Davis Governor Director MEMORANDUM TO: Doug Huggett Permits Section Interested Review Agencies FROM: Heather Coats f/AAC�- Field Representative, Wilmington f THROUGH: Debra Wilson O Wilmington District Manager DATE: April 12, 2012 SUBJECT: Permit Modification Request CAMA Major Permit No. 43 -11 Penderwatch, Hampstead, Pender County Dee Freeman Secretary Ms. Allie Sheffield, on behalf of Penderwatch & Conservancy, is requesting a modification of State Permit No. 43 -11. State Permit No. 43 -11 was issued to Penderwatch & Conservancy on March 31, 2011 authorizing construction of 12 oyster bag reefs. Six of the reefs were constructed in June of 2011. Five are to be constructed shortly (Reefs 1 -3, 11 & 12). Reef 4 will not be built at this time due to the presence of submerged aquatic vegetation (SAV). The permit has been extended per Session Laws 2009 -406 and 2010 -177 and will expire on October 1, 2015. Ms. Sheffield is requesting that the permit be modified in order to allow a realignment of the reefs in order to avoid the SAV now growing in the project area and relief from Condition #4 of the permit, which requires a 5' separation between SAV and the reefs. Penderwatch is requesting the condition be modified to reduce the required distance from SAV from 5' to 2', to account for the abundance of SAV that is now growing in the area. Reef 1 has also been reduced to 22.3' in length from an authorized 70'. Reef 2 would be decreased in length from a permitted 28' in length to 19' in length. Reef 3 would be reduced in length from 57' to 28'.
