Good afternoon Jim and thank you for all of your guidance/assistance with the permit on this site. The genesis for the
modification was that the Town had asked us to provide an updated permit because of the shifting of the UGS. I had
completely forgotten that Filterra came to us during construction with an alternate size for the filterra until Joel
reminded me when we were updating the application as requested. Since the request came from Filterra, referencing
their approval to do so through the state, I assumed it was an acceptable change and that they had been given the
latitude to make those adjustments in their approval by the state given the proprietary calculations they have. Being
that the change didn't conflict with the "DESIGN STANDARDS" items 1-5 of the stormwater permit, I just assumed we
would make note of the size change on the asbuilts and certifications that were required under the "SCHEDULE OF
COMPLIANCE" item #6.
My apologies if we should have run that change through the state sooner and if my assumptions above were in error.
The filterra is constructed and we are preparing asbuilts/certifications now. Do you want that asbuilt/certification to be
the redline or to provide 2 separate submittals?

Allison,
If the size of the Filterra is being changed from what was permitted (As indicated by the new Minor Modification Form),
you need to provide a red -lined plan sheet showing the new Filterra size/location and you also need to provide a red -
lined copy of the Filterra page of the Supplement-EZ Form (Showing any applicable changes on it).
Also, for future reference, if the size /configuration of an SCM is being changed it needs to be submitted as a major
modification, not a minor modification (I'll let it slide this time since I've already reviewed it).

I was looking over the information you provided on November 25, 2020. Everything looks good except for a few small
issues:
Please correct the following:
Minor Modification Form, Part A8 — Please add to this item that the UGSs are only required for local quantity
requirements and that the State approved SCM (Filterra) has not been modified (Just for clarity).
Part B2 — Please provide a second copy of plan sheet C-1.6 (Only one was provided) and 2 hard copies of any of
the other plan sheets (that are part of the permit package) that have been changed since having issued the
permit. For example, plan sheet C-2.8 has the details of the UGS on it and these will be changed by this minor
mod so would need to be replaced). Only applicable plan sheets that were included in the permit package need
to be updated (The permittee should have a hard copy of the permit package or if they lost it, there is a hard
copy of the permit package at the Raleigh Regional Office).
Please provide the following:
• 2x hard copies of the revised first page of the Minor Modification Application (new signatures are not needed,
I'll slip sheet the revised pages in).
• 1x full electronic copy of the revised Minor Modification Application.
• 1x hard copy of plan sheet C-1.6.
• 2x hard copies of any other applicable plan sheets.
• 1x electronic copy of the applicable plan sheets.

Since these are really minor things, once I get the hard copies, anything else that may have changed from addressing

We received the submittal information on 11/25/20. Typically, the Minor Mod review takes about 30-45 calendar days

I just wanted to confirm you guys received everything and inquire how long it usually takes to receive the permit
modification? The City is holding up a CO on a building due to waiting for the permit, despite my forwarding your
previous email that it was not a big deal if we didn't change the drainage area to the Filterra.
Any insight you could provide on the permit issuance would be tremendously helpful.

Since the permitted SCM and the drainage area to it are not being changed, but other aspects of the project are, it
sounds like this can be covered under a Minor Modification.
The Minor Modification is fairly straightforward and there's no application fee. Essentially, you will fill out the Minor
Modification Form

Since having issued the original permit, we have updated our permitting language so, as part of the Minor Modification,
we will also provide the permittee with an updated permit (The updated permit does not change any of the terms or
conditions of the original permit, it just clarifies some things and is now consistent with our Regional Office permits).

Due to some value engineering and other site constraints, we revised the stormwater management plan to combine the
previous 2 underground storage systems into one larger system. We had permitted the Filterra with you to meet the
state regulations for treating any additional impervious areas and the corresponding drainage area for the Filterra has
remained the same through these changes. I tried to explain this to the local municipality, however they still wanted a
confirmation that these changes didn't warrant a revised permit from the state. I don't see how it would, however I am
attaching the updated grading/stormwater plan so you can see the changes.

The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete Stormwater Management Permit
Application for the subject project on August 27, 2019. Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 - 1062 rules.
We are forwarding Permit No. SW5190701, dated September 4, 2019, for the construction, operation and maintenance
of the subject project and the stormwater system. This permit shall be effective from the date of issuance and shall be
subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may
be required.
