4. Project Description and History
4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The project site is an off -site utility line associated with a planned residential development submitted under a previous permit application. The 401 permit and Buffer Authorization
(20201259 Ver 1) have been received for the main site, and the 404 permit is in progress (SAW-2020-01270).
The proposed off -site utility route was determined to be necessary after the main site permit application had been submitted. The proposed utility route will be located within an existing
20-ft wide City of Raleigh Utility ROW. Impacts for installation of the new line will be limited to this 20-ff wide corridor. The utility ROW is currently occupied by a maintained herbaceous
area and a portion of a golf course. A delineation was completed for a larger 5.57-acre area surrounding the utility route.
For the purposes of this application, only the utility route will be discussed as all other impacts are addressed in the original application.

The purpose of the proposed project is to replace in existing sewer line to enable the required capacity for the addition of a single-family residential subdivision.

The proposed project will involve installation of a new sewer line within an existing sewer line ROW in order to accommodate the increased service necessary for the 401 Assemblage
project.
All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, graders, and earth
movers. No SCMs are required. Impacts will be limited to the utility line corridor.

Timmons Group completed a delineation for a 5.57-acre area surrounding the proposed utility route on October 28, 2020. Consultation with the USACE and DWR for a Jurisdictional
Determination and Buffer Determination was initiated on January 14, 2021.
Dave Bailey of the USACE replied on January 14, 2021 stating no field verification from the Corps was necessary, and the delineation file would be used for issuance of a PJD and/or
permit review.

This is the second of two permit applications for the 401 Assemblage site. The first permit application was submitted in the fall of 2020 for the proposed residential development known
as 401 Assemblage. At the time of initial submittal the off -site utility requirement was not known. The 401 Permit and Buffer Authorization have been received for the initial submittal, with
404 Permit in progress. The original permit required the following impact totals:

0.03-acres of permanent -indirect loss wetland impact
0.07-acres of temporary wetland impact associated vnth a utility route
201-ft (0.02-acres) of permanent stream impact
48-ft (0.01-acres) of temporary stream impact

As such, this second permit application for the off -site utility route is required.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning,
including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts. The remaining impacts
proposed are necessary in order for the project's goals to be realized.
The utility route is planned along an existing utility line as a proposed utility line replacement to further avoid and minimize impacts.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with
the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013)
and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall
install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install
devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case
less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is
required and will be kept by the owner's representative.
Temporary seeding and permanent seeding plans are included to restore impacted areas. Measures will be taken to prevent oil, tar, trash, debris and
other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained
within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material
within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initiated within
jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters.

A USFWS IPaC Report and NCNHP Natural Heritage Database Report were utilized for reviewof potential protected species in the vicinity of the
project Site. Species identified by IPaC as potentially occurring in the vicinity of the Site include: Michawes sumac, dwarf wedgemussel, red -cockaded
woodpecker, yellow lance, Neuse River waterdog, Atlantic pigtoe, and Carolina madtom.
No consultation was initiated with the USFWS for the off -site utility line, however, the USFWS concurred with a "no effect" determination for the main
project site located immediately west of this site location. No new species were identified by the updated IPaC or NCNHP Report as potentially
occurring in the vicinity of the project location.
Based on the similarity of stream habitat and disturbed nature of terrestrial habitat (well shaded utility ROW and maintained golf course), it is the
opinion of Timmons Group that the proposed project Will have no effect on protected species.

Due to the distance from historic resources and the nature of the proposed project, an underground sewer line, it is the opinion of Timmons that the
proposed utility line installation will have no effect on historic resources.

Each green bar represents the bird's relative probability of presence in the 10km grid cell(s) your
project overlaps during a particular week of the year. (A year is represented as 12 4-week months.) A
taller bar indicates a higher probability of species presence. The survey effort (see below) can be
used to establish a level of confidence in the presence score. One can have higher confidence in the
presence score if the corresponding survey effort is also high.
How is the probability of presence score calculated? The calculation is done in three steps:
1. The probability of presence for each week is calculated as the number of survey events in the
week where the species was detected divided by the total number of survey events for that week.
For example, if in week 12 there were 20 survey events and the Spotted Towhee was found in 5
of them, the probability of presence of the Spotted Towhee in week 12 is 0.25. %
2. To properly present the pattern of presence across the year, the relative probability of presence
is calculated. This is the probability of presence divided by the maximum probability of presence
across all weeks. For example, imagine the probability of presence in week 20 for the Spotted
Towhee is 0.05, and that the probability of presence at week 12 (0.25) is the maximum of any
week of the year. The relative probability of presence on week 12 is 0.25/0.25 = 1; at week 20 it is
0.05/0.25 = 0.2. A 4
3. The relative probability of presence calculated in the previous step undergoes a statistical
conversion so that all possible values fall between 0 and 10, inclusive. This is the probability of
presence score.

