The following are the review comments and corrections for the above referenced plan
1 Please shift Midas Lame further west to mznzmiZe buffer impacts If this cannot be accomplished please explain
Midas lane cannot be shifted west due to connectivity with the existing NCDOT
Roadway
Z Along Midas Lane on 1-ot 16 it appears that a large amount of fill will be placed in the buffer Please
explain the purpose of this fill and avoid fill impacts in Zone I
The grading on lot 16 has been revised to a 31 slope to stay out of the buffer
3 Basin # 1 is proposed on Lot 16 at the edge of the buffer Please explain howyou will maintain diffuse flow
at the outlet of the basin
The outlet of the basin will require a level spreader This will be shown on the
constructions plans at a future date
4 Will the sites be City water and sewer or septic andl or well water? If so this may limit the number of usable
lots eipectaly Lot 16
The site will be served by on -site well and septic
5 Please explain why the road crossing to the north is necessary Can the road to the north be placed on the west
side of Midas Lane crossing to avoid two road impacts?
The roadway to the north is a requirement placed on this project by the City of
Durham Umfied Development Ordinance, per the Planning Directors determination.
Any connection to the west side of the road would be through an existing residential
home
6 Please eliminate the driveway crossing on Lot 5 by moving it north of the crossing on the northern stub road or
combine the driveways on I.ot 4 and 5 by placing it on the proper y line and as a result mznzmztiing the buffer
impacts of two driveway crossings
The driveway on lot 5 has been revised to the sub road to decrease the umpact to the
buffers
7 Buffer mitigation is only required forparallel road impacts and forperpendicular impactgreater than 150
linear feet or 113 acre of buffer Please include an approval letter from a mitigation bank or EEP stating that
credits are available and are being reserved for this project
When the determination of the total mitigation has been determined, EBX LLC has
available credits in the Neuse for tins project

GENERAL CONDITIONS OF APPROVAL
PROTECTION OF EXISTING VEGETATION:
At the start of grading involving the lowering of existing grade around a tree or stripping
of topsoil, a clean, sharp, vertical cut shall be made at the edge of the tree save area
at the some time as other erosion control measures are installed. The tree protection
fencing shall be installed on the side of the cut farthest away from the tree trunk and
shall remain in place until all construction in the vicinity of the trees is complete. No
storage of materials, fill, or equipment and no trespassing shall be allowed within the
5oundary of the protected area.
DRIOR TO GRADING
Tree Protection Fencing to be installed prior to any land disturbance, demolition or
ssuonce of grading permits.
.STREAM BUFFERS
50 foot wide undisturbed stream buffer, measured from top of bank, each side of stream
No clearing or grading other than selective thinning and ordinary maintenance of existing
.iegetation permitted, except in accordance with 15A NCAC 02B.233 (6) Vegetation
Management. No structures or features requiring grading or construction may be built
,within the 10 foot stream buffer setback. Any use allowed by Section 8.5.5 of the UDO
shall be designed and constructed to minimize the amount of intrusion into the stream
:Mfer and to minimize clearing, grading, erosion and water quality degradation. UDO Sec

each lot is required to have two (2) parking spaces and each driveway shall be at least
8 foot measured from right —of —way or street easement line as applicable.
iifyETLANDS
A is the responsibility of the landowner to determine whether or not wetlands are located
on the property, and to ensure that no illegal activities occur in the wetlands. it is illegal
=:a fill in wetlands or to use heavy mechanical equipment to clear wetlands. All plans and
plats submitted to the Planning Department for approval should show all wetlands defined
,by the Corps of Engineers. For more information contact Eric Alsmeyer with the Army
Corps of Engineers at 919 -554 -4884 (ext 23).
-- `ROSION CONTROL
- A land— disturbing permit will be required prior to the commencement of any
land— disturbing activities. r
2. A sedimentation and erosion control plan must be submitted and approved prior to the
issuance of a land— disturbance permit.
3. If an offsite soil spoil or borrow site is utilized, then the disturbed area for the
spoil /borrow site must be included in the land— disturbance plan and permit unless the
spoil /borrow site already has a land — disturbance permit.
-4. Show and verbalize the limits of disturbance.
SPECIAL CONDITIONS OF APPROVAL
1. Recorded right —of —way dedication plat required prior to issuance of 1st building permit
2. Site will be graded on a lot— by—lot basis
3. Payment —in —Lieu of open dedication is to be made prior to the approval of any final
plats per UDO Sec 7.2.2A or 12.5.2.
4. Approval does not guarantee approval of either on site water supply or waste water
disposal systems or that permits will be issued for construction of such systems
5. All new utilities shall be installed underground.
6. Lot 15 driveway will not encroach into stream and stream buffer area.
7. Streets outside the corporate limits must request NCDOT maintenance as soon as the
NCDOT occupancy requirement is met, and not more than twice the minimum number
of units required for maintenance by NCDOT may be occupied prior to acceptance for
maintenance by NCDOT.
8. Prior to the issuance of a certificate of occu ancv: Construct Midas Lane (from the
eastern property line of the site to Halcyon Place) to minimum NCDOT public street
standards

SEEDBED PREPARATION
1. Chisel compacted areas and spread topsoil 3 inches deep over adverse
soil conditions, if available.
2. Rip the entire area to 6 inches depth.
3. Remove all loose rock, roots, and other obstructions leaving surface
reasonably smooth and uniform.
4. Apply agricultural lime, fertilizer, and superphosphate uniformly and
mix with soil (see below *).
5. Continue tillage until a well - pulverized, firm, reasonably uniform
seedbed is prepared 4 to 6 inches deep.
6. Seed on a freshly prepared seedbed and cover seed lightly with seeding
equipment or cultipack after seeding.
7. Mulch immediately after seeding and anchor mulch.
8. Inspect all seeded areas and make necessary repairs or reseedings
within the planting season, if possible. If stand should be over
60 % damaged, reestablish following original lime, fertilizer and
