Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The proposed utility project Will extend across four (4) properties for a length of 1,500 If with an additional 800 feet of side branches to the main line. The majority of the work is within or adjacent to existing maintained sewer, Duke transmission, and gas main easements. The easements are open and regularly mowed for maintenance access. Approximately 350 feet of the project is in a wooded area that will require clearing. There are small patches of wetland within the project area. The new sewer line will cross a small stream. The route of the gravity sewer runs parallel to Little Creek, but only comes with 60 feet of the top of bank at one location. 4b. Explain the purpose of the proposed project:* The proposed project is a 24-inch sanitary gravity sewer approximately 1,500 If long with an additional 825 feet of side branches to the main line (210 ft of 8-inch, 226 ft of 10-inch, 134 ft of 12-inch, 255 ft of 24-inch). The line will replace an existing aging 18-inch sanitary sewer outfall. 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The 1,500 ft long 24-inch sanitary sewer outfall will replace an aging 18-inch sanitary sewer outfall. In addition there is approximately 800 feet of side branches. Of the total 2,300 feet of gravity sewer, 1,900 It are in maintained easements and 400 ft in new work easements. The existing 18-inch sewer Will be replaced by the 24-inch sewer main within or adjacent to the existing easement. Approximately 350 feet of the new easement will require tree clearing. A small (2-3 ft wide) unnamed tributary of Little Creek will be crossed by open cut trenching for installation of the gravity sewer. There will be a permanent impact of approximately 0.037 acres of wooded wetlands. The possible equipment that will be used on the project are one to two large excavators, dump trucks, and pickups. The project will require bypass pumping of the sewage during installation of some of the sewer mains. 4j. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: An Option 2 was to install all the new utilities adjacent to the existing utility. This option would have impacted approximately 0.1 acres of forested wetlands. In lieu of this option, approximately 520 feet of the design installs the new sewer by removing and replacing the existing. An Option 1 was to cross the power & gas easements east of the existing sewer outfall and run parallel to the south side of the power easement. This option would have impacted approximately 0.14 acres of wooded wetlands. This option was abandoned for the selected option. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The main construction technique that was selected to avoid impacts was the decision to remove the existing 18-inch pipe and install the new 24-inch pipe in the same trench for a distance of approximately 520 feet. This allows the work to stay within the existing maintained easement. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Figures: Figure 1: Project Vicinity & Survey Reach Figures 2: NCNHP Element Occurrences 1.0 INTRODUCTION The town of Clayton proposes the construction of a sewer line in the vicinity of NC-42 in Johnston County, North Carolina (Figure 1). The project would potentially involve an open -cut crossing of Little Creek, a tributary to Swift Creek of the Neuse River Basin. The Federally Endangered Dwarf Wedgemussel (Alasmidonta heterodon, DWM) and Federally Threatened Yellow Lance (Elliptio lanceolata) are listed by the U.S. Fish and Wildlife Service (USFWS) and known to occur in Johnston County. The Atlantic Pigtoe (Fusconaia masoni), also known to occur in the county, was proposed for listing under the Endangered Species Act (ESA) as a Threatened Species with Section 4(d) Rule and Critical Habitat Designation on October 11, 2018. All three species are known to occur in Swift Creek, and the DWM and Atlantic Pigtoe have been reported in Little Creek. Table 1 lists the nearest element occurrence (EO) for targeted species in approximate river miles (RM) from the project crossing. Habitat evaluations were also conducted in two unnamed tributaries to Little Creek (Figure 1). 