of 6 PART VIII ACRONYMS Part VIII 1 of 1 11 Permit No NCS000523 PART I PERMITTED ACTIVITIES During the period beginning on the effective date of the permit and lasting until expiration, NCTA is authorized to discharge general roadway drainage borrow pit wastewater and stormwater associated with active NCTA projects Covered NCTA activities include the following • Facilities with any of the following activities • Pesticide and fertilizer storage • Salt and deicing chemical storage • Construction activities requiring erosion control as required by geographical restrictions • Borrow pits /waste piles • General roadway drainage Waste pile activities shall be covered under tlus permit unless the site requires a permit from the Division of Waste Management If a Division of Waste Management permit is required, the facility must also file an application with Division of Water Quality (DWQ) for coverage under a separate NPDES stormwater permit All new general roadway drainage construction and borrow pit/waste pile activities will receive automatic coverage under this permit upon notification to DWQ (see Part III Section A 2 ) New industrial facilities must request coverage under this permit (see Part III Section A, Paragraph 2 a ) All discharges authorized herein shall be managed in accordance with the terms and conditions of this permit and adequately treated as necessary Any other point source discharge to surface waters of the state is prohibited unless it is an allowable non stormwater discharge or is covered by another permit authorization or approval Coverage of material storage areas and musing activities under this permit supersedes the requirements to seek discharge authorization under the NCDENR general permits NCG020000 (applicable to stormwater point source discharge outfalls associated with mining and quarrying of nonmetallic minerals (except fuels) land disturbance and vehicle maintenance, mine dewatering discharge outfalls wastewater discharge outfalls from sand and/or gravel operations nondischargmg closed loop recycle systems, and process recycle wastewater discharge outfalls) unless specifically required by the Director This permit does not include water quality based effluent limits therefore in the event the permuttee s discharges are found by the Division to cause or contribute to a violation of in stream water quality standards, the Division ( NCDENR Division of Water Quality) may take enforcement action or NCTA and DWQ shall conduct an assessment and implement the permit requirements necessary to adequately address the permittee s contribution to the water quality standards violation Applicable programs under this permit shall be initiated as NCTA projects require them This permit does not � PART H MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED DISCHARGES SECTION A ILLICIT DISCHARGE DETECTION AND ELIMINATION PROGRAM Objectives i Implement an Illicit Discharge Detection and Elimination Program to assure that potential illicit discharges spills and illegal dumping into the NCTA municipal separate storm sewer system are detected and eliminated it NCTA shall implement appropriate procedures and actions to report illicit spills, discharges and illegal dumping for appropriate enforcement or other action by NCDENR b Management Measures The NCTA shall implement the following management measures to meet the objectives of the Illicit Discharge Detection and Elimination Program and shall notify DWQ prior to modification of any goals Management Measurable Goals YR 1 YR 2 Measures (a) Provide illicit NCTA shall provide annual training for appropriate staff X X discharge and contractors Trainin g shall include identification and identification reporting of illicit SECTION B POST - CONSTRUCTION CONTROLS Stormwater System Inventory and Pnoritizahon Program a Objectives 1 Develop and maintain a statewide NCTA stormwater system inventory for the purpose of supporting the Post Construction Program and Illicit Discharge Detection and Elimination Program it Maintain a stormwater system to map sensitive water crossings b Management Measure The NCTA shall implement the following management measure to meet the objectives of the Stormwater System Inventory and Prioritization Program and shall notify DWQ prior to modification of any goals Management Measure Measurable Goals YR 1 YR 2 (a) Develop and NCTA will develop and maintain a stormwater outfall X X maintain a inventory to include outfalls from primary and secondary stormwater roadways that basis and in keeping with the current DWQ policy on new stormwater treatment technologies b Management Measures The NCTA shall implement the following management measures to meet the objectives of the BMP Toolbox for Post Construction Runoff Program and shall notify DWQ prior to modification of any goals Management Measures Measurable Goals YR 1 YR 2 (a) Develop a BMP NCTA will develop a stormwater BMP Toolbox to X Toolbox provide internal guidance on design of post - construction runoff control measures The BMP Toolbox will include appropriate uses /anticipated applications design criteria, materials specifications and pollutant removal potential Innovative or proprietary BMPs will be evaluated in keeping with DWQ policy for permitting new /mnovative technologies( Permitting New Stormwater Treatment Technologies DEHNR November 24 1997 or as amended) (b) Evaluate BMPs defined NCTA shall fully evaluate the water quality BMPs X in DWQ s Stormwater defined in the Stormwater Best Management Best Management Practices Manual [NCDEHNR November 1995 and Practices Manual for as may be subsequently amended] and produce linear applicability guidance on the suitability of each for NCTA applications The guidance shall form the baseline