Director Division of Water Quality May 11, 2007 DWQ Project # 07-0218 Guilford County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Blue Ridge Companies Attn: Mr. Jim Grdich 5826 Samet Drive Suite 105 High Point, NC 27265 Subject Property: Alexandria Apartments Park, High Point Oak Hollow Lake [030608, 17-(3.3), WS1V] RETURN OF APPLICATION Dear Mr. Grdich: On February 5, 2007, the Division of Water Quality (DWQ) received your application dated January 29, 2007 to impact 1,920 square feet (ft2) of Zone 1 of the protected riparian buffers and 1,280 square feet (ft2) of Zone 2 of the protected riparian buffers to construct the proposed multi- family apartment complex. On February 14, 2007, February 20, 2007, and April 18, 2007, the DWQ received additional information from you, however, your response to our last Request For More Information letter dated March 5, 2007, did not address our request regarding stormwater best management practices for your site. Specifically, the following concerns were noted: In your from the DWQ dated March 5, 2007, Item 1 stated: "You have proposed two stormwater ponds to control stormwater and achieve nutrient removal to protect water quality to the maximum extent practical, per 15A NCAC 2B.0250(2)(e). Under Nationwide Permit 39 and the corresponding General Certification 3402, if you have any impacts to any water supply waters, you must use extended detention wetlands, bio- retention or a wet pond followed by a forested filter strip (designed according to the latest version of the NC DENR Stormwater Best Management Practices Manual). Due to the fact that you are in the Randleman Water Supply Watershed, you must revise your stormwater plans. Please show your revised stormwater plans. Be sure to include all applicable O&M agreements and worksheets." The most recent submittal on this project dated April 18, 2007 still fails to meet the requirements of General Certifications 3402 for water supply watersheds because the wet ponds are not followed by a properly designed forested filter strip. In addition, this submittal includes a worksheet for only one of the proposed wet ponds (Pond 2). For these reasons your permit application is hereby considered returned. Once you have redesigned your project to address the problems and inadequacies with your application as it was submitted, you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee. Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any work done within waters of the state would be a violation of North Carolina General Statutes and Administrative Code.
