The project involves the installation of a new gravity sewer line connecting the West Cary Force Main to the Beaver
Creek Pump Station which will pump the sewage to the Western Wake Regional Water Reclamation Facility (WWRWRF)
for treatment This portion of the WWRWRF project will allow for conveyance of wastewater from Town of Morrisville
Research Triangle Park South the western part of the Town of Cary and the Town of Apex to WWRWRF

D Impact Justification and Mitigation
1 Avoidance and Minimization
1a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
Avoidance of impacts is only possible by implementing a no build option which does not satisfy the need for the project
Crossings of streams with protected riparian buffers are designed to be within 15 degrees of perpendicular to the stream The
crossing at B2 is as near to perpendicular as is feasible given the restraints of adjacent property owners the NCDOT
encroachment agreement for the crossing of US Highway 64 and natural topography of the area Efforts to reduce the
impacts to the B2 buffer impact area would require renegotiation of the NCDOT encroachment agreement and purchasing
additional easement width from the adjacent property owner The crossing at B6 includes Reedy Branch and an unnamed
tributary (UT) to Reedy Branch The UT crossing is as near to perpendicular as feasible in order to maintain a near
perpendicular crossing of Reedy Branch and to maintain gravity flow Further measures to reduce the area of buffer impacted
at the B6 crossing would result in an increase in the impacts to the buffer along Reedy Branch and possible loss of the
perpendicular crossing of Reedy Branch In order to minimize the impacts to the buffer along Reedy Branch careful
consideration was given to all viable stream crossing locations within the vicinity of the pipe alignment

of the United States on the subject site, and the permit applicant or other
affected party who requested this preliminary JD is hereby advised of his
or her option to request and obtain an approvedjunsd►ctional
determination (JD) for that site Nevertheless, the permit applicant or other
person who requested this preliminary JD has declined to exercise the
option to obtain an approved JD in this instance and at this time

conditions of that permit, including whatever mitigation requirements the
Corps has determined to be necessary, (5) that undertaking any activity in
reliance upon the subject permit authorization without requesting an
approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable, (6) accepting a permit authorization (e g signing a proffered
individual permit) or undertaking any activity in reliance on any form of
Corps permit authorization based on a preliminary JD constitutes
agreement that all wetlands and other water bodies on the site affected in
any way by that activity arejunsd ►ctional waters of the United States and
precludes any challenge to such jurisdiction in any administrative or
judicial compliance or enforcement action, or in any administrative appeal
or in any Federal court, and (T) whether the applicant elects to use either
an approved JD or a preliminary JD, that JD will be processed as soon as
is practicable Further, an approved JD, a proffered individual permit (and
all terms and conditions contained therein), or individual permit denial can
be administratively appealed pursuant to 33 C F R Part 331, and that in any
administrative appeal, jurisdictional issues can be raised (see 33 C F R
331 5(a)(2)) If, during that administrative appeal, it becomes necessary to
make an official determination whether CWA jurisdiction exists over a site,
or to provide an official delineation of jurisdictional waters on the site, the
Corps will provide an approved JD to accomplish that result, as soon as is
practicable

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved You must also comply with all other state federal or local government permits regulations or authorizations associated
with the proposed activity including SL 2009 337 An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S L 2011 343
This acceptance is valid for six months from the date of this letter and is not transferable If we have not received a copy of the
issued 404 Perimt1401 Cerhfication/CAMA permit within this time frame this acceptance will expire It is the applicant s
responsibility to send copies of the permits to NCEEP Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work The amount of the In
