Please review this draft carefully to ensure thorough understanding of the requirements and conditions it contains. Changes made to the draft permit sent to you on November 24, 2020 are outlined below. The following changes were made to the draft permit sent to you on November 24,2020: • A typographical error regarding the monitoring frequencies for total phosphorous and total nitrogen in Sections A.(1.) through A.(3.) has been corrected. • A typographical error has been corrected in the header to Section A.(3.). • Special Condition A.(8.)has been corrected to reference total zinc instead of total silver. • The facility components list in the supplement to cover has been updated for accuracy. • Per request by the County, CBOD5 limits have replaced BOD5 limits [See A.(1.)—A.(3.)]. This draft permit maintains the following significant changes identified in the letter sent on November 24, 2020: • As the Division has received a signed Engineer's Certificate indication construction has been completed under ATC No. 085359A07, the 6.0 MGD flow tier has been removed from the permit and the facility is under operation at the 7.5 MGD flow tier[See A.(1.)]. • Per the Name/Ownership Change Request received on November 23, 2020, the facility name has been changed from "Twelve Mile Creek WWTP"to "Twelve Mile Creek WRF." • Based on the 2012 Statewide Mercury TMDL implementation guidance, Special Condition A.(9.)Mercury Minimization Plan has been removed from the permit. • Based on the reasonable potential analysis(RPA) showing reasonable potential to violate state water quality standards based on a limited data set, quarterly monitoring for total cadmium has been added to the permit [See A.(1.), A.(.2), and A.(3.)]. • Based on review of instream monitoring data, the Division has removed sampling requirements at the location "one quarter mile downstream from the outfall, before confluence with the first tributary" [See A.(1.), A.(.2), and A.(3.)]. The Permittee shall continue to report Monthly Average Total Phosphorous and 12- Month Mass Average Loading Total Phosphorous via the Division's eDMR system [See Special Condition A.(5.)] • To provide verification of the site-specific criteria for copper and silver developed as a result of the County's 2005/2006 Water Effect Ratio study, Special Condition A.(8.) Water Effect Ratio Confirmation Study has been added to the permit. • Special Condition A.(3.)has been modified to include the specific three years in which the Effluent Pollutant Scan shall be performed(2022,2023, and 2024). In addition,at the end of the Special Condition,2nd species Toxicity Testing Requirements for municipal permit renewals per Federal Regulations [40 CFR 122.21(j)(5)]have been added.As such, Special Condition A.(10.)Additional Toxicity Testing Requirements for Municipal Permit Renewal has been removed from the permit. • A notation was made concerning the Electronic Reporting Rule—Phase 2 Extension. EPA has extended the Phase 2 deadline from December 21,2020,to December 21,2025 [See Special Condition A.(7.)] • Parameter codes have been added to the Effluent Limitations and Monitoring Requirements [ See A.(1.),A.(.2),and A.(3.)]. The NPDES standard conditions(Parts II,III,and IV)that are a part of the permit are not included in this draft document (cover, map, and Part I). The conditions are the same as in your current permit except that agency and division names have been updated.The latest version is available at https://bit.ly/3k5NFaL and can be viewed online or downloaded as a PDF file. Concurrent with this notification the Division is publishing a notice in a newspaper having circulation in the general Union County area, soliciting public comments on this draft permit. CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) [15A NCAC 02B.0200] The effluent discharge shall at no time exhibit observable inhibition of repeduAtm or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%at 7.5 MGD,9.0 MGD and 12.0 MGD flow. The permit holder shall perform at a minimum,quarterly monitoring using test procedures outlined in the"North Carolina Ceriodaphnia Chronic Effluent BioassayProcedure, Revised December 2010,or P subsequent versions