On January 17 2012 the Division of Water Quality (DWQ) received the Year One Monitoring Report
dated January 13 2012 for the Rudolf Bank Parcel in Johnston County North Carolina On February
10 2012 Katie Merritt with DWQ requested that you revise the report to state that success will be
measured by the establishment of 320 planted trees per acre which is more consistent with the As Built
report Secondly it was requested that you provide photos documenting the replanted areas within the
riparian buffer mitigation site that were mowed Your response indicates that EBX Neuse 1 LLC will
provide confirmation when the buffer has been replanted in Spring 2012 Additionally it was requested
that you distinguish between Neuse buffer mitigation and nutrient offset mitigation throughout the
report It was also requested that you delete portions of the report that were not compliant with the
UMBI Revisions to Table 2 corrections to credit sale affidavits and requests for additional credit sale
affidavits were all additional items requested On April 19 2012 and April 30 2012 DWQ received a
satisfactory response to all of the requests and appreciates your cooperation
According to the UMBI the following Project Milestone has been met and the corresponding credits
shall be released

By copy of this correspondence DWQ confirms that you have satisfied the above requirements for the
above referenced tract and an additional 10% of your nutrient offset credits (0 1 x 92,420 lbs -N = 9,242
lb -N) are now available for sale Also an additional 10% of your riparian buffer credits (01 x 173,064
ft' = 17,306 4 ft2 ) are now available for sale One square foot of riparian buffer restoration for
mitigation equals one riparian buffer credit

In previous correspondence dated July 19 2011, it was explained to project manager Martin Hovis that
the performance /monitoring bond may be lowered each year on a case by case basis based on the
adjusted cost to finish the monitoring You have our approval to lower your performance bond by 10%
As always please copy DWQ on all correspondence related to credit sales referencing the DWQ project
number associated with the impacts for which credits are being purchased as compensatory mitigation
Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020201 of the Neuse River Basin