Nationwide Conservation Measures describes measures that can help avoid and minimize impacts to all birds at
any location year round. Implementation of these measures is particularly important when birds are most likely to
occur in the project area. When birds may be breeding in the area, identifying the locations of any active nests and
avoiding their destruction is a very helpful impact minimization measure. To see when birds are most likely to occur
and be breeding in your project area, view the Probability of Presence Summary. Additional measures or permits
may be advisable depending on the type of activity you are conducting and the type of infrastructure or bird
species present on your project site.
What does IPaC use to generate the migratory birds potentially occurring in my specified location?
The Migratory Bird Resource List is comprised of USFWS Birds of Conservation Concern (BCC), and other species
that may warrant special attention in your project location.
The migratory bird list generated for your project is derived from data provided by the Avian Knowledge Network
(AKN). The AKN data is based on a growing collection of survey, banding, and citizen science datasets and is queried
and filtered to return a list of those birds reported as occurring in the 10km grid cell(s) which your project
intersects, and that have been identified as warranting special attention because they are a BCC species in that
area, an eagle (Eagle Act requirements may apply), or a species that has a particular vulnerability to offshore
activities or development. 11111
Again, the Migratory Bird Resource list includes only a subset of birds that may occur in your project area. It is not

What does IPaC use to generate the probability of presence graphs for the migratory birds potentially occurring
in my specified location?
The probability of presence graphs associated with your migratory bird list are based on data provided by the Avian

Probability of presence data is continuously being updated as new and better information becomes available. To

How do I know if a bird is breeding, wintering, migrating or present year-round in my project area?
To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or
year-round), you may refer to the following resources: The Cornell Lab of Ornithology All About Birds Bird Guide, or
(if you are unsuccessful in locating the bird of interest there), the Cornell Lab of Ornithology Neotropical Birds
guide. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in
your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere"
is indicated, then the bird likely does not breed in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range
anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands);
2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the
continental USA; and
3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of
the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from
certain types of development or activities (e.g. offshore energy development or longline fishing).

Proper Interpretation and Use of Your Migratory Bird Report.,
The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority
concern. To learn more about how your list is generated, and see options for identifying what other birds may be in
your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in
my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km
grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look
carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a
red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of
presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack
of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting
point for identifying what birds of concern have the potential to be in your project area, when they might be there,
and if they might be breeding (which means nests might be present). The list helps you know what to look for to
confirm presence, and helps guide you in knowing when to implement conservation measures to avoid or minimize
potential impacts from your project activities, should presence be confirmed. To learn more about conservation

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information
on the location, type and size of these resources. The maps are prepared from the analysis of high altitude imagery.
Wetlands are identified based on vegetation, visible hydrology and geography. A margin of error is inherent in the
use of imagery; thus, detailed on -the -ground inspection of any particular site may result in revision of the wetland
boundaries or classification established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts,
the amount and quality of the collateral data and the amount of ground truth verification work conducted.
Metadata should be consulted to determine the date of the source imagery used and any mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or field work. There may be
occasional differences in polygon boundaries or classifications between the information depicted on the map and
the actual conditions on site.
Data exclusions
Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial
imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged
aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters.

Some deepwater reef communities (coral or tuberficid worm reefs) have also been excluded from the inventory.
These habitats, because of their depth, go undetected by aerial imagery.

different manner than that used in this inventory. There is no attempt, in either the design or products of this
inventory, to define the limits of proprietary jurisdiction of any Federal, state, or local government or to establish

