Navigation Branch has revie- wed the proposed buoy locations and it appears they are located outside the Federal navigation
channels of S- ansboro Basin and entrance channel, as -well as outside the setback limit. Since the buoys would be placed
outside our Federal navigation jurisdiction, USACE Navigation Branch -would not have any objection to the placement of these
items, as long as any proposed no -wake zone is established land-ward (north-west direction) of their locations. All no -wake zones
in NC are officially established and enforced b-,- the NC Wildlife Resource Commission. Please contact Betsv Foard for the
application process.
No Wake Zones and other boating restriction markers on Federal navigation channels -will not be permitted unless the
Wilmington District Commander determines that substantial safety concerns exist and that the restriction -will remedy those
concerns ,without significant impacts to the "navigable capacity" of the Federal Channel. Other means of addressing such safety
concerns -will have to be considered before a no -wake zone can be considered.

Reference the application submitted by the of SNN- ansboro to install a three "no -,rake" buoys along the boundaries of a
formerly NCWRC No Wake Zone, N aternvard of Main Street, Church Street, and Moore Street, on the White Oak River, in
S,, ansboro, Onslo,,N- County, North Carolina.

This proposal to place three no wake buoys meets the terms and conditions of NWP1 (Aids to Navigation). Thus, the
Corps Regulatory Division has no objections for the proposed no,,rake buoys. The assigned Action ID for this project is SAW -
2012- 00829.
Please note a NO WAKE ZONE in this area is not approved by the Corps of Engineers. Should the To- n -,wish to
pursue approval of a Federal NO WAKE ZONE in this area, they -will need to contact Mr. Todd Horton of our Navigation
Branch. The NWP1 referenced above only applies to our approval of the buoys under Section 10 of the Rivers and Harbors
Act.
