Scott Brown, PE 409 Chicago Drive, Suite 112 Fayetteville, NC 28306 NORTH CAROLINA Environmental Quality October 29, 2020 Subject: Request for Additional Information Stormwater Permit No. SW6201001 Evelyn Estates Subdivision Cumberland County Dear Mr. Brown: The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application for the subject project on October 1, 2020. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Based on the proposed design, the project appears to be a mixture of high -density and low -density development. While it is true that the project meets the letter of the law with regard to low -density requirements, the intent of the law is not met. For example, lots 2-9 & 13-19 are approximately 20,000 sf in size and are allocated approximately 10,000 sf of BUA resulting in a %BUA of about 50%, significantly higher than the low -density maximum %BUA of 24%. The project essentially contains two areas, lot 10 (with a %BUA of about 2%) and the remainder of the project (with a %BUA of about 47%). Per 15A NCAC 02H .1003(1)(d), the Division may determine that a project contains both high -density and low -density areas. Please do one of the following to address this: a. Reduce the amount of BUA allocated per lot so that the entire project more closely meets the intent of low -density development. The deed restriction document will need to be revised and resubmitted (with original signature). b. Redistribute the amount of BUA allocated to the lots proportionately based on lot size. The deed restriction document will need to be revised and resubmitted (with original signature). c. Design the high -density portion of the project area to meet all applicable high - density requirements. Most items in the submittal (Application, plans, supplemental forms, calcs, etc...) will need to be revised and resubmitted. There is a BUA discrepancy between the Application and the low -density supplement/deed restriction document. The low -density supplement & deed restriction document indicate that the allocated BUA per lot is 10,157 sf. Since there are 19 lots, this results in an on -site BUA allocated to lots of 192,983 sf. The number in Section IV, 10 of the Application should match this number (192,991 sf is incorrectly shown). 3. Please correct the following issues with the low -density supplement form: a. Please provide the "Vaji,," value for the proposed swales. This value is the maximum allowable velocity that the swale can safely handle before eroding (Part III). b. Please initial the provided items on the Required Item Checklist (Part IV). c. Item d of the Required Items Checklist — This item is required. d. Item j of the Required Items Checklist — This item is required since swale 3 is discharging to a wetland area. Please also ensure that swale 3 is discharging to the wetland area at a non -erosive velocity (<= 2 fps). e. Items k & 1 of the Required Items Checklist — Please show the bottom width of the swales on the swale detail. Please also specify the type of vegetation to be used. 4. Please provide the following information to supplement the provided calculations: a. Rainfall data showing where the intensities used in the swale calculations came from. b. A swale drainage area map showing the drainage area size, BUA within the drainage area, and the times of concentration so that the swale calculations can be verified (This does not need to be included in the main set of plans). 5. Please identify the individual who made the wetland determination on the plans (Section VI, 8m). 6. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. a. Pdfs must be uploaded using the form at: https://edocs.deq.nc.gov/Forms/SW—Project Submittal b. Hard copies must be mailed or delivered to the following address: Jim Farkas 512 N. The requested information should be received by this Office prior to November 28, 2020, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SW6201001 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
