Carteret County
Wilmington Regional Office personnel performed a Compliance Inspection of the project known as
Britthaven of Newport, located off Bayberry Road, Newport in Carteret County, North Carolina. The
inspection was performed in response to a search of our records, indicating that no Stormwater
Management Permit was applied for.
The project has been found in violation of Stormwater Permit Number 980103, issued pursuant to
the requirements of 15A NCAC 2H.1000. The violations found are:
1. On January 13, 1998, this Office sent you a letter via certified mail requesting that you make
application for a Stormwater Management Permit. No response to the request was received.
2. The project is currently under construction without the required stormwater permit.
To correct these violations you must :
1. Provide a written "Plan of Action" which outlines the actions you will take to correct the
violations and a time frame for completion of those actions, on or before June 28, 1998.
2. Submit a Stormwater mangement Permit application within 60 days of receipt of this letter.
3. Immediately stop the construction of impervious areas, piping, curbing, etc. These items
may need to be revised in order to comply with the stormwater regulations.

Failure to provide the "Plan of Action" by June 28, 1998, or to correct the violations by the date
designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in
the initiation of enforcement action which may include recommendations for the assessment of civil and
criminal penalties, pursuant to NCGS 143-215.6A.
By copy of this letter to the Carteret County Building Inspector, this Office is requesting that the
Building Inspector consider withholding building permits and Certificates of Occupancy for this project
until this matter is, satisfactorily resolved.

Maintenance plan, volume calculation example, SA/DA ratio tables for the coastal counties, NCAC 2H.1000
stormwater reguiations, anct ttie permit and calculations for Sand Ridge Subdivision detention pond, Project
Number 931006. The pond is only sized for single family lots and a multi -family apartment complex.
It is possible that the multi -family complex has been scrapped and Britthaven is being built instead.
Please check with Mr. Hill about this. I'm not sure of the exact location of the Britthaven site.

This letter is in response to your notice to Mr. Robert Hill of September 18, 1998.
We are in the process of submitting the information requested by Ms. Linda
Lewis in her letter of September 10, 1998.
In addition to the final site plan layout and design calculations, an agreement
must be executed by and between Britthaven and the Sand Ridge subdivision
developers (MAR-STAL Partnership) granting permission to discharge the
nursing home site stormwater into the permitted retention pond.
Hopefully, I will have this documentation forwarded to Linda Lewis, as per her
request, before October 10, 1998.

Dear Mr. Hill:
This letter is to notify you that the Wilmington Regional Office of the Division of Water Quality is considering
sending a recommendation for enforcement action to the Director of the Division of Water Quality. The
recommendation concerns the violation of North Carolina General Statute 143-215.6A (a)(2) ; failing to apply for and
receive a permit required by NCGS 143-215.1. You failed to respond to a request for a Stormwater Management
Permit Application made initially in January, 1998, and again on May 29, 1998, via certified mail. Construction of
the project has commenced.
If you have an explanation for this violation that you wish to present, please respond in writing to me within
ten (10) days following receipt of this Notice. Your explanation will be reviewed and if an enforcement action is still
deemed appropriate, your explanation will be forwarded to the Director with the enforcement package for his
consideration.
By copy of this letter to the Building Inspections Department, I am requesting that they consider withholding
the building permit and Certificate of Occupancy pending receipt of the stormwater permit.

This office has reviewed the subject sedimentation and erosion control plan. We find the plan to be
acceptable and hereby issue this letter of approval with comments as attached.
Please be advised that Title 15A, of the North Carolina Administrative Code, 413.0017(a) requires that
a copy of the approved plan be on file at the job site. Also, you should consider this letter to give the Notice

North Carolina's Sedimentation Pollution Control Program is performance oriented, requiring protection
of the natural resources and adjoining properties. If, following the commencement of this project, it is
determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 1 13A-51 thru 66), this office
may require revisions to the plan and its implementation to insure compliance with the Act.
Recognizing the desirability of early coordination of sedimentation control, we believe that it would be
