Vegetation will be replanted in locations where temporary buffer impacts have taken place. Additionally, this design proposes two stormwater ponds with outfalls that provide diffuse flow into riparian buffers. 1a. Show the location of diffuse flow measure(s) on your site plan. 1b. Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environmental Management Commission to grant a variance when there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection. 1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit from the property shall not be considered adequate justification for a variance. The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible. Because the proposed use (commercial development (loading dock/parking access)) is not listed in 15A NCAC 02B .0714 (11) (Table of Uses), it will require an Authorization Certificate with Exception, pursuant to (10) (v). As shown in the attached, several design alternatives were considered. Alternative 3, which minimized the unavoidable buffer impacts to the maximum extent practicable, was selected. 2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc). The stream and associated buffers are located in the south central portion of the property, which makes full avoidance of the feature impossible for the intended use. As stated above, an alternatives analysis was completed and the selected alternative avoids and minimizes buffer impacts to the maximum extent practicable. 3. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different from that of neighboring property. No other adiacent Darcels are available for this Duraose and need. The subject parcel is only slightly larger in size than the proposed building and docking spaces, which limits the ability to design around the buffered feature. 4. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer Rule. The applicant is knowingly requesting a buffer variance as no other options are available in order to build the designed pro No violations to the buffer rule have occurred. 5. For Neuse, Tar -Pamlico, Jordan Lake and Goose Creek only: Did the applicant purchase the property after the effective date of the applicable Buffer Rule and then request a variance? Yes, the property is expected to be purchased in April, 2021. 6. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread. The industrial use of this property limits the options of the applicant in terms of zoning, as much of the surrounding area is residential. As mentioned previously, this design (Phase 1) is intended to connect to the overall Hodge Road Business Park (Phase 1), and therefore the parcel options are even further limited. Lastly, since the project involves one large structure rather numerous smaller ones, the ability to avoid or minimize impacts is greatly reduced. A smaller building is not possible in order to meet the need of the Droiect. and therefore would not be viable. F. Nature of Activity (Description of project, include all features) The existing USACE/DWR permits (2014-02127 and 15-1256, respectively) authorize 1.193 acres of unavoidable wetland impacts and 2,119 SF of Zone 1 and 2,590 SF of Zone 2 Neuse Riparian buffers resulting from the construction six warehouse -style buildings, semi -truck roadway, parking and loading infrastructure and required stormwater and utility services (Phase 1). The second phase of this construction project, proposed herein, would add an additional warehouse -style building and the same types of supporting infrastructure. Phase 2, as proposed, will result in additional permanent impacts to Waters of the United States, including: 0.959 acre of wetlands and 23 LF of stream, as well as permanent impacts to 128 SF of Zone 1 and 1,215 SF of Zone 2 Neuse Riparian Buffers. 19. The selected alternative (Alternative # 3) is shown on pages 1 and 2 of this attachment package and alternatives 1 and 2 (not selected) are shown in Appendix A. As detailed in the attached permit application and Appendix A, the selected alternative will result in the least WOTUS and Neuse Buffer impacts, while still providing the minimum amount of project area (building, loading and parking space) to make the project viable (financially and functionally). As shown in these plans, each alternative evaluated includes the following: Alternative #3 (Preferred): This alternative would include 41,765 SF (0.959 acre) of permanent wetland impacts, 23 LF of permanent and 21 LF of temporary stream impacts, 3,067 SF of permanent and 3,905 SF of temporary Zone 1 impacts and 930 SF of permanent and 456 SF of temporary Zone 2 riparian buffer impacts. This option includes 159,600 SF of building space, 164 automobile parking spaces, 79 flex spaces, 44 dock spaces and 24 trailer spaces. The preferred alternative also includes two wet ponds to provide the necessary water quality treatment for the site. Alternative # 1: This alternative would include approximately 41,765 SF (0.959 acre) of permanent wetland impacts, 373 LF of permanent stream impacts, 20,667 SF of permanent Zone 1 impacts and 17,392 SF of permanent Zone 2 riparian buffer impacts. This option includes 159,600 SF of building space, 218 automobile parking spaces, 79 flex spaces, 44 dock spaces and 39 trailer spaces. Alternative 41 also includes a single, large wet pond to provide the necessary water quality treatment for the site. Alternative # 2: This alternative would include approximately 41,765 SF (0.959 acre) of permanent wetland impacts, 360 LF of permanent stream impacts, 20,523 SF of permanent Zone 1 impacts and 15,035 SF of permanent Zone 2 riparian buffer impacts.
