However, we realize that five (5) separate incidents within a few years at the same station is excessive. The Town of Taylorsville has been actively correcting troubled spots on our entire infrastructure; particularly the area noted in the vicinity of Northwood Park. This rehab involves slip -lining, pipe -bursting, as well as grouting and epoxy -coating 100+ manholes within our system. A great deal of our problem is the issue of inflow and infiltration leading to the Northwood Station. This rehab has been underway for several months now, and is a huge step forward in attempting to resolve the SSO's at this station. As you are aware, grants and monies for water and sewer improvements are hard to come by in the troubled financial days we are faced with, but we are actively utilizing what funds we have to prevent inflow, sand, silt, and grit from reaching the Northwood Park Station in an attempt to stop all SSO's as quickly as possible. The Town of Taylorsville has received a Rural Center Grant for gravity line rehabilitation in the Northwood area which is currently underway. The Clean Water Management Trust Fund was applied for in February, and they have not responded as yet (possibly due to budget cuts). These funds (if acquired) are intended to construct a new Northwood Pump Station, as well as continue the rehabilitation of the Town's aging sewer infrastructure. A pumping truck was in place within the hour of the first knowledge of the SSO to prevent any additional sewage from leaving the excavation hole or the Prison Pump Station. There was no additional spillage of sewer water either on the ground or into the creek soon after the pump truck arrived; therefore there was no need for a 5-day tabulation of volume reaching surface waters (4,000 gal was the entire estimated total based on scada flow data for that force main). Attached is a copy of our most recent compliance inspection report as conducted by Mrs. Barbara Sifford of the Mooresville Regional Office In May of 2009. The letter notes that although the Town of Taylorsville is contracted to maintain the Prison Pump Station and lines, the infrastructure is owned by the State of North Carolina, and not the Town of Taylorsville. There is no evidence that the force main fracture was due to negligence on the Town's part; therefore the Town believes it responded promptly to this SSO, and used reasonable judgment and care in resolving this issue. The entire infrastructure within the Prison property is only eight years old, and appears to be in very good condition. We attribute this line failure to water hammer, and have asked our engineers to look into possible ways to resolve this in the future. The check valves within the Prison Pump station were inspected, and operated properly both before and after this SSO. The Town feels that any fines as a result of this SSO should be waived because of the unpredictability of this SSO, coupled with the reasonable care taken in our quick response and clean-up in this matter. We believe that this SSO was not a preventative maintenance issue on our part; just a situation that occurred beyond our control. If you have any further questions contact me at 828-632-2218. Here is some additional information about our collection system maintenance and mapping. The Town of Taylorsville will continue to strive for optimal collection system operation in accordance with State guidelines. Hopefully this letter will address any additional concerns that your office may have. Attached are copies of our Collection System Operation & Maintenance divided into four (4) sections for 2008. This plan includes pump station contingency plan for emergency situations, and our 24 hour response plan for repairing of any leaks or sewer overflows. Also, I have included the onsite test sheet that includes results from both upstream and downstream tests performed on Stirewalt Creek shortly after the overflow. Response time: Immediate, for the Town has personal on duty 24 hours a day. Operations and Maintenance SCHEDULE FOR TESTING EMERGENCY AND STANDBY EQUIPMENT On site emergency power generators will be tested once per week either by automatic schedule or manual schedule Standby emergency power generators will be tested once per week ROUTINE PUMP STATION INSPECTION AND MAINTENANCE PROGRAM Cleaning and removing debris from the pump station structure, outside perimeter and wet well Inspection and exercising all valves Inspecting and lubricating pumps and other mechanical equipment according to the manufacture's recommendations and Verifying the proper operation of the alarms, telemetery system and auziliary equipment Operations and Maintenance CONTINGENCY PLAN FOR PUMP FAILURE AT PUMP STATIONS Process if a pump fails in multiple pump station: Repairs by Town Crew will begin immediately, if repairs are beyond Town's ability, pump will be pulled and taken to local pump repair & service. If repairs are beyond local means, pump will betaken to PDA Central Pump and Motor Service, a 24 hour pump and motor service specializing in pump and motor repairs in pump stations. Sullins, Director Division of Water Quality December 12, 2007 Subject: NOTICE OF VIOLATION Tracking #NOV-2007-DV-0318 Collection System Permit Number WQCS00135 Town of Taylorsville, Alexander County A review has been conducted of the Town .of Taylorsville's self reported Sanitary Sewer Overflows (SSOs) 5-Day Report(s). This review has shown Taylorsville to be in violation of the requirements found in Collection System Permit WQCS00135 and/or G.S. 143-215.1(a)(1). The violations that occurred during November 2007 are listed in Attachment A. Remedial and corrective actions, if not already implemented, should be taken to prevent further SSOs. Please note that due to the continued high numbers of SSOs in North Carolina the Division of Water Quality has implemented a new SSO enforcement policy. Beginning June 1, 2007, until December 1, 2007, any reportable SSO may be issued a Notice of Violation (NOV) and some may be assessed a civil penalty. Beginning on December 1, 2007, civil penalties will be issued for SSOs based on volume, volume reaching surface waters, duration and gravity, impacts to public health, fish kills, and recreational area closures. Other factors considered in determining the amount of the civil penalty are the violator's history of spills, the cost of rectifying the damage, whether the spill was intentional, and whether money was saved by non-compliance. After December 1, 2007 the SSOs highlighted in Attachment A are those that the regional office has determined, after review of the CS-SSO 5-day report, that would have resulted in a civil penalty assessment. You will have 10 days from receiving a Notice of Violation letter to provide any additional justification as to why these spills do not meet the criteria listed in this letter for civil penalty assessment beginning in January 2008.
