Re Section 401 Water Quality Certification application
Dear Mr Brame
On February 3 2012 the North Carolina Division of Water Quality (Division) received a copy of your
application for a modified 401 General Water Quality Certification to impact an additional 319 linear feet
of an unnamed tributary to South Buffalo Creek for the 4009 West Wendover Ave Retail and Auto
Auction Parking Project in Greensboro NC in Guilford County On February 23 2012 the US Army
Corps of Engineers ( USACE) placed this project on Public Notice and the Division has commented to the
USACE regarding this project Additional information is required in order that we may determine your
project s compliance with 15A NCAC 2H 0500 The Division will require this information in order to
process your application to impact protected wetlands and/or streams on the subject property Therefore
we will place this project on hold as ;incomplete until we receive this additional information and if we do
not receive the additional information requested below we will have to move toward denial of your
application as required by 15A NCAC 2H 0506 Please provide the following information so that we
may continue to review your project
The Division requests that the parking requirements for the Kaplan School be evaluated in more
detail The original building is approximately 270 000 square feet Minimum parking for the
original building was determined to be 250 spaces per the previous permits issued by the USACE
and DWQ Therefore the approved parking requirements are approximately 1 space per 1000
square foot of building space The building expansion is proposed as an additional 10 000 square
feet The applicant proposes that 100 additional spaces are necessary for the 10 000 square foot
addition (12 original spaces will be lost and will need to be added elsewhere) however this does
not adhere to the previously determined minimum parking needs of 1 space/ 1000 square feet
The Division requests that the applicant provide further clarification of minimization of the
impacts related to this building expansion

2 The Division is aware that the USACE received comments during the Public Notice period that
require a response by the applicant Please submit your response to the public comments to this
office when you respond to the USACE
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to Sue Homewood at the address on this letterhead and a copy to Ian McMillan N C

27699 1650 If you will not be able to provide the requested information within that timeframe please
provide written confirmation that you intend to provide the requested information and include a specific
timetable delineating when the requested materials will be provided If we do not hear from you in 30

project as returned
This letter only addresses the application review and does not authorize any impacts to wetlands waters or
protected buffers Please be aware that any impacts requested within your application are not authorized (at
