PROJECT SUMMARY: The applicant proposes to construct a new 4-slip docking facility with a covered gazebo, floating docks, and boat lifts. 74 Pelican Drive, Raber Investments, LLC Page Two 9. PROJECT DESCRIPTION The project site is located at 74 Pelican Drive, on the Lee's Cut, in Wrightsville Beach, New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles on Eastwood Rd towards Wrightsville Reach. Cross the drawbridge and after approximately 0.3 miles bear left onto W. Salisbury Street. Travel approximately 0.13 miles and turn left to access Pelican Drive, and then turn right onto Pelican Drive. The subject property will be the first house on the left. The property boarders Lee's Cut near the Atlantic Intracoastal Waterway (AIWW) in Wrightsville Beach_ According to the applicant the 0.44 acre parcel located at 74 Pelican has a maximum elevation of 4' above normal high water (NHW) and has approximately 83' of shoreline frontage, currently stabilized by a wooden bulkhead that approximates normal high water (NHW). The lot has an existing single-family home with the highground vegetation consisting primarily of ornamental landscaping and maintained lawn grasses. Waterward of the existing bulkhead is an existing docking facility, mud flats, and open water. The existing 3-slip docking facility incorporates approximately 937 ft2 and includes two boatlifts, a floating dock, and a gazebo. No permit history was found for the original bulkhead; however, records indicate that bulkhead repairs were authorized by the Town of Wrightsville Beach beginning in 1980 with several repair and replacement permits in the following years. The Town of Wrightsville Beach permitted the first pier on this property on 4/14i1976. The current configuration was authorized by General Permit No.18159, which was issued to Robert Running on 81411998. The most recent permit for this property authorized the addition of a boatlift in an existing slip through General Permit No. 70822 issued on 4/5/2018. No further permit history was found for this location. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to construct a new 4-slip docking facility with a covered gazebo, floating docks, and boat lifts. The existing docking facility will be removed. The new docking facility would include a 3' by 6' access from the existing bulkhead leading to a 18' by 17' gazebo. A second access, via ramp, would be located east of the gazebo and would extend from the bulkhead to a 6' by 12' floating dock positioned perpendicular to the shoreline. Attached to the end of the 6' by 12' floating dock would bean 8' by 26' floating platform that would extend waterward of the gazebo and parallel to the shoreline. Two finger piers measuring 4' by 24' would extend waterward in a perpendicular position extending from each end of the 8' by 26' floating platform. A 17' by 13' boatlift would be installed on the outer west side of one of the 4' by 24' finger piers. A second boatlift measuring 14' by 13' would be installed on the outer east side of the other 4' by 24' finger pier. The proposed docking facility would extend approximately 56' from the bulkhead. In the project area the established pier headline is approximately 60' waterward of the bulkhead. The boatlifts would beset back 15' from each riparian corridor boundary. According to the application water depths is in the vicinity of the new docking facility range from -4' to -12' normal low water (NLW) (Page 1 and 2 of 2) 10, ANTICIPATED IMPACTS As proposed, the new 4-slip docking facility would result in the incorporation of approximately an additional 252 ft2 Of Public Trust Area and Estuarine Waters for a total of 1,189 ft2 incorporated. The project area consists of open water, Estuarine Water, and Estuarine Shoreline. There would be no impact to vegetated wetlands or to the high ground area. The application states that the constructed features would not encroach into either adjacent 15' riparian corridor setbacks. Additionally, no encroachment beyond the established pierhead line is proposed. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction. It was received as complete on January 22, 2021 and appears to be adequate for processing at this time. The projected deadline for making a decision is April 7, 2021. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permitdecision within 70 days from January 22, 2021, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project_ Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property, or at a point along the'road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application.