BMP Toolbox and include appropriate uses construction guidelines, siting constraints etc (c) Evaluate design related NCTA shall investigate the potential stormwater X X BMPs impacts during the planning phase of a project by consultmg the Toolbox to evaluate design related BMPs Documentation of the investigation shall include recommendations and Maintenance Program to aid in the inspection operation and maintenance of BMPs b Management Measures The NCTA shall implement the following management measures to meet the objectives of the BMP Inspection and Maintenance Program and shall notify DWQ prior to modification of any goals Management Measures Measurable Goals YR 1 YR 2 (a) Evaluate BMP NCTA will evaluate BMPs included in the BMP X inspection and Toolbox for inspection and maintenance needs The maintenance needs evaluation will include consideration of the BMP type sitmg conditions and State Stormwater Permit requirements (b) runoff program to regulate stormwater runoff by requiring structural and non structural best management practices to protect water quality reduce pollutant loading and minimize post construction impacts to water quality b Management Measures The NCTA shall implement the following management measures to meet the objectives of the Post Construction Runoff Control Program and shall notify DWQ prior to modification of any goals Management Measures Measurable Goals YR YR 1 2 (a) Develop a Post NCTA shall work with DENR to develop a Post X X Construction Construction Stormwater Program (PCSP) runoff Use only approved vegetation management materials Management Measures The NCTA shall implement the following management measures to meet the objectives of the Vegetation Management Program and shall notify DWQ prior to modification of any goals Management Measures Measurable Goals YR 1 YR 2 (a) Implement appropriate NCTA shall require staff and contractors to utilize X X pest control properly permitted under applicable laws and rules b Coordinate with DENR the reporting of non permitted or under permitted discharges that adversely impact or have the potential to adversely impact NCTA s discharges including discharges that result from the direct or indirect stormwater discharges entering its system 2 Management Measures The NCTA shall implement the following management SECTION D CONSTRUCTION Sediment and Erosion Control Program Objectives i Control development activities disturbing one or more acres of land surface including activities by NCTA contractors u Require construction site operators to implement appropriate erosion and sediment control practices ill Require site inspection and enforcement of control measures iv Establish requirements for construction site operators to control waste that may cause adverse impacts to water quality such as discarded building materials concrete truck washout chemicals litter and sanitary waste at the construction site b Management Measures Implementation of a NCDENR Division of Land Resources Erosion and Sediment Control Program and unplementation of the General Permit NCGO 10000 effectively meets the objectives above by permitting and controlling development activities disturbing one or more acres of land surface and those activities less than one acre that are part of a larger common plan of development The delegated program is authorized under the Sediment Pollution Control Act of 1973 and Chapter 4 of Title 15A of the North Carolina Administrative Code This program includes procedures for public input sanctions to ensure compliance requirements for construction site operators to implement appropriate erosion and sediment control practices review of site plans which incorporates consideration of potential water quality impacts and procedures for site inspection and enforcement of control measures Currently this program has been delegated to NCDOT by the Sedimentation Control Commission in February 1991 and as may be subsequently amended and applied to NCTA construction projects as described in the memorandum of understanding (MOU) between NCDOT and NCTA Future applicable programs may be delegated to the NCTA u NCTA shall mcorporate the applicable requirements of NCGO10000, the North Carolina General Permit to Discharge Stormwater under the National Pollutant Discharge Elimination System associated with construction activities issued October 1 2001 and as may be subsequently amended into the delegated Erosion and Sediment Control Program Part H Page 9 of 13 Permit No NCS000523 2 Borrow Pit and Waste Pile Activities a Objective Implement sediment and erosion control measures and reclamation plans on all borrow pit and waste pile projects (soil waste or disposal areas) associated with NCTA projects in keeping with the sediment and erosion control program established by the North Carolina Sediment Control Commission Existing commercial quarries and borrow pits not under the control of NCTA are covered under their own individual applicable permits b Management Measures The NCTA shall unplement the following management measures to meet the objectives of the Borrow Pit/Waste Pile Program and shall notify DWQ prior to modification of any goals Management Measures Measurable Goals YR 1 YR 2 (a) Implement erosion and NCTA shall implement erosion and sediment control X X sediment control measures on all borrow pit and waste pile projects measures on all borrow The measures utilized shall be in keeping with the pits /waste piles erosion and sediment control within areas where NCTA operates or has planned active projects u The training should include topics such as spill control, chemical application illicit connections and illegal dumping b Management Measures The NCTA shall implement the following management measures to meet