Project Setting
Tim and Deborah McCollister's project is located on Parcel #014909000 at 0 NC 12 Hwy,
Lot 2, Block A of C H Fulcher Tract subdivision, in Frisco, Dare County. The 1.7-acre lot is
adjacent to their single-family residence at 52138 NC 12 Hwy, Frisco, and to a man-made
canal that connects to the Pamlico Sound. Man-made features onsite include a mobile
home and septic system. The shoreline length along the two sides of the canal totals 142
feet. The elevation of the tract ranges from 3' to 6' above normal water level (NWL). There
was no notable erosion escarpment in the project area, and no known archeological sites on
the property.
Coastal wetland vegetation onsite consists of Black Needlerush (Juncus roemerianus), Salt
meadow Cordgrass (Spartina patens), and Big Cordgrass (Spartina cynosuroides). High
ground is overgrown with the following non -coastal vegetation: Live Oak (Quercus
virginiana), Eastern Red Cedar (Juniperus virginiana), Wax Myrtle (Morelia cerifera),
Chinese Privet (aka Common Privet and Japanese Privet--Ligustrum sinense Lour), Adam's
Needle Yucca (Yucca filamentosa), and indigenous grasses.
The adjacent riparian property to the northeast is developed with a storage shed, and part-
owner of a wooden vehicular bridge that is elevated 4' above NWL in the center. The
applicants have purchased the vacant lot (Parcel #014908000) that is immediately next to/
west of the project site. The adjacent riparian property to the northwest is developed with a
single-family residence, detached garage, and two -track driveway that has a culvert in place
to cross the canal.
Major Permit (MP) #92-19 was originally issued on 11/25/2019 for a wooden vehicular
bridge with associated 404 wetland fill of 535 square feet (sf) and driveway using #57 stone.
Some clearing has occurred north of the canal, in front of the existing mobile home, in
preparation for the permitted driveway. The US Army Corps of Engineers (USACE)
authorized the fill project on 11/25/2019 via Programmatic General Permit #198000291
(Action ID SAW-2019-00951. The wetland delineation was verified by the USACE on
06/04/2019. The NC Division of Water Resources (DWR) authorized the project through
Water Quality Certification 4175, project DWR Project No. 2019-1295.
The Pamlico Sound is classified as Coastal Waters, and is in the Pasquotank River Basin.
The Environmental Management Commission's water classifications for this tributary are SA
and High Quality Waters (HQW). The area is closed to shellfishing. The water depths in
the adjacent man-made canal range from -V to -1.5' NWL at the project site. There were no
submerged aquatic vegetation (SAVs) found at the project site.

Development Proposal
As noted in the project setting, the original MP was issued for a wooden vehicular bridge
and stone driveway to access the existing home north of the canal. Due to the costs of
bridge construction, the McCollisters are now requesting authorization to install a 20-foot by
42-inch corrugated metal culvert in the man-made ditch/canal and place clean fill material
over the culvert. The new section of driveway is proposed to be 12 feet wide with 3:1 side
slopes, using #57 stone and geotextile fabric, and connect to the permitted driveway. This
project will impact 370± sf (18.5'x20') and require 555± cubic yards (cy) of fill below NWL.
The culvert will be installed with an excavator, and matting may be used to temporarily cross
over existing wetlands. Silt fencing will be installed around disturbed area(s) to prevent
runoff into the adjacent wetlands and waterbody.
Anticipated Impacts
Filling of the canal will impact 370± shallow water habitat in the Estuarine Waters/Public Trust
Areas AECs.

The proposed driveway will provide permanent access to the existing mobile home. The property owners have used an
adjacent property owners bridge to access the mobile home but ownership has changed and this is no longer an option. The
proposed driveway with culvert will privide permanent access over an existing ditch.

The proposed driveway will cross an existing man-made ditch with one, 42 inch 20' corrugated metal culvert. The culvert will

excavator will be used to place the culvert and construct the driveway. Equipment to be stored onsite during construction.

The subject property is located in Frisco, Dare County, North Carolina. The property is a
developed 1.17 acre lot with Coastal and Section 404 wetlands.
The existing permit was issued for wooden bridge and driveway to access an existing
mobile home. The cost associated with constructing a bridge that will support vehicles is
not economically feasible; therefore, the owners are proposing a culverted driveway over
the existing manmade ditch/canal. The access driveway will be constructed by installing
one 20 foot long by 42 inch corrugated metal culvert. The driveway will be 12 feet wide
with 3:1 side slopes down to the culvert base and fill 555 cubic yards below normal water
level. The driveway will be constructed as previously permitted using #57 stone and
geotextile fabric.
Wetland Fill Mitigation:
The existing permit is authorized to impact 535 square feet of Section 404 wetlands for
the construction of the access driveway to the existing mobile home. There are no
additional wetland impacts associated with placement of the culvert; therefore, we are
proposing no mitigation for the modification.
Wetland Delineation:
A wetland delineation was completed by Atlantic Environmental Consultants, LLC and
verified by the US Army Corp of Engineers on June 4, 2019. A copy of the Approved
Jurisdictional Determination signed by Billy Standridge is included with the application.
Submerged Aquatic Vegetation (SAV) Analysis:
An SAV (subaquatic vegetation) survey was conducted on 7/1/19 by Doug Dorman of
Atlantic Environmental Consultants, LLC. There was no SAV growth in the location of
the proposed driveway.
Construction Techniques:
The culvert will be installed with an excavator and clean fill material will be placed over
the culvert to create the driveway. As the driveway is being constructed some matting
may be placed temporarily over the existing wetlands to provide a safe working platform.
The matting will be removed when the driveway construction is complete. A pickup truck
and small tractor will be used to transport material over the driveway as it is being
constructed.
