The existing sewer line is within a Raleigh Water recorded easement. The upsized sewer line will be located within this same easement. The developer, Cambridge -Caddy, LLC, will be responsible for the design, permitting, and construction costs up front. The existing sewer line that will be replaced is a Raleigh Water sewer line. Raleigh Water will reimburse Cambridge -Caddy, LLC for at least some of the costs. There are eleven potential aquatic resources including two streams (CH 100 — 37' and CH 200 — 32') and nine wetlands (WL 1000 — 0.097 acre, WL 1100 — 0.032 acre, WL 1200 — 0.005 acre, WL 1300 — 0.002 acre, WL 1400 — 0.030 acre, WL 1500 — 0.009 acre, WL 1600 — 0.002 acre, WL 1700 — 0.011 acre, and WL 1800 — 0.056 acre) within the sewer line easement. The streams are unnamed tributaries to Swift Creek. Replacement / upsizing of the existing sewer line will require 53 linear feet of temporary stream impacts, 0.143 acre of temporary wetland impacts to herbaceous wetlands (WL 1000 — WL 1700), and 0.056 acre of conversion impacts to one forested wetland. The forested wetland impact (WL 1800) is mostly clear of trees except for right along CH 2O0. Eight willow trees will need to be removed for construction. (Atlas) performed pedestrian surveys of the review area to search for federally listed threatened, endangered, and candidate (TEC) species that could potentially occur on the property. Prior to the fieldwork, website records were searched for potential known locations of listed species that have been mapped within a one -mile radius of the approximate center of this property. The subject site is located at 7801 Caddy Road Raleigh, NC 27603 and is within Wake County. The review area is comprised of portions of six parcels and is approximately 4,800 linear feet. The general project area is located approximately 3 miles South of Garner, NC and located along the East side of NC Highway 401. The surrounding area consists predominantly of agriculture fields, forest land, detached single family homes, commercial development, and a golf course. The project purpose is for the replacement/maintenance of an existing sewer line. Included with this package is a master plan. Project impacts will include two temporary stream crossings for the sewer line and nine temporary wetland crossings for the sewer line. A U.S. Army Corps of Engineers Nationwide Permit 3 will be required for unavoidable impacts to potential Waters of the United States. The master plan has been included in Appendix D. 1.1 Federal Status This status is designated by the U.S. Fish and Wildlife Service (USFWS) and the U.S. National Marine Fisheries Service (NMFS) in accordance with the U.S. Endangered Species Act of1973, as amended (ESA). Plants and plant varieties, (including fungi and lichens), animal speciesand subspecies, and vertebrate populations are considered for Endangered or Threatened status according to the criteria established under the ESA. Proposals and determinations to add taxa or populations to the Lists of Endangered and Threatened Wildlife and Plants are published in the Federal Register. Additionally, the USFWS and the NMFS periodically publish a Noticeof Review or Notice of Reclassification in the Federal Register that present an updated list of plant and animal taxa which are regarded as candidates or proposed for possible addition to the Lists of Endangered and Threatened Wildlife and Plants. Consult the Raleigh Ecological Services Field offices for more information. An endangered species is a taxon "in danger of extinction throughout all or a significant portion of its range" (Endangered Species Act, Section 3). A threatened species is a taxon "likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range" (Endangered Species Act, Section 3). Candidate species are "Taxa for which the [Fish and Wildlife] Service has on file enough substantial information on biological vulnerability and threat(s) to support proposals to list them as endangered or threatened. Proposed rules have not yet been issued because this action is precluded at present by other listing activity. Development and publication of proposed rules on these taxa are anticipated. The Service encourages State and other Federal agencies as well as other affected parties to give consideration to these taxa in environmental planning." (Federal Register, February 28, 1996). Taxa formerly considered as 'Category 1' are now considered as 'Candidate'. ATLAS Environmental, Inc. 338 S. These species may or may not be listed in the future, and many of these species were formerly recognized as "C2" candidate species. "...The Service remains concerned about these species, but further biological research and field study are needed to resolve the conservation status of these taxa. Many species of concern will be found not to warrant listing, either because they are not threatened or endangered or because they do not qualify as species under the definition in the [Endangered Species] Act. Others may be found to be in greater danger of extinction than some present candidate taxa. The Service is working with the States and other private and public interests to assess their need for protection under the Act. Such species are the pool from which future candidates for listing will be drawn." (Federal Register, February 28, 1996). 