Hardee Farms — Phase One Location New Bern, NC Purpose Narrative outlining need for further wetland impacts beyond the original protect scope and reasoning behind proposed mitigation chosen This narrative is in response to our 401 Certification initial Express Review meeting with the Washington Regional Office The intent of this letter is to provide a narrative to justify the additional impacts needed and to outline reasoning for the proposed mitigation for the proposed mitigation chosen Please refer to the site plans for illustration Site Modification — Additional Impacts Required This site was previously planned and permitted to include 0 04 ac of wetland fill A 401 Certification was approved by your office on February 22, 2012 and additionally the Nationwide Permit 29 for the 404 wetland fills was approved by the US Army Corps of Engineers on February 13, 2012 The wetland fill of 0 04 ac was the minimum at that time necessary to make the subdivision roadway crossings to access the land needed, and was under the required mitigation threshold of 0 10 ac Since that tune several discussions ensued between Thomas Engineering, the City of New Bern, and the Developer for Hardee Farms — Phase One regarding the increased traffic volumes traveling through the neighboring Brices Crossing subdivision As a result of these discussions and as a compromise with other parties involved, the Developer has agreed to extend a proposed subdivision road (Hardee Farms Rd) such that a second connection point to Brices Crossing will be constructed with the current project Due to this roadway extension and as illustrated by the plan several additional 404 wetland impacts (fills) are necessary to make the roadway crossings It is stressed that these impacts to the addition area are necessary as the roadway extension is being requested by the City of New Bern Additionally we feel that the additional road will add a safety factor for the overall site The traffic volumes in the existing Brices Crossing subdivision will be spread out, lessening the concentrated flow in any given area Additionally emergency vehicles will now have two access points into the proposed Hardee ENGINEERING, PA Mitigation Required Several additional wetland impacts are required due to the roadway extension these totaling approximately 0 39 ac All of the permanent impacts are wetland fills with one area being a temporary disturbance only for drainage pipe installation It is our understanding that mitigation is necessary for these type impacts when the area impacted is greater than 0 10 ac However both the 401 Certification and Nationwide Permit 29 are able to be permitted as the impact area remains under 0 50 ac The Developer proposes to proceed with a combination of restoration & conservation as mitigation for the proposed impacts as outlined below Mitgation Proposed (Prunardy Conservation, Secondarily Restoration) Conservation Easement Several wetland areas exist downstream of the wetland impact sites We feel that the best source of mitigation for these sites is to record Conservation Easements in these downstream zones to ensure their preservation We understand that required mitigation in this manner is at a 10 1 ratio so therefore the total conservation area proposed would be 3 7 acres 404 Wetland Restoration The project site has an existing farm road and pipes along the boundary It is believed that in several areas the road was installed and filled/piped in areas that were once wetlands One area of the road is planned to be deleted pipe removed, re graded, and native wetland vegetation re- established This is an area of approximately 0 10 ac Mitigation Not Chosen/Applicable Wetland Restoration Wetland restoration as described above is the only area that we can tell on site where wetlands have previously been impacted and can be restored to state of similar nature to their original It is proposed to take full advantage of this area Wetland Creation In our opinion wetland creation on the site is not a good and feasible option Wetland creation would take place in fringe areas and in close proximity to proposed lot areas There would be not good way to discussed however, finally decided against This was due to three principal reasons 1) Credits /wetland improvements in this manner are made offsrte The goal of the program and compensatory mitigation is to improve, restore or enhance ecosystems, due to negative impacts being created by the developer The most effective way to monitor the success of wetland preservation/restoration effort is to install it locally not in a remote, offsite and in many cases a remote and unseen location 2) Mitigation in the manner proposed would preserve wetlands directly downstream of the impacted areas, and provide that no future disturbance would occur in these areas This would effectively restore wetland functions within the area of impact and within its associated drainage basin Additionally development in the areas draining to Bnces Creek is at an increasing rate having cumulative impacts on wetland function and water quality Ignoring the option to preserve the local site and address remote locales does not appear as effective 3) Cost/Developer Financial Obligation — The Developer has already obtained the property, and done so with costs It is unreasonable to request further financial burdens on the Developer, especially in the current economic climate when more applicable means of mitigation are present and readily available This makes sense not only for the Developer but the environmental protection agencies as well Summary In summary, the additional impacts and revised plan for this site are necessary due to requests and/or comments by others as well as local community concerns Proposed mitigation is primarily by recorded downstream conservation easement (10 1 ratio) and secondarily wetland restoration Both proposed mitigation types will (1) allow
