On January 27 2012 the Division of Water Quality (DWQ) received your application dated December 15
2011 to fill or otherwise impact 23 508 square feet of Zone 1 Neuse River basin protected riparian buffers
and 12 713 square feet of Zone 2 Neuse River basin protected riparian buffers for a residential subdivision
On April 5 2012 DWQ received additional information The DWQ has determined that your application
and /or additional information was incomplete and /or provided inaccurate information as discussed below
The DWQ will require additional information in order to process your application to impact protected
buffers on the subject property This same information was requested in the March 5 2012 DWQ letter
Therefore if we do not receive the requested information your project will be formally returned as
incomplete Please provide the following information so that we may continue to review your project

1 Please include an approval letter from a mitigation bank or EEP stating that credits are available
and are being reserved for this project
2 DWQ is unable to approve a diffuse flow plan due to limited information provided Would you
prefer that we review the diffuse flow plan when you apply for the 401 WQC?
Please submit this information within 30 calendar days of the date of this letter Please send requested
information to DWQ Central Office, Attn Karen Higgins, 1650 Mail Service Center, Raleigh, NC 27699-
1650 If we do not receive this requested information within 30 calendar days of the date of this letter your
project will be returned and you will need to reapply with a new application