2 Methods 2.1 Information, Planning and Conservation System A record search of the US FWS website was conducted to determine what species are known to occur within Wake County. The US FWS T&E for Wake County shows species that are known to or are believed to occur within the county boundary. The IPaC (Information, Planning, and Conservation System) which is a mapping tool was also used to generate a table of threatened, endangered, or candidate species, and/or designated critical habitat. Species on the IPaC list include species that may be affected by the project and could include species that exist in another geographic area. For example, certain fishes or clams may appear on the species list because a project could cause downstream effects on the species such as sedimentation or increase storm flows. 2.2 NC Natural Heritage Program The North Carolina Department of Environment and Natural Resources (NCDENR), North Carolina Natural Heritage Program (NCNHP) GIS database was searched to determine what species or rare natural communities (element occurrences) are known to occur within a one -mile radius of the approximate center of the project. A list of the rare, threatened, and endangered species and communities known to occur within the Lake Wheeler quadrangle was generated for the field search and is included below from the NCNHP GIS database. This list indicates what species have been reported to the NCNHP as occurring in the state, each county, and within each quadrangle. These are not complete listings of what exists in the field as no complete survey of the state has ever been completed. Information contained in this report concerning the species presented and discussed therein came from reliable published sources, personal professional knowledge from the staff members that conducted the field surveys and possibly interviews with the current property owners during the field surveys at the review area. 3 Results 3.1 Information, Planning and Conservation System Searches of the US FWS website (www.fws.gov/endangered, www.ecos.fws.gov/ipac) found four currently listed federally threatened/endangered species in Wake County that could occur on the property or be impacted downstream. These include: Red -cockaded Woodpecker (Picoides borealis) a federal endangered bird, Yellow Lance (Elliptio lanceolate), a federal threatened clam ATLAS Environmental, Inc. 338 S. Sharon Amity Road #411 Charlotte, North Carolina 28211; 704-512-1206 (o) / 828-712-9205 (m) 4 www.atlasenvi.com / Offices in Asheville and Charlotte Page 29 of 97 species, Dwarf Wedgemussel (Alasmidonta heterodon) a federal endangered clam, and Michaux's sumac (Rhus michauxii) a federal endangered flowering plant. No currently designated critical habitats were documented to exist within the review area. 3.2 NC Natural Heritage Program A search of the NC website (www.ncnhp.org/web/nhp/database-search) found no elemental occurrences of currently listed federally threatened or endangered species within a one -mile radius of the review area. No natural areas were documented to exist within a one -mile radius of the review area. Fifteen managed areas have been documented to exist within a one -mile radius of the review area (Eleven Wake County Open Spaces, one Town of Garner Open Space, one Town of Garner- Swift Creek Greenway, one Wake County Easement, one North American Land Trust Easement). In summary there are currently four federally listed threatened/endangered species documented to exist within Wake County and having the potential to occur or be affected by the project. The survey conducted by Atlas staff included all these species to have the potential to occur or have the potential to be impacted downstream at the project. Maps were generated from NCDENR NCNHP's GIS database file and illustrate the approximate known locations of rare species or natural communities (element occurrences) within a one -mile radius of the approximate center of the project. There are no documented federally endangered, threatened, or candidate species known to occur within one mile of the project boundary. 4 Findings The project area is located along the east side of NC Highway 401 and is located approximately 3 miles South of Garner. The review area is portions of six parcels and totals approximately 4,800 linear feet. The land use within the review area is mostly forested and actively used for an existing sewer line. The entire property was thoroughly searched for the below species. 