3.1 Little Creek Stream Conditions Habitat in Little Creek consisted of a series of shallow (two inches to one foot deep), riffles and runs between two long, deep (up to five feet), stagnant pools created by Beaver (Castor canadensis) dams. The channel width ranged from 12 to 25 feet wide (averaging 14-16 feet) with moderately eroded banks three to six feet high. The substrate consisted largely of coarse sand and cobble, with large accumulations of silt and organic material within the pools. The water surface within the pools were covered with cyanobacteria blooms. The adjacent landuse consisted of mixture of narrow -forested areas, open utility easements, and residential and commercial areas. The Unnamed Tributary to Little Creek from the west was approximately three feet wide with banks up to two feet high. The substrate consisted of sand, with clay/loam banks. The channel was totally dry during the site visit and various grasses and forbs were growing within. Suitable habitat for mussels is not present in this channel. The Unnamed Tributary to Little Creek from the east was approximately four to six feet wide with banks up to two feet high. The substrate consisted of sand, gravel and small cobble, with clay/loam banks. The channel was mostly dry during the site visit, with only the lower 20-30 feet retaining pooled water up to three inches deep. The remaining portion of the channel was moist and covered with leaf litter. Suitable habitat for mussels is not present in this channel. 3.1 Methodology Mussel surveys were conducted from approximately 1,312 feet (400 meters) downstream of the proposed crossing footprint upstream to the NC 42 crossing of the stream. Habitat analysis of the two tributaries were conducted for approximately 400 feet (122 meters) beginning at their respective confluences with Little Creek (Figure 1). Visual surveys were completed by wading in the stream using glass bottom view buckets (bathyscopes), focusing mainly on areas considered to provide the best habitat attributes for the targeted species based on professional opinion. However, all in -stream habitat types (pool, riffle, slackwater, etc.) were surveyed to some degree. Tactile searches were also performed within submerged root wads along the banks. The survey team spread out across the channel into survey lanes (right and left) as they ascended the stream. Timed survey efforts were employed to allow Catch Per Unit Effort (CPUE) data for each mussel species if encountered. Relative abundance for freshwater snails and freshwater clam species were estimated using the following criteria: Little Creek Sewer Freshwater Mussel Surveys November 2019 Three Oaks Job# 19-327 Page 2 ➢ (VA) Very abundant > 30 per square meter ➢ (A) Abundant 16-30 per square meter ➢ (C) Common 6-15 per square meter ➢ (U) Uncommon 3-5 per square meter ➢ (R) Rare 1-2 per square meter ➢ (P-) Ancillary adjective "Patchy" indicates an uneven distribution of the species within the sampled site. 4.0 RESULTS Freshwater mussel surveys were conducted under low flow. The water was clear in the free - flowing sections of the survey reach; however, within the pools it was moderately turbid, due to suspended solids and the cyanobacteria blooms. A total of 3.03 person -hours of survey time were spent in the reach. No freshwater mussels were found. Other mollusk species found during the surveys include the introduced Asian Clam (Corbicula fluminea), which was common with a patchy distribution. 5.0 DISCUSSION/CONCLUSIONS As discussed in Section 1.0, the Dwarf Wedgemussel and Atlantic Pigtoe have been recorded in Little Creek, approximately 2.6 and 3.9 miles respectively, downstream of the project crossing. In addition, all three species are known to occur in Swift Creek, downstream and upstream of the Little Creek/Swift Creek confluence, which is 6.2 RM downstream of the project crossing. While the surveyed section of Little Creek is of sufficient size and contains appropriate substrate to potentially support the target mussel species, based on the survey results, none of the species are likely to be present and it is possible that this portion of Little Creek no longer supports any freshwater mussel species. As recently as 2017, the Eastern Elliptio (Ellitio complanata), a widespread and common freshwater mussel species, was found in the vicinity of the NC 42 crossing of Little Creek (Three Oaks mussel survey data). Although only three live individuals were found during the 2017 surveys, a number of relict shells were also found. The failure to find any evidence (live individuals, or relict shells) during the survey conducted for this project suggests a decline, or extirpation of the Eastern Elliptio from this section of Little Creek. While all three of the target species are known to occur downstream of the proposed project crossing of Little Creek, adverse effects to these species are not anticipated to occur as a result of project construction. This is based on the survey results, as well as the fact that there is an impoundment on Little Creek between the project area and the section of the stream known to support the target species. The presence of the impoundment would thus, abate any potential for downstream effects to occur. The USFWS is the regulating authority for Section 7 Biological Conclusions and as such, it is recommended that they be consulted regarding their concurrence with the finding of this document.
