This site was partially cultivated and partially wooded and the adjacent property to the south is a large agricultural field. 18. NATURE OF ACTIVITY (Description of project, include all features): Earthen fill of 1.91 acres of 404 jurisdictional wetlands attain parking and building space to allow for the proposed commercial anchor stores and the proposed road to be constructed on the existing parcel. A Conservation easement of 38.33 acres is proposed for mitigation for this project. The conservation easement will encompass n 19. US Army Corps Individual Permit Application Narrative Scot Realty/ Scot Construction Moyock, NC The proposed wetland fill is requested to allow for commercial development of the property. Two of the proposed fill areas (0.91 acres and 0.87 acres will be used to afford the construction of the buildings, parking areas for the two anchor stores, with a minor portion of wetland fill requested for the construction of the roadway that access the rear of the property which will contain the water treatment plant. The anchor stores (i.e., Lowe's, Wal Mart or other similar corporations) are vital to the applicant's proposed development plan and are to be the main feature of the site. Smaller stores, pharmacy, and restaurants, and a small hotel are planned on the remaining highground in support of the two anchor stores. Stormwater Retention Ponds have been proposed and shown on the workplat. These stormwater retention ponds will be built according to Best Management Practices as specified by NCDWQ state stormwater rules. The applicant has submitted a stormwater application to the NC Division of Water Quality and the application is currently under review. AVOIDANCE AND MINIMIZATION The applicant's request is constrained by the nature of the two large anchor stores which are proposed to large retail stores. The two largest contiguous areas of highground were selected in the design process to house the anchor stores. The parking areas required and the access required by tractor trailer trucks are governed by Currituck County zoning requirements and limitations of the large trucks. The site location was chosen to maximize the use of the two highground ridges and also allow for placement of the BMP stormwater treatment ponds to be constructed in highground. The proposed design represents a built out plan for the parcel. The development will be phased in as contracts or sales are made between the applicant and the purchaser. The fill area side slopes have already been calculated and shown in the proposed wetland fill areas. No additional wetland impacts are foreseen or proposed. All other remaining wetlands downslope of the project will be placed under a conservation easement which will prevent further fill in wetland areas. PROPOSED MITIGATION: The applicant has proposed an onsite 35.22 acre conservation easement to the North Carolina Ecosystem Enhancement Program. This 35.22 acre area will contain 35.62 acres of 404 wetlands and 2.71 acres of highground so that the transition areas from the wetland to highground will also be preserved. This conservation easement will provide a 18:1 ratio of preserved wetlands to the impacted wetland area with the addition of 2.71 acres of highground, far exceeding the required 10:1 minimum ratio. Please note: A canal drainage/canal Maintenance easement by Currituck County exists along Roland Creek Canal that prevents the applicant from placing a conservation easement on the area adjacent to the canal, otherwise this area would have been included in the proposed conservation easement area. The original application to the Army Corps designated this area as part of the conservation easement, but the area adjacent to the canal had to be removed adjacent to the canal per a request by Mike Doxey of Currituck County Soil and Water. The conservation easement area is significant due to its location at the headwaters of Roland Creek and tributary of the Currituck Sound and will provide a fairly wide buffer to the nearby surface waters from the proposed development. The conservation easement area will be one contiguous area paralleling the Roland Canal and Creek which will allow for wildlife movement patterns along the creek area to remain contiguous to the creek.
