the map created by our GIS specialist, showing proposed buoy locations presented by Swansboro and our suggested locations for buoys to not encroach on USACE setbacks. In some areas we had to recommend buoys only 30 yards from shore so as to not encroach into the setback area. The NCWRC does not purchase, place and maintain no wake buoys and we have no objection to the placement of buoys by the town of Swansboro or its designee, as long as the markers conform to US ATONS standards and are placed according to the agreed upon locations. We do ask that once these markers are placed that the Town notify me so that we can update our maps and let our Enforcement Officers know of the new markings. Also, we have had inquiries from Casper's Marina about placing a buoy at their marina. If there is a designee to purchase and place a buoy, and if it falls within the allowed area on the attached maps we have no objections. If we can be of further assistance please let me know. Since the buoys would be placed outside our Federal navigation jurisdiction, USACE Navigation Branch would not have any objection to the placement of these items, as long as any proposed no wake zone is established landward (northwest direction) of their locations. All no wake zones in NC are officially established and enforced by the NC Wildlife Resource Commission. Please contact Betsy Foard for the application process. No Wake Zones and other boating restriction markers on Federal navigation channels will not be permitted unless the Wilmington District Commander determines that substantial safety concerns exist and that the restriction will remedy those concerns without significant impacts to the "navigable capacity" of the Federal Channel. This proposal to place three no wake buoys meets the terms and conditions of NWP1(Aids to Navigation). Thus, the Corps Regulatory Division has no objections for the proposed no wake buoys. The assigned Action ID for this project is SAW- 2012 - 00829. Please note a NO WAKE ZONE in this area is not approved by the Corps of Engineers. Should the Town wish to pursue approval of a Federal NO WAKE ZONE in this area, they will need to contact Mr. Todd Horton of our Navigation Branch. The NWP1 referenced above only applies to our approval of the buoys under Section 10 of the Rivers and Harbors Act.
