I m sorry to say that Lindsay has requested that we withdrawal their application for a major variance
at 526 Oakland Drive from the May WQC agenda
Their closing on the property fell thru with Mr Valentine apparently there are multiple creditors with
judgments on the property against Mr Valentine They have their attorney involved now who is trying
to work thru the issues and getting the creditors to release their judgments
Please plan to tentatively move this to the July 11th WQC agenda and we II confirm this with you on or
around June 11th Also please keep us posted on the decision of the Legislature on the potential to
exempt these type of properties from the buffer rules

Consideration of a Request for a Major Variance from the Neuse River
Riparian Area Protection Rule
Lot 3 D L Jordan Subdivision Raleigh NC
May 9 2012
A request has been received for the Water Quality Committee to grant a mayor variance from the Neuse
River Riparian Area Protection Requirements (15A NCAC 2B 0233) for the proposed single family
home development located at Lot 3 D L Jordan Subdivision in Raleigh NC Wake County North
Carolina The home will impact 1 740 square feet (ft) of Zone 1 and 2 157 square feet (ft) of Zone 2 of
the protected riparian buffers
Recommendations and Preliminary Findings
1 The applicant purchased the property on April 15 2012 This property has been platted and recorded
since 1965
2 The applicant minimized and tried to avoid the buffer impacts Big Branch runs through the
property so buffers encompass most of the lot
3 The applicant did not meet the following hardship 15A NCAC 02B 0233(9)(a)(i)(E) in that the
owner purchased the property after the effective date of the rule
4 Additional Conditions — The Division of Water Quality (Division) staff believe that the following
conditions should be added to the variance if approved to ensure protection of retained buffers
located at Lot 3 D L Jordan Subdivision in Raleigh
• The Division staff believes that a deed restriction should be placed on the remaining protected
riparian buffers on this property and
• A stormwater plan will be submitted to the Division for approval and the variance should be
conditioned upon the applicant obtaining said approval from the Division
Recommendation The Division staff supports this mayor variance request However the Division
recognizes that the applicant does not comply with the evaluation criteria 15A NCAC 02B
0233(9)(a)(i)(E) since the owner purchased the property after the effective date of the rule