4.1 Red -cockaded Woodpecker Red -cockaded Woodpeckers are found in mature pine forest typically 60-120 years old, and these woodpeckers are known for excavating nesting cavities in living pines. These woodpeckers typically need 80 or more acres to have cavity clusters. No suitable habitat exist on site. 4.2 Michaux's Sumac Michaux's sumac grows in sandy or rocky open woods on basic soils. The sumac survives best in areas where some form of disturbance has provided an open area. Suitable habitat on site includes roadsides and on the edges of artificially maintained clearings. No Michaux's Sumac was observed on site. 4.3 Yellow Lance The Yellow Lance mussels are about 85 mm fully grown and are found in streams as small as one meter wide. These mussels prefer clean medium course sandy substrate in the main channel of streams. There are two perennial streams on site however no permanent stream impacts will occur to either stream. No Yellow Lances were observed on site during the field evaluations. ATLAS Environmental, Inc. 338 S. The mussel rarely exceeding 45 mm in length and is light brown in color. There are two perennial streams on site however no permanent stream impacts will occur to either stream. No Dwarf Wedgemussels were observed on site during the field evaluations. None of these species were observed and the project should not have a negative effect on any of these species. 5.2 Permitting If impacts to regulated waters or wetlands are required to develop the property, Condition 18 of Nationwide Permit 3 is applicable as follows: 1. Endangered Species. (a) No activity is authorized under any NWP which is likely to directly or indirectly jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act (ESA), or which will directly or indirectly destroy or adversely modify the critical habitat of such species. No activity is authorized under any NWP which "may affect" a listed species or critical habitat, unless ESA section 7 consultation addressing the effects of the proposed activity has been completed. Direct effects are the immediate effects on listed species and critical habitat caused by the NWP activity. Indirect effects are those effects on listed species and critical habitat that are caused by the NWP activity and are later in time, but still are reasonably certain to occur. (b) Federal agencies should follow their own procedures for complying with the requirements of the ESA. If pre -construction notification is required for the proposed activity, the Federal permittee must provide the district engineer with the appropriate documentation to demonstrate compliance with those requirements. The district engineer will verify that the appropriate documentation has been submitted. If the appropriate documentation has not been submitted, additional ESA section 7 consultation may be necessary for the activity and the respective federal agency would be responsible for fulfilling its obligation under section 7 of the ESA. (c) Non-federal permittees must submit a pre -construction notification to the ATLAS Environmental, Inc. 338 S. Sharon Amity Road #411 Charlotte, North Carolina 28211; 704-512-1206 (o) / 828-712-9205 (m) www.atiasenv6.com / Offices in Asheville and Charlotte Page 31 of 97 district engineer if any listed species or designated critical habitat might be affected or is in the vicinity of the activity, or if the activity is located in designated critical habitat, and shall not begin work on the activity until notified by the district engineer that the requirements of the ESA have been satisfied and that the activity is authorized. For activities that might affect Federally -listed endangered or threatened species or designated critical habitat, the pre - construction notification must include the name(s) of the endangered or threatened species that might be affected by the proposed activity or that utilize the designated critical habitat that might be affected by the proposed activity. The district engineer will determine whether the proposed activity "may affect" or will have "no effect" to listed species and designated critical habitat and will notify the non- Federal applicant of the Corps' determination within 45 days of receipt of a complete pre -construction notification. In cases where the non -Federal applicant has identified listed species or critical habitat that might be affected or is in the vicinity of the activity, and has so notified the Corps, the applicant shall not begin work until the Corps has provided notification that the proposed activity will have "no effect" on listed species or critical habitat, or until ESA section 7 consultation has been completed. If the non -Federal applicant has not heard back from the Corps within 45 days, the applicant must still wait for notification from the Corps. (d) As a result of formal or informal consultation with the FWS or NMFSthe district engineer may add species -specific permit conditions to the NWPs. (e) Authorization of an activity by an NWP does not authorize the "take" of a threatened or endangered species as defined under the ESA. In the absence of separate authorization (e.g., an ESA Section 10 Permit, a Biological Opinion