the objectives of the Public Education and Involvement Program Internal NCTA shall notify DWQ prior to modification of any goals Additional training programs are listed under other programs such as the BMP Toolbox the BUT Inspection and Maintenance Program and the Vegetation Management Program Management Measures Measurable Goals YR 1 YR 2 (a) Provide pollution NCTA shall provide and maintain annual stormwater X X prevention pollution awareness training for appropriate NCTA awareness training personnel and different social economic and age groups ui Establish and maintain public involvement in NCTA stormwater quality programs b Management Measures The NCTA shall implement the following management measures to meet the objectives of the Public Education and Involvement External and shall notify DWQ prior to modification of any goals Manage t Measurable Goals Y1R Y2R rme a Develop and NCTA shall develop the External Education and X submit an Involvement Plan and submit to DWQ for approval External in Year 1 The plan shall include the requirements Education and for the measurable goals below conduct research with faculty and staff at state universities of other designated institutions that result in independent quantitative assessment of pollutant loads from NCTA permitted activities and/or measure BMP effectiveness b NCTA will work with DENR NCDOT or other agencies to conduct research to enhance or vnprove existing practices or develop new methods or processes with state of the art technology to meet future permit requirements 2 Management Measures The NCTA shall implement the following management measures to meet the objectives of the Research Program and shall notify DWQ prior to modification of any goals Management Measures Measurable Goals YR 1 YR 2 a Develop a NCTA shall develop a Research Program that shall be in X Research Plan keeping with the guidelines established by the Federal Highway Administration Evaluation and Management of Highway Runoff Water Quality Manual WHWA PD 96 032 or any updates) The Program shall be documented in the Research Plan the X Research Plan Research Plan Part II Page 13 of 13 Permit No NCS000523 PART III OTHER REQUIREMENTS SECTION A REPORTING AND RECORD KEEPING REQUIREMENTS Program Assessment NCTA shall provide DWQ with an annual report consisting of a program summary and assessment The report shall include the status of each component in Part H of this permit, proposed changes to the stormwater management program or implementation schedule a summary of illicit connection and illegal dumping reports and inspections identification of water quality improvement or degradation as a result of NCTA activities and successes failures and milestones /accomplishments of the program b The annual report shall be submitted to DWQ no later than March 1 of each year The annual assessment report shall cover the period from January 1 through December 31 that immediately preceded the submittal date An annual report will not be submitted in year 1 as the permit would not apply to the previous year c NCTA shall maintain a copy of each annual program assessment report on file for a period of five years 2 New Activities and Facilities Seeking Coverage a New NCTA activities and facilities wluch are subject to and completed construction and borrow pit/waste pile activities for a specified tune period within the previous five years of the request date Notification shall consist of the project location size receiving stream name(s) and classification(s) wastewater treatment management measures and contact person All new construction activities and borrow pits /waste piles must meet the requirements of this permit regardless of notification status c NCTA shall provide the notification in an electronic format compatible with DWQ systems Report Submittals Duplicate signed copies of all reports required herein, shall be submitted to the following address Division of Water Quality Surface Water Protection Section Stormwater Permitting Unit 1617 Mail Service Center Raleigh, North Carolina 27699 1617 Part III Page 1 of 4 Permit No NCS000523 b All applications reports or information submitted to DWQ shall be signed by a principal executive officer or duly authorized representative A person is a duly authorized representative only if I The authorization is made in writing by a principal executive officer u The authorization specified either an individual or a position having responsibility for the overall operation of a regulated facility or activity or an individual or position having overall responsibility for envrronimental/stormwater matters and rrr The written authorization is submitted to the Director c Any person signing a document under paragraphs a or b of this section shall make the following certification "I cerhfy under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted Based on my inquiry of the person or persons who manage the system or those persons directly responsible for gathering the information, the information submitted is to the best of my knowledge and belief true accurate and complete I am aware that there are significant penalties for submitting false information including the possibility of fines and imprisonment for knowing violations " 4 Recording Results For each measurement sample, inspection or maintenance activity performed or collected pursuant to the requirements of this permit the permrttee shall record the following information. a The date exact place and time of sampling measurements inspection or maintenance activity b The individual(s) who performed the sampling measurements inspection or maintenance activity C The date(s) analyses were performed CL The individual(s) who performed the analyses e The analytical techniques