9. PROJECT DESCRIPTION
Billy Farrington, representing Hammerhead Corporation, Inc., has requested that the attached application be processed
under the Express Permit Review Program.
The applicant's project is located at 6802 Emerald Drive, adjacent to Bogue Sound, in the Town of Emerald Isle,
Carteret County. To find the property, take Highway 24 west from Morehead City towards Cape Carteret. Turn left onto
Highway 58 and travel across the Emerald Isle high-rise bridge. Turn left on Emerald Drive into the Shell Cove
subdivision and the property will be located on the left hand side of the road approximately 0.1 miles. The subject site
is bordered by residential properties to the west, a church to the east, NC Highway 5 8 to the south and Bogue Sound to
the north.
The subject property is approximately 5.39 acres with roughly 430 linear feet of shoreline along Bogue Sound (the
northern property line). The site is part of the Shell Cove subdivision and is currently undeveloped. Elevations at the
site range from 4' to 12' above Mean High Water (MHW). High-ground vegetation on the tract consists primarily of
Long Leaf Pine, Live Oak, Cedar and Red Maple. Most of the under story vegetation has been cleared, however there is
a small stand of vegetation along the waters edge that consists of Wax Myrtle, Yaupon, and Red Bay. Transitional
species on the property including: Sea Oxeye (Borrichia frutescens), and Grounsel-bush (Baccharus halimif lia) are
located along the upper edge of the coastal wetlands. High coastal marsh vegetation, including, Black Needle Rush
(Juncus roemarianus), Spike Grass (Distichlis spica ta), and Salt Meadow Grass (Spartina patens) complete the
transition to the waters edge where Smooth Cordgrass Marsh (Spartina alterniflora) is the predominant species. The
marsh area adjacent to the site ranges in width from approximately 20 to 400 feet.
The waters of Bogue Sound, adjacent to the project site, are classified as SA-ORW by the North Carolina Division of
Water Quality. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries.
According to the Division of Environmental Health, Shellfish Sanitation Section, this area of Bogue Sound is OPEN to
the harvesting of shellfish.
PROPOSED PROJECT
The applicant proposes to fill and grade approximately 74,606 sq. ft. of high ground within the Shell Cove North
subdivision. According to the application package, compatible fill material would be placed on Lots 5 through 9. The
fill material would be graded and stabilized with vegetation prior to future home site construction.
Starting at the terminal end of Canal Drive and working east, the applicant proposes to install a 10' x 50' construction
entrance, consisting of marl. The construction entrance would provide direct access to Lots 5 through 9. Fill material
would be spread throughout the Lots and graded down towards the north, or towards Bogue Sound. A temporary
sediment trap would be constructed along the upper limits of the "404" and coastal wetland line and outside of the 30'
Coastal Shoreline Buffer. The sediment trap would span from the western edge of Lot 5 to the eastern edge of Lot 9.
Additional high ground and vegetated wetlands would remain undisturbed along the northern side of the proposed trap.
It should be noted that the applicant received a CAMA Minor permit (#06-68) from the Town of Emerald Isle on
12/12/06. The permit authorized land-disturbing activities within the 575-foot AEC at 6802 Emerald Drive. However,
subsequent to the issuance of the CAMA Minor Permit, it was discovered that the associated grading and filling would
disturb more than one acre, thus requiring Sedimentation and Erosion Control Plan, as well as a State Stormwater Plan.
Therefore, the associated grading of the property the and construction of a temporary sediment trap, which are located
within the 575-foot Area of Environmental Concern (AEC), in additional to the requirements for obtaining State
Stormwater and Sedimentation and Erosion Control approval, requires this project to be reviewed under the CAMA
Major development process.

The applicant has indicated that sewer and water would be provided by on-site systems. The Department of
Environmental Health, Water Supply Section, has issued a public water supply permit to the applicant. The
authorization to construct a water supply well was approved under permit NCDENR-05-01708, on 11-28-05. In
addition, the applicant has submitted an Express Low-Density Stormwater Permit application to the North Carolina
Division of Water Quality. The Express Stormwater permit application is currently in review, under project number
SW8070432. Lastly, the applicant has also submitted, and obtained approval of a Sedimentation and Erosion Control
Plan (SECP) from the Division of Land Quality. The plan was approved on 4/03/07, and was issued under Carte-2007-
324.
10. ANTICIPATED IMPACTS:
The initial grading of the property would result in the disturbance of approximately 74,606 sq. ft. (1.71 acres) of high
ground. No impacts are proposed within the 30' coastal shoreline buffer, coastal wetlands or surface waters.

and stored off site,and there will be one dozer used and stored on site. Future seeding and vegetation efforts will be
done and a farm tractor may be used and stored briefly on site.

package to be complete. Items (a) -- (0 are always applicable to any major development application. Please consult the application

NARRATIVE
Shell Cove North is a 9 lot subdivision, located adjacent to NC 58 on
Emerald Isle, N.C..
Phase One was put on record in 2004. Phase One is a four (4) lot
subdivision. No land disturbing activities were required for the approval
process. Noland disturbing activities will be done at this time for Phase
One. All lots front on NC 58 so DOT driveway permits will be granted to
allow for all lots to enter and exit onto NC 58. The owners decided to
take advantage of the public R/W of Canal Drive, and subsequently, a
driveway was built within an easement so all four lots could gain access not
from NC 58, but from Canal Drive. Lot 4 (the most eastwardly lot in Phase
One) was sold to Pete Horst Yacht Sales. There is no land disturbance in
this phase. Lot impervious limits for these lots (1- 4) is 7,050 square feet
for each lot.
Phase Two was put on record in 2006. Phase Two is a five (5) lot
subdivision. This Phase requires land disturbing activities and therefore a
number of permits. There are approximately 74,606 square feet (1.71
acres) of high ground that will be disturbed by the addition of select fill.
By adding fill, the owners of Lots 5 - 9 will be able to construct residences
several feet higher than normal and perhaps be able to avoid or minimize
storm f food levels. Lots 5 - 9 could also be granted driveway permits from
the DOT, but a central driveway easement was placed on the land and it
suits the community better. A neighborhood boat basin, which is not a part
of this project, will be constructed at a later date. Lot impervious limits
for these lots (5 - 9) is 9,800 square feet for each lot. The town of
Emerald Isle is the adjacent riparian owner on the East side of the property.
