Thank you for your letter dated March 22 2012 in which you request additional
information regarding the NWP application submitted for SE 17th Street Tract 8 Oak Island,
NC Below is a response to your comments
Your request as proposed implies that the aforementioned tract has been legally subdivided
and that building of the two lots are co dependent upon one another that together they are
considered a single and complete project Please provide additional information supporting this
as so and demonstrate why you believe that the development of two structures on a single tract is
necessary for the economic return on the property
This tract has not been legally subdivided yet However the owner has received the support of
the Town of Oak Island to subdivide and is moving forward with the process The subdivision of
the site and construction of two structures is necessary in order to maximize the economic return
on the property Comparable sales in the area show that small waterfront lots (— 0 25 acre) have
recently sold for an average price of $120 000 and larger waterfront lots (— 0 50 ac) have sold for
an average pace of $175 000 Therefore the sale of two small lots would generate approximately
$240 000 vs $175 000 for one larger lot Additionally one larger lot would likely result in the
construction of a larger house that would impact a similar amount of wetlands as the construction
of two smaller houses on two smaller lots
Two separate NWP applications have been prepared for Lhese lots and are enclosed Lot #20
requests 0 048 acre (2102 so of wetland fill and Lot #22 requests 0 051 acre (2248 so of wetland

We request that you please revise your mitigation plan Your proposal to purchase non riparian
credits fi om the Stone Farm Mitigation Bank (SFMB) is unsuitable as compensatory mitigation
for the proposed impacts because the wetland project is located outside of the SFMB service
area More importantly we do not believe that the wetland type and function at the project area
is comparable to that of SFMB Furthermore your I 1 ratio is insufficient to address the overall
loss associated with the project
The applicant proposes to buy into the NC Ecosystem Enhancement Program in order to restore
riparian wetlands at a 2 1 mitigation ratio for each lot Attached is their acceptance letter
Please note that the site plan has changed slightly All development is now located outside of
CAMA's Area of Environmental Concern Additionally communication with the Town has
resulted in several minor changes to the house locations and the lot lines in order to meet setback
requirements The revised site plans are enclosed Wetland impacts remain the same Please let

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced protect as indicated in the table below Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved You must also comply with all other state federal or local government permits regulations or authorizations associated
with the proposed activity including SL 2009 337 An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S L 2011 343
This acceptance is valid for six months from the date of this letter and is not transferable If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame this acceptance will expire It is the applicant s
responsibility to send copies of the permits to NCEEP Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www nceep net
Based on the information supplied by you in your request to use the NCEEP the impacts that may require compensatory mitigation are