or methods used and f The results of such analyses 5 Planned Changes The permrttee shall give notice to the Director as soon as possible of any planned changes which could significantly alter the nature or quantity of pollutants discharged This notification requirement includes pollutants that are not specifically listed in the permit or subject to notification requirements in 40 CFR Part 122 42 (a) Part III Page 2 of 4 Permit No NCS000523 Anticipated Noncompliance The permittee shall give notice to the Director as soon as possible of any planned changes which may result in noncompliance with the permit requirements 7 Twenty -four Hour Reporting a The permittee shall report to the central office or the appropriate regional office any noncompliance or reasonably anticipated non - comphance which may endanger health or the environment Any information shall be provided orally within 24 hours from the time the permittee becomes aware of the circumstances A written submission shall also be provided within 5 days of the time the permittee becomes aware of the circumstances To report an environmental emergency call 1 800 858 0368 b The written submission shall contain a description of the noncompliance and its causes the period of noncompliance including exact dates and tunes and if the noncompliance has not been corrected the anticipated tune compliance is expected to continue and steps taken or planned to reduce eliminate and prevent reoccurrence of the noncompliance The Director may waive the written report on a case by case basis if the oral report has been received within 24 hours 8 Other Information Where the permittee becomes aware that it failed to submit any relevant facts in applying to be covered under this permit or in any report to the Director it shall promptly submit such facts or information SECTION B COMPLIANCE SCHEDULE Stormwater Program Implementation NCTA may modify the stormwater management program implementation schedule through the annual reporting process Part III Page 3 of 4 Permit No NCS000523 SECTION C TOTAL MAXIMUM DAILY LOAD ASSESSMENT NCTA shall develop and implement a program to address unpaired waters for which a TMDL has been approved by EPA The program shall be unplemented in the drainage areas of those TMDLs which name the NCTA as a significant contributor of the pollutant of concern and assigns the NCTA a wasteload allocation (WLA) explicit from other point sources 2 For each TMDL the NCTA is subject to as described in (1) above the NCTA shall summarize the locations of NCTA outfalls already identified in its Stormwater Outfall inventory which are within its jurisdictional area with the potential of discharging the pollutant(s) of concern for established TMDLs to the unpaired segments to their tributaries and to segments and tributaries within the watershed contributing to the unpaired segments For each TMDL the NCTA is subject to as described in (1) above the NCTA shall develop an Assessment & Monitoring Plan (Plan) The Plan shall include an evaluation of the need for additional data collection related to the NCTA s discharge of the TMDL pollutant of concern Additional data collection to be evaluated may include (but does not require) supplemental inventory of NCTA outfalls monitoring an assessment of the effectiveness of existing BMPs and an assessment of the potential for non NCTA discharges entering the NCTA s conveyance system to negatively impact the quality of the NCTA s stormwater chscharge If the Plan proposes analytical monitoring then it shall include a description of the sample type frequency and any seasonal considerations Where appropriate the permittee may reduce the monitoring burden by proposing to monitor outfalls that the Division would consider substantially similar to other outfalls The monitoring plan shall be adjusted as additional outfalls are identified 4 The Plan shall include a schedule for implementing the proposed assessment and monitoring activities The Plan shall be submitted to DWQ for comments no later than 12 months after notification by DWQ that NCTA has been assigned a WLA DWQ shall complete its review of the plan within 6 months of receiving the plan from the permittee The NCTA shall uutiate implementation of the Plan within 6 months of receiving Plan approval from DWQ In accordance with the implementation schedule the NCTA shall provide in subsequent annual reports a summary of the assessment and monitoring activities performed within the reporting period Within 6 months of completing the assessments and monitoring activities outlined in the Plan the NCTA shall submit a report of its findings to DWQ The report shall include an assessment of whether additional structural and/or non structural BMPs are necessary to meet the NCTA s WLA The report shall include a schedule for implementing such BMPs Upon approval by DWQ the NCTA shall implement any needed BMPs in accordance with the schedule Subsequent annual reports after unplementation of the additional BMPs will report on their effectiveness Part III Page 4 of 4 Permit No NCS000523 PART IV STANDARD CONDITIONS SECTION A COMPLIANCE AND LIABILITY Duty to Comply NCTA must comply with all conditions of this permit Any permit noncompliance constitutes a violation of the Clean Water Act and is grounds for enforcement action for permit termination revocation and reissuance or modification or denial of permit coverage upon renewal application a. NCTA shall comply with standards or prohibitions established under section 307(a) of the Clean Water Act for toxic pollutants within the tune provided in the regulations that establish these standards or prohibitions even if the permit has not yet been modified to mcorporate the requirement b The Clean Water Act