Dear Mr. Jolly:
Thank you for your letter of May 17, 2012. Orton Plantation Holdings, LLC ("Orton")
appreciates this opportunity to propose a resolution in advance of your final decision on
our application for a Section 404 Permit.
In response to your letter, Orton is developing an amended proposal for avoidance and
minimization, However, no reference is made to Orton's May 16 response to the
comments submitted by EPA by letter of May 3. Thus, it is not clear whether you had the
benefit of the May 16 letter when you sent your letter of May 17? The May 16 response
addressed several of the issues raised in your letter. We would like to explore some of
those issues with you further, and we would like to discuss additional avoidance and
minimization measures we plan to propose. To that end, I propose a meeting with you
and your staff, with adequate time to discuss and resolve the remaining issues. Given the
proposed deadline of June 15, 2012, we suggest that we schedule the meeting within the
next week or two. I could make myself available to meet next week if that is convenient
for you.
I look forward to hearing from you. Our team will make every effort to accommodate a
meeting time convenient for you and your staff.