with "incidental take" provisions, etc.) from the FWS or the NMFS, the Endangered Species Act prohibits any person subject to the jurisdiction of the United States to take a listed species, where "take" means to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct. The word "harm" in the definition of "take" means an act which actually kills or injures wildlife. Such an act may include significant habitat modification or degradation where it actually kills or injures wildlife by significantly impairing essential behavioral patterns, including breeding, feeding or sheltering. (f) If the non-federal permittee has a valid ESA section 10(a)(1)(B) incidental take permit with an approved Habitat Conservation Plan for a project or a group of projects that includes the proposed NWP activity, the non-federal applicant should provide a copy of that ESA section 10(a)(1)(B) permit with the PCN required by paragraph (c) of this general condition. The district engineer will coordinate with the agency that issued the ESA section 10(a)(1)(B) permit to determine whether the proposed NWP activity and the associated incidental take were considered in the internal ESA section 7 consultation conducted for the ESA section 10(a)(1)(B) permit. If that coordination results in concurrence from the agency that the proposed NWP activity and the associated incidental take were considered in the internal ESA section 7 consultation for the ESA section 10(a)(1)(B) permit, the district engineer does not need to conduct a separate ESA section 7 consultation for the proposed NWP activity. The survey was to search for cultural resources that may be subject to Section 106 of the National Historic Preservation Act and North Carolina General Statute 121-12(a). Prior to the fieldwork, publicly available records and aerial imagery was searched for potentially known resources and to identify areas that may require enhanced inspection. This report is not to be used to determine eligibility of structures for addition to the National Register of Historic Places and is not a historic structure survey report. Site photographs are included in Appendix A. The NC HPO Buffer Map results are included in Appendix B. Resource maps are included in Appendix C. The stream/wetland impact maps along the sewer line are included in Appendix D. A copy of the National Register Criterion for Evaluation is included as Appendix E. 2.1 Site Location The subject site is located at 7801 Caddy Road Raleigh, NC 27603 and is within Wake County. The review area is comprised of a portion of six parcels and is approximately 4,800 linear feet. The general project area is located approximately 3 miles South of Garner and located along the East of NC Highway 401. The surrounding area consists predominantly of agriculture, forest land, detached single family homes, commercial development, and a golf course. 2.2 Project Purpose The project purpose is for the replacement/ maintenance of an existing sewer line. Included with this package is a master plan. Project impacts will include two temporary stream crossings for a sewer line and nine temporary wetland crossings for a sewer line. A U.S. Army Corps of Engineers Nationwide Permit 3/12 will be required for unavoidable impacts to potential Waters of the United States. The sewer stream and wetland impact maps have been included in Appendix D. 2.3 Recent Site Use and History The review area has recently been used as an existing sewer line. No structures or residences were observed to currently exist within the review area. Historic aerial imagery does not indicate previous structures were located on the property in the past. The results were spatially filtered to buffered to view any known sites within 0.5 mile of the review area boundary. The map and any associated results were downloaded for further investigation. 3.2 Pedestrian Site Evaluation The reconnaissance was performed by walking transects across the site, walking the site boundaries, and when necessary performing a vehicular reconnaissance of the immediate vicinity. The entirety of the property was inspected to the greatest extent possible. It is important to note that thick vegetation, seasonal variations, and other site features can obstruct observation of certain features. 