provides that any person who violates section 301 302 306 307 308, 318 or 405 of the Act or any permit condition or limitation implementing any such sections in a permit issued under section 402 or any requirement unposed in a pretreatment program approved under sections 402(a)(3) or 402(b)(8) of the Act is subject to a civil penalty not to exceed $27 500 per day for each violation The Clean Water Act provides that any person who negligently violates sections 301 302 306, 307 308 318 or 405 of the Act or any condition or limitation implementing any of such sections in a permit issued under section 402 of the Act or any requirement unposed in a pretreatment program approved under section 402(a)(3) or 402(b)(8) of the Act is subject to criminal penalties of $2 500 to $25 000 per day of violation or imprisonment of not more than 1 year or both. In the case of a second or subsequent conviction for a negligent violation a person shall be subject to criminal penalties of not more than $50 000 per day of violation or by imprisonment of not more than 2 years or both Any person who knowingly violates such sections or such conditions or limitations is subject to criminal penalties of $5 000 to $50 000 per day of violation or imprisonment for not more than 3 years or both. In the case of a second or subsequent conviction for a knowing violation a person shall be subject to criminal penalties of not more than $100 000 per day of violation or imprisonment of not more than 6 years, or both Any person who knowingly violates section 301 302 303 306 307 308 318 or 405 of the Act, or any permit condition or limitation implementing any of such sections in a permit issued under section 402 of the Act and who knows at that time that he thereby places another person in inmmment danger of death or serious bodily mjury shall upon conviction be subject to a fine of not more than $250 000 or imprisonment of not more than 15 years or both In the case of a second or subsequent conviction for a knowing endangerment violation a person shall be subject to a fine of not more than $500,000 or by imprisonment of not more than 30 years or both An organization, as defined in section 309(c)(3)(B)(ui) of the CWA shall upon conviction of violating the imminent danger provision be subject to a fine of not more than $1000 000 and can be fined up to $2 000 000 for second or subsequent convictions C Under state law a daily civil penalty of not more than ten thousand dollars ($10 000) per violation may be assessed against any person who violates or fails to act in accordance with the terms conditions or requirements of a permit [Ref North Carolina General Statutes 143 215 6A] Part IV Page 1 of 6 Permit No NCS000523 CL Any person may be assessed an administrative penalty by the Director for violating section 301 302 306 307 308 318 or 405 of the Act or any permit condition or linutation implementing any of such sections in a permit issued under section 402 of the Act Administrative penalties for Class I violations are not to exceed $11000 per violation, with the maximum amount of any Class I penalty assessed not to exceed $27500 Penalties for Class Il violations are not to exceed $11000 per day for each day during which the violation continues with the maximum amount of any Class II penalty not to exceed $137 500 2 Duty to 1VLthgate NCTA shall take all reasonable steps to minim, 7e or prevent any discharge in violation of tins permit wluch has a reasonable likelihood of adversely affecting human health or the environment Civil and Criminal Liability Except as provided in Part IV Section B Paragraph 3 of this permit regarding bypassing of stormwater control facilities nothing in this pernut shall be construed to relieve the permittee from any responsibilities liabilities or penalties for noncompliance pursuant to NCGS 143 215 3 143 215 6A 143 215 6B 143 215 6C or Section 309 of the Federal Act 33 USC 1319 Furthermore the permittee is responsible for consequential damages such as fish kills even though the responsibility for effective compliance may be temporarily suspended 4 Oil and Hazardous Substance Liability Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities liabilities or penalties to which the pemuttee is or may be subject to under NCGS 143 -215 75 et seq or Section 311 of the Federal Act 33 USC 1321 5 Property Rights The issuance of this permit does not convey any property rights in either real or personal property or any exclusive privileges nor does it authorize any mjury to private property or any invasion of personal rights nor any infringement of Federal State or local laws or regulations 6 Severability The provisions of this permit are severable and if any provision of this permit or the application of any provision of this peanut to any circumstances is held invalid the application of such provision to other circumstances and the remainder of this permit, shall not be affected thereby 7 Duty to Provide Information The permittee shall furnish to the Director within a reasonable time any information which the Director may request to determine whether cause exists for modifying revoking and reissuing or terminating the coverage issued pursuant to this permit or to determine compliance with tlus permit The permittee shall also furnish to the Director upon request copies of records required by this permit Part IV Page 2 of 6 Permit No NCS000523 8 Penalties for Tampering The Clean Water Act provides that any person who falsifies tampers with or knowingly renders maccurate any monitoring device or method required to be maintained under this permit shall, upon conviction be punished by a fine of not more than $10 000 per violation or by imprisonment for not more than two years per violation or by both