The Division has determined that your application is incomplete and cannot be processed. The application is on-hold until all of the following information is received: In a letter sent to the Division dated February 2, 2021 you indicated the Hebron Road Extension is neither scheduled nor funded and that a 70’ right-of-way proposed under this project is necessary for the future possibility the extension is constructed. Additionally, you have indicated all site improvements at the crossing depicted in the plans submitted are necessary in order to support the driveway for the high school only. This Office believes the proposed 136’ culverts, outlet protection, fill, and other associated activities with this crossing also accommodate the extra width of the 70’ right-of-way being reserved for future Hebron Road Extension. If this Office has interpreted your response incorrectly, please provide additional details, including site plans that more clearly depict the proposed crossing [15A NCAC 02H .0506(b)(1)]. Please provide detailed engineering plans, profile view, and cross-section of the proposed culvert for Stream SE. Please include details regarding stream alignment in relation to pipe alignment, pipe slope, pipe burial, and dissipator pad. The Division previously requested this information but believes it was not provided. Your response dated February 2, 2021 indicated this information was provided on Sheets C-7 and C-8, however those sheets appear to address the two 136’ box culverts at Impact Area #1 (Stream SD) and the 63’ box culvert at Impact Area #2. Mitigation is required for losses of equal to or greater than 300 linear feet of perennial stream. Please provide a mitigation plan that conforms to the requirements of 15A NCAC 02H .0506(c). Furthermore, buffer mitigation is required for some of the proposed buffer impacts. Please submit a mitigation plan detailing the amount of buffer impact for Zone 1 and/or Zone 2 and how the impact will be mitigated. [15A NCAC 02B .0714]. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information as a reply to this email or by submitting all of the above requested information through this link: https://edocs.deq.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under Section 401 of the Clean Water Act or the Neuse Riparian Buffer Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
