Dear Mr. Bartlett:
On February 9, 2021, staff from the Asheville Regional Office of the Division of Energy, Mineral, and
Land Resources (DEMLR), conducted a site inspection for the Environmental Inks - Siegwerk
facility located at 1 Quality Products Drive, Burke County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. This facility is covered under NPDES Stormwater
General Permit NCG090000 by Certificate of Coverage NCG090032. Permit coverage authorizes the
discharge of stormwater from the facility to receiving waters designated as a tributary of Hunting
Creek, a Class WS-IV waterbody in the Catawba River Basin.
As a result of the site inspection, the following permit condition violations are noted:
1) Failure to Provide Secondary Containment
Secondary containment has not been provided for all bulk storage of liquid materials on
site. [Part II, Section A, Item 2b]
2) Failure to take all reasonable steps to minimize or prevent any discharge in violation
of this eeneral hermit which has a reasonable likelihood of adverselv affectine human
health or the environment.
During the inspection, several 'bats" used for storage of inks were observed leaking onto
the ground and draining toward the storm drains On site. Other storage containers were
also observed that had discharged onto the ground through leaks or lack of preventative
maintenance and good housekeeping. [Part III, Section A, Item 3]
3) Failure to Maintain the Stormwater Pollution Prevention Plan
At the time of the inspection, the Stormwater Pollution Prevention Plan had not been
maintained and kept up-to-date. [Part II, Section A, Item 8]

Required Response:
1. Complete all corrective actions outlined in the enclosed inspection report by March 16,
2021.
2. Submit a written response to this office explaining why these violations occurred. Response
is due within 10 calendar days of receipt of this notice.
Thank you for your attention to this matter. This office is considering sending a recommendation
for enforcement to the Director of the Division of Energy, Mineral, & Land Resources regarding
these issues. Your above -mentioned response to this correspondence will be considered in this
process. The violations, as detailed above, are required to be properly resolved. These
violations and any future violations are subject to a civil penalty assessment of up to $25,000

Inspection Summary:
On February 9, 2021 this facility was inspected for compliance. I met with Lee Kearson, Ronnie Murphy, and Wayne Hurd
on site. During the inspection, the following violations were noted:
1) Secondary containment has not been provided for all bulk storage of liquid materials on site. The permittee shall
immediately begin efforts to provide secondary containment for all bulk storage of liquid material as outlined in the
NCG090000 General Permit.
2) During the inspection, several "vats" used for storage of inks were observed leaking onto the ground and draining toward
the stormdrains on site. Other storage containers were also observed that had discharged onto the ground through leaks or
lack of preventative maintenance and good housekeeping. The permittee shall immediately begin effort to identify, repair and
prevent future discharges on site.
3) The Stormwater Pollution Prevention plan has not been maintained on site. While sections of the Plan were available, all
required information had not been maintained.
Please give the above items your immediate attention.
This facility will be re -inspected on or after March 16, 2021. If the above items have not been addressed, further action will be
taken.