If a conviction of a person is for a violation committed after a first conviction of such person under this paragraph punishment is a fine of not more that $20 000 per day of violation or by imprisonment of not more than 4 years or both 9 Penalties for Falsification of Reports The Clean Water Act provides that any person who knowingly makes any false statement representation or certification in any record or other document submitted or required to be maintained under this permit including monitoring reports or reports of compliance or noncompliance shall upon conviction be punished by a fine of not more than $10 000 per violation, or by imprisonment for not more than two years per violation or by both 10 Permit Actions This permit may be modified revoked and reissued, or terminated for cause The notification of planned changes or anticipated noncompliance does not stay any permit condition Part IV Page 3 of 6 Permit No NCS000523 SECTION B OPERATION AND MAINTENANCE OF POLLUTION CONTROLS Proper Operation and Maintenance The permittee shall at all tunes properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this permit Proper operation and maintenance also includes adequate laboratory controls and appropriate quality assurance procedures This provision requires the operation of back up or auxiliary facilities or sumlar systems that are installed by a permittee only when the operation is necessary to achieve compliance with the conditions of the permit 2 Need to Halt or Reduce not a Defense It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the condition of this permit 3 Bypassing of Stormwater Control Facilities Bypass is prohibited and the Director may take enforcement action again st a permittee for bypass unless a Bypass was unavoidable to prevent loss of life personal injury or severe property damage and b There were no feasible alternatives to the bypass such as the use of auxiliary control facilities retention of stormwater or maintenance during normal periods of equipment downtime or dry weather This condition is not satisfied if adequate backup controls should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance and c The permittee submitted notices as required under Part III Section A of this permit d The Director may approve an anticipated bypass after considering its adverse effects if the Director determines that it will meet the three conditions listed above Part IV Page 4 of 6 Permit No NCS000523 SECTION C MONITORING AND RECORDS Representative Sampling Samples collected and measurements taken, as required herein shall be characteristic of the volume and nature of the pernutted discharge Analytical sampling shall be performed during a representative storm event Samples shall be taken on a day and tune that is characteristic of the discharge All samples shall betaken before the discharge joins or is diluted by any other waste stream, body of water or substance Monitoring points as specified in this permit shall not be changed without notification to and approval of the Director 2 Flow Measurements Where required appropriate flow measurement devices and methods consistent with accepted scientific practices shall be selected and used to ensure the accuracy and reliability of measurements of the volume of monitored discharges ` Test Procedures Test procedures for the analysis of pollutants shall conform to the EMC regulations published pursuant to NCGS 143 215 63 et seq the Water and Air Quality Reporting Acts and to regulations published pursuant to Section 304(g) 33 USC 1314 of the Federal Water Pollution Control Act as Amended and Regulation 40 CFR 136 To meet the intent of the monitoring required by this permit, all test procedures must produce muumum detection and reporting levels and all data generated must be reported down to the m,mmum detection or lower reporting level of the procedure 4 Inspection and Entry The permittee shall allow the Director or an authorized representative (including an authorized contractor acting as a representative of the Director) or in the case of a facility which discharges through a municipal separate storm sewer system, an authorized representative of a municipal operator or the separate storm sewer system receiving the discharge upon the presentation of credentials and other documents as may be required by law to a Enter upon the pernuttee's prenuses where a regulated facility or activity is located or conducted or where records must be kept under the conditions of this permit b Have access to and copy at reasonable tunes any records that must be kept under the conditions of this permit Inspect at reasonable tunes any facilities equipment (including monitoring and control equipment) practices or operations regulated or required under this permit and d Sample or monitor at reasonable tunes for the purposes of assuring permit compliance or as otherwise authorized by the Clean Water Act any substances or parameters at any location Part IV Page 5 of 6 Permit No NCS000523 Availability of Reports Except for data determined to be confidential under NCGS 143 215 3(a)(2) or Section 308 of the Federal Act, 33 USC 1318 all reports prepared in accordance with the terms of this permit shall be available for public inspection at the offices of DWQ As required by the Act analytical data shall not be considered confidential Knowingly making any false statement on any such report may result in the imposition of criminal penalties as provided for in NCGS 143 215 6B or in Section 309 of the Federal Act Part IV Page 6 of 6 Permit No NCS000523 PART V LIMITATIONS REOPENER This permit shall be modified or alternatively revoked and reissued, to comply with any applicable effluent guideline or water quality standard issued or