Forrest Creek UT 2 Bank Parcel Credit Release

On August 11 2011 the Division of Water Quality (DWQ) received a revised Bank Parcel
Development Package (BPDP) on behalf of Environmental Banc & Exchange, LLC, for the Forrest
Creek UT 2 Bank Parcel to Orange County North Carolina On October 11 2011 DWQ received a
conservation easement for the subject site On November 28, 2011 the DWQ also received a revised
As Built Report for this site According to the As Built report the Forrest Creek UT 2 bank parcel will
generate 131 acres (2 977 63 lb N) of nitrogen nutrient offset credit and 131 acres (191 78 lb P) of
phosphorous nutrient offset credit On February 10 2012 the DWQ approved an Umbrella Mitigation
Banking Instrument (UMBI) for Environmental Banc & Exchange LLC to provide nutrient offset and
riparian buffer mitigation in the Falls Watershed of the Upper Neuse River Basin On April 5 2012 and
April 16 2012 DWQ received a monitoring bond and a revised Year 1 Monitoring Report respectively
for the subject site
According to the UMBI the following Project Milestones have been met and the corresponding credits
shall be released
Task/Milestones
1) Approval of BPDP Conservation Easement Recorded and financial
assurance posted (not applicable for Forrest Creek UT 2 — site was
already planted)
2) Mitigation Site Earthwork Planting and Installation of Monitoring
Devices completed
3) Monitoring Financial Assurance Posted and Approval of As Built
Report
4) Year 1 Monitoring Report approved by the DWQ

above referenced tract and 60% of your nitrogen nutrient offset credits (0 6 x 2,977 63 lbs N =1,786 58
lb-N) are now available for sale Also, 60% of your phosphorous nutrient offset credits (0 6 x 19178
lb P =115 07 lb -P) are now available for sale
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin which includes only the Upper and Lower Falls Watersheds as
defined in 15A NCAC 02B 0276
