Subject: Town of Apex new 5-year MS4 Permit (NCS000446)
Intent to Comply

Dear Ms. Powell,

On February 4, 2021 the Town of Apex received a Notice of Compliance (NOC-2021-PC-0127) from
DEQ in reference to the recent MS4 Program audit conducted by DEQ staff in September 2020. In
accordance with DEQ policy, the Town is stating in writing that we acknowledge the MS4 permit
renewal requirements and it is our intent to fully comply within the established deadlines.

A Stormwater Management Plan (SWMP) will be drafted utilizing the DEQ Phase II MS4 SWMP
template and will be submitted to DEQ for review by June 4, 2021 (120 calendar days from receipt
of the NOC). Within 30 days of receiving written concurrence that our SWMP is acceptable, the
Town will submit an NPDES MS4 permit application to DEQ. We will respond to all public
comments on the draft SWMP and submit a final SWMP for DEQ approval and final permit
issuance.