approved under Sections 302(b) (2) (c) and (d) 304(b) (2) and 307(a) of the Clean Water Act if the effluent guideline or water quality standard so issued or approved a Contains different conditions or is otherwise more stringent than any limitation in the permit or b Controls any pollutant not limited in the permit The permit as modified or reissued under this paragraph shall also contain any other requirements in the Act then applicable The issuance of this permit does not prohibit the Director from reopening and modifying the permit revoking and reissuing the permit or terminating the permit as allowed by the laws rules and regulations contained in Title 40 Code of Federal Regulations Parts 122 and 123, Title 15A of the North Carolina Administrative Code Subchapter 2H 0100 and North Carolina General Statute 143 215 1 et al PART VI ADMINISTERING AND COMPLIANCE MONITORING FEE REQUIREMENTS The permittee must pay the administering and compliance monitoring fee within 30 (dlurty) days after being billed by the Division Failure to pay the fee in timely manner in accordance with 15A NCAC 2H 0105(b)(4) may cause this Division to initiate action to revoke the Certificate of Coverage Part V and VI Page 1 of 1 Permit No NCS000523 PART VII DEFINITIONS Act See Clean Water Act 2 Allowable Non Stormwater Discharges This permit regulates stormwater discharges Non stormwater discharges which shall be allowed in the stormwater conveyance system are (a) All other discharges that are authorized by a non stormwater NPDES permit (b) Uncontaminated groundwater foundation drams air conditioner or air compressor condensate without added chemicals springs discharges of uncontaminated potable water waterline and fire hydrant flushings water from footing drams flows from riparian habitats and wetlands imgation drainage landscape watering pavement wash water which does not use detergents and no spills or leaks or toxic or hazardous materials have occurred (unless all materials have been removed) routine external building wash down which does not use detergents and incidental windblown mist from cooling towers that collect on rooftops (c) Discharges resulting from fire fighting training without chemical additives or from fire fighting Best Management Practices (BMPs) Measures or practices used to reduce the amount of pollution entering surface waters BMPs may take the form of a process activity or physical structure 4 Borrow Pit A Borrow Pit means a man made depression in the ground created when earthen materials are removed to provide fill or materials at another site Often, the pit will fill with ram water or groundwater and must be dewatered to continue the removal of materials Bulk Storage of Liquid Products Bulk Storage of Liquid Products means liquid raw materials manufactured products waste materials or by products with a capacity that triggers compliance with 40 CFR 112 6 Bypass A bypass is the known diversion of stormwater or wastewater from any portion of a control facility including the collection system, which is not a designed or established operating mode for the facility 7 Clean Water Act The Federal Water Pollution Control Act also known as the Clean Water Act (CWA) as amended, 33 USC 1251 et seq Part VII Page 1 of 5 Permit No NCS000523 Division or DWO The Division of Water Quality Department of Environment and Natural Resources Director The Director of the Division of Water Quality the permit issuing authority 10 Grab Sample An individual sample collected instantaneously Grab samples that will be directly analyzed or qualitatively monitored must be taken within the first 30 minutes of discharge 11 Hazardous Substance Any substance designated in 40 CFR Part 116 pursuant to Section 311 of the Clean Water Act 12 Industrial Activrty For the purposes of this permit industrial activities shall mean all industrial activities listed defined in 40 CFR 122 26 with the exception of general roadway drainage construction activities and borrow pits /waste piles 13 Municipal Separate Storm Sewer System Municipal separate storm sewer means a conveyance or system of conveyances (including roads with drainage systems municipal streets catch basins curbs gutters ditches man -made channels or storm drams) (i) Owned or operated by a State city town borough county parish district association or other public body (created by or pursuant to State law) having jurisdiction over disposal of sewage industrial wastes storm water or other wastes including special districts under State law such as a sewer district, flood control district or drainage district or similar entity or an Indian tribe or an authorized Indian tribal organization or a designated and approved management agency under section 208 of the CWA that discharges to waters of the United States (ii) Designed or used for collectmg or conveying storm water (m) Which is not a combined sewer and (iv) Which is not part of a Publicly Owned Treatment Works (POTW) as defined at 40 CFR 1222 A Phase I MS4 includes medium and large MS4s To be a medium or large MS4 the MS4 must be located in an urbanized area with a population greater than 100 000 A Phase 11 MS4 includes regulated small MS4s To be a regulated small MS4 the MS4 must be located in an urbanized area with a population less than 100 000 but with selected population densities Part VII Page 2 of 5 Permit No NCS000523 14 Outfall The point of wastewater or stormwater discharge from a discrete conveyance system See also point source discharge 15 Permittee The owner or operator issued this permit (NCTA) 16 Point Source Discharge of Stormwater Any discernible, confined and chscrete conveyance including but not specifically limited to any pipe ditch, channel tunnel conduit well or discrete fissure from