Re: Online Project Review Request, 401 Assemblage, Wake County, North Carolina.
Dear Mr. Benjamin,
We have reviewed the referenced project using the North Carolina Field Office's online project
review process and have followed all guidance and instructions in completing the review. We
completed our review in August of 2020 and are submitting our project review package in
accordance with the instructions for further review.
Our proposed action consists of a residential development with associated amenities and
infrastructure. Development is anticipated to include the construction of subdivision roads across
two jurisdictional streams and their corresponding riparian buffers. Minor wetland impacts are
anticipated for the proposed road crossings. Currently, no wetland, stream, or riparian buffer
impacts are anticipated to be associated with the construction of the residential lots.
The location of the project and the action area are identified on the enclosed maps (Figures 1 and
2 in Appendix C, including a USGS topographic map and aerial imagery).
The project is expected to be completed over several years. Construction is anticipated to take
place around late 2020 through 2021.
This project review is needed as supplement to U.S. Army Corps of Engineers consultation for
use of a Nationwide Permit due to impacts to jurisdictional waters anticipated with the proposed
construction of subdivision roads.
The USFWS IPaC search for the Site (Consultation Code 04EN2000-2020-SLI-1630, Event
Code 04EN2000-2020E-03708) identified three federally listed endangered species and one
federally listed threatened species as potentially occurring in the vicinity of the Site: Michaux's
sumac (Rhus michauxii), dwarf wedgemussel (Alasmidonta heterodon), red -cockaded
woodpecker (Picoides borealis), and yellow lance (Elliptio lanceolate), respectively.
Additionally, lPaC identified two federally proposed threatened and one federally proposed
endangered species: Neuse River waterdog (Necturus lewisi), Atlantic pigtoe (Fusconaia
masoni), and Carolina madtom (Noturus furiosus), respectively. No critical habitat was identified
within the project area . Additionally, per the instructions of the Raleigh Field Office's Project
Review Steps, Timmons personnel assessed the potential for impacts to the bald eagle
(Haliaeetus leucocephalus) and northern long-eared bat (Myotis septentrionalis).
Effects to critical habitat
There is no critical habitat located within the Site boundaries or a 1-mile radius.
Effects to federally endangered species
The majority of the Site consists of predominantly hardwood forest and active cattle pasture.
Approximately 35 acres of the Site consists of maintained pine plantation with approximately
15- to 20-year old pine trees. No potentially suitable roosting habitat is located within or in the
immediate vicinity of the project area. Further, no occurrences of red -cockaded woodpecker
were noted during the Site inspection or through review of NCNHP data. Therefore, it is the
opinion of Timmons that any proposed disturbance will have no effect on the red -cockaded
woodpecker.
There are two stream features within the Site proposed to be impacted of appropriate size to
potentially serve as suitable habitat for aquatic species. The southern -most stream is located
within an active cattle pasture and shows signs of active degradation from cattle activity and
downcutting. The forested stream in the northern portion of the Site displays more favorable
conditions aquatic species; however, a man-made pond impounded by an earthen dam with no
apparent outlet is located down -stream, preventing the migration of aquatic species to areas of
proposed impact. Further, no signs of mollusks, mollusk shells, or protected aquatic species were
observed during the Site inspection. A review of the NCNHP data revealed no known
occurrences of the dwarf wedgemussel within a one -mile radius of the Site boundaries or within
the vicinity of the proposed project. Therefore, it is the opinion of Timmons that any proposed
disturbance will have no effect on the dwarf wedgemussel.
During the Site inspection, potentially low -quality habitat for Michaux's sumac was observed
along unpaved access roads through the Site. However, these areas are well shaded by the mature
forest canopy overhead. Further, there are no noted occurrences of Michaux's sumac in the
vicinity of the project area and no occurrences were observed at the time of inspection.
Therefore, due to the lack of documented occurrences within one mile of the Site, the lack of
observances, and the absence of suitable habitat, it is the opinion of Timmons that any proposed
disturbance will have no effect on Michaux's sumac.
Effects to federally threatened endangered species
The two stream features within the Site proposed to be disturbed are of the appropriate size to
potentially constitute suitable habitat for the yellow lance. However, as discussed above, the
southern -most stream was observed to be severely disturbed from surrounding cattle pasture use
and the northern -most stream has a down -stream, impounded man-made pond. Further, no
occurrences were observed at the time of inspection and a review of the NCNHP data revealed
no known occurrences of the yellow lance within a one -mile radius of the Site boundaries or
within the vicinity of the proposed project. Therefore, it is the opinion of Timmons that any

proposed disturbance will have no effect on the yellow lance.
Effects to proposed federally protected species
Due to the low quality nature of the southern -most stream to be impacted and the down -stream
impoundment of the northern -most stream, it is the opinion of Timmons that the proposed
project will have no effect on the Neuse River waterdog, Carolina madtom,affect and the Atlantic
pigtoe.
Effects to federally protected species not identified through IPaC
The majority of the Site consists of hardwood forest and active cattle pasture with approximately
35 acres of pine plantation located in the northern portion. Forested areas observed on -Site
contain several trees that could represent potentially suitable summer roosting habitat for the
northern long-eared bat. Timmons Group is not aware of known maternity roost trees or
hibernacula in the vicinity of the Site. Although potentially suitable summer roosting habitat is
present, Wake County is not identified as a county in which the species is likely to occur.
Therefore, it is the opinion of Timmons that any development of the Site may affect, but is not
likely to adversely affect the northern long-eared bat. Further, per the findings of the Final 4(d)
Rule on the northern long-eared bat, disturbance activities associated with the Site would qualify
as exempt, unintentional take.
The Raleigh Field Office Project Review steps request that reviewers assess their projects for the
potential to impact bald eagle nests. Per the NCNFlP Report, there are no occurrences of the bald
eagle or bald eagle nests at or within 1-mile of the project Site. Further, no occurrences of nests
or bald eagles were observed during the Site inspection. Therefore, any disturbance of the Site is
unlikely to disturb nesting bald eagles and no Eagle Act Permit is required
The enclosed project review package provides the information about the species and critical
habitat considered in our review and includes a species conclusions table identifying the
determinations.

The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by

prepared to fulfill that requirement and in determining whether additional consultation with the

If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