4 Results 4.1 North Carolina Historic Preservation Office Buffer Map The NC HPO Buffer Map indicated sixteen results within a 0.5-mile buffer surrounding the review area boundary. Of the sixteen results eleven are listed as having a status as Survey Only, two are listed as SA, and two are listed as SD indicating it was surveyed but is destroyed or moved. Representative photographs are included in Appendix A. The buffer map and table of results are included in Appendix B. 4.2 Pedestrian Site Evaluation During the field evaluation of the subject property no residences or structures were observed to currently exist within the review area. A property may have "significance" for association with important events or patterns of history (criterion A); for association with an important historical figure (criterion B); as an important example of period architecture, landscape, or engineering (criterion C); or for the information it is likely to yield (criterion D, applied to archaeological sites and districts, and sometimes applied to certain types of structures). A National Register nomination must demonstrate how a property is significant in at least one of these four areas. For properties nominated under criterion A, frequently cited areas of significance are agriculture, community planning and development, social history, commerce, industry, politics and government, education, recreation and culture, and others. For technical reasons, criterion B (significant person) nominations are rare. Criterion C (architecture) is cited for most, but not all, nominations of historic buildings. Archaeological sites are always nominated under criterion D, but may also have significance under one or more of the other three criteria. Properties are nominated at a local, state, or national level of significance depending on the geographical range of the importance of a property and its associations. The level of significance must be justified in the nomination. The majority of properties (about 70%) are listed at the local level of significance. The level of significance has no effect on the protections or benefits of listing. Besides meeting one or more of the above criteria, a property must also have "integrity" of "location, design, setting, materials, workmanship, feeling, and association." This means that the property must retain enough of its historic physical character (or in the case of archaeological sites, intact archaeological features) to represent its historic period and associations adequately. All properties change over time, and in some cases past alterations can take on historical significance in their own right. The degree to which more recent, incompatible, or non -historic alterations are acceptable depends on the type of property, its rarity, and its period and area of significance. Buildings with certain types of alterations are usually turned down by the National Register Advisory Committee. For example, 19th and early 20th century wood frame buildings that have been brick veneered in the mid- 20th century are routinely turned down for loss of historic integrity. Similarly, it is extremely rare that buildings covered in synthetic materials such as aluminum or vinyl siding are individually eligible for listing in the Register. Criteria Exceptions The criteria exclude birthplaces and graves of historical figures, cemeteries, religious properties, moved buildings, reconstructions, commemorative properties, and properties less than 50 years old, with certain exceptions. The following exceptions are sometimes encountered: Historic churches that are architecturally significant and retain sufficient architectural integrity can be successfully nominated under criterion C (architecture), sometimes together with criterion A for social or religious history, provided they have not been brick -veneered or covered in aluminum or vinyl siding. Cemeteries may sometimes successfully be nominated under criterion C when they retain important examples of historic stone carving, funerary art, and/or landscaping, and they also may be eligible tinder criterion A or criterion D. However, both the National Register Advisory Committee and the National Register have turned down nominations of graves when the historical importance of the deceased is the sole basis for the nomination. The National Register was created primarily to recognize and protect historic places and environments that represent how people lived, worked, and built in the historic past. Human burials are recognized and protected under other laws and programs. Moved buildings may sometimes be successfully nominated under criterion C for architecture when they remain in their historic communities and the new setting adequately replicates the original setting. The point to remember is that the program is called the National Register of Historic Places. not Historic Buildings or Historic Things, because significance is embodied in locations and settings as well as in the structures themselves. Buildings moved great distances, buildings moved into incompatible settings (such as a farmhouse moved into an urban neighborhood or a downtown residence moved to a suburb), and collections of buildings moved from various locations to create a pseudo -historic "village" are routinely turned down. In some cases, the relocation of a historic building to a distant or incompatible setting may be the last and only way to save it, and such an undertaking may be worthwhile. However, sponsors of such a project must understand that the property subsequently may not be eligible for the National Register. If a property is less than 50 years old, it can be nominated only if a strong argument can be made for exceptional significance.