which stormwater is or may be discharged to waters of the state 17 Representative Storm Event A storm event that measures greater than 0 1 inches of ramfall and that is preceded by at least 72 hours in which no storm event measuring greater than 0 1 inches has occurred A single storm event may contain up to 10 consecutive hours of no precipitation For example if it rains for 2 hours without producing any collectable discharge and then stops a sample may be collected if a ram producing a discharge begins again within the next 10 hours 18 Secondary Containment Spill containment for the contents of the single largest tank within the containment structure plus sufficient freeboard to allow for the 25 year 24 hour storm event 19 Section 313 Water Priority Chemical A chemical or chemical category which a Is listed in 40 CFR 372 65 pursuant to Section 313 of Title III of the Superfund Amendments and Reauthorization Act (SARA) of 1986 also titled the Emergency Planning and Community Right to Know Act of 1986 b Is present at or above threshold levels at a facility subject to SARA title III Section 313 reporting requirements and That met at least one of the following criteria (1) Is listed in appendix D of 40 CFR Part 122 on either Table II (organic priority pollutants) Table III (certain metals cyanides and phenols) or Table IV (certain toxic pollutants and hazardous substances) (2) Is listed as a hazardous substance pursuant to Section 311(b)(2)(A) of the CWA at 40 CFR 116 4 or (3) Is a pollutant for which EPA has published acute or chronic water quality criteria Part VII Page 3 of 5 Permit No NCS000523 20 Sensitive Waters a Waters that are classified as lugh quality outstanding resource shellfish trout or nutrient sensitive waters in accordance with subsections (d) and (e) of 15A NCAC 2B 0101 (Procedures for Assignment of Water Quality Standards — General Procedures) b Waters that are occupied by or designated as critical habitat for aquatic animal species that are listed as threatened or endangered by the United States Fish and Wildlife Service or the National Marine Fisheries Service under the provisions of the Endangered Species Act of 1973 (Pub L No 93 205 87 Stat 884 16 U S C §§ 1531 et seq ) as amended c Waters for which the designated use as described by the classification system set out in subsections (c) (d) and (e) of 15A NCAC 2B 0101 (Procedures for Assignment of Water Quality Standards — General Procedures) have been determined to be impaired in accordance with the requirements of subsection (d) of 33 U S C § 1313 The following North Carolina water quality classifications are HQW by definition Water Supply I (WS I) Water Supply II (WS II) Shellfishmg (SA) and waters which DWQ has received a petition for reclassification to either WS I or WS -II 21 Severe Property Damage Means substantial physical damage to property damage to the control facilities that causes them to become inoperable or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass Severe property damage does not mean economic loss caused by delays in production 22 Significant Materials Includes but is not limited to raw materials fuels materials such as solvents detergents and plastic pellets finished materials such as metallic products raw materials used in food processing or production hazardous substances designated under section 101(14) of CERCLA any chemical the facility is required to report pursuant to section 313 of Title III of SARA fertilizers pesticides and waste products such as ashes slag and sludge that have the potential to be released with stormwater discharges 23 Significant Spills Includes but is not limited to releases of oil or hazardous substances in excess of reportable quantities under Section 311 of the Clean Water Act (Ref 40 CFR 110 10 and CFR 117 21) or Section 102 of CERCLA (Ref 40 CFR 302 4) 24 Stormwater Runoff The flow of water which results from precipitation and which occurs immediately following rainfall or as a result of snowmelt Part VII Page 4 of 5 Permit No NCS000523 25 Stormwater Associated with Industrial Activity The discharge from any point source which is used for collectmg and conveying stormwater and which is directly related to manufacturing, processing or raw material storage areas at an industrial site Facilities considered to be engaged in industrial activities" include those activities defined in 40 CFR 122 26(b)(14) The term does not include discharges from facilities or activities excluded from the NPDES program See also the definition of industrial activities 26 Stormwater Pollution Prevention Plan A comprehensive site specific plan which details measures and practices to reduce stormwater pollution and is based on an evaluation of the pollution potential of the site 27 Ten Year Design Storm The maximum 24 hour precipitation event expected to be equaled or exceeded on the average once in ten years Design storm information can be found in the State of North Carolina Erosion and Sediment Control Planning and Design Manual 28 Toxic Pollutant Any pollutant listed as toxic under Section 307(a)(1) of the Clean Water Act 29 Upset Means an exceptional incident in which there is unintentional and temporary noncompliance with technology based permit limitations because of factors beyond the reasonable control of the permittee An upset does not include noncompliance to the extent caused by operational error improperly designed treatment or control facilities inadequate treatment or control facilities lack of preventive maintenance or careless or improper operation 30 Waste Pile A Waste Pile means a stack or pile of materials remaining from construction or maintenance activities For NCTA projects these waste piles typically consist of earthen materials or
