DANIEL SMITH Director S Reginald Kenan PO Box 472 Warsaw, NC 28398-0472 Subject: Notice of Deficiency Reginald Kenan Farm AWS310870 Duplin County NOD-2021-PC-0052 Dear Mr. Kenan: NORTH CAROLINA Environmental Quality February 8th, 2021 On December 15, 2020, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) noted during a compliance inspection a failure to perform calibrations for irrigation equipment and a failure to retain calibration records. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, multiple deficiencies have been noted for a failure to calibrate irrigation equipment and retain records under the Swine Waste System General Permit No. AWG100000 that you are covered to operate under. Deficiency 1: Failure to calibrate irrigation equipment in accordance with Condition II.26. of Swine Waste System General Permit No. AWG100000. The previous calibration date for this facility was not able to be determined but was most likely before 2018. Required Corrective Action for Deficiency 1: The facility should calibrate irrigation equipment at least once every two calendar years. Deficiency 2: Failure to retain records of irrigation equipment calibration in accordance with Condition III.15. of Swine Waste System General Permit No. AWG100000. Required Corrective Action for Deficiency 2: The facility should retain records of irrigation equipment calibration to be readily available at the facility. You are required to take any necessary action to address the above violation. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A If you have any questions concerning this Notice, please contact Jennifer Ryan at (910) 685- 2652 or at Jennifer.Ryan@ncdenr.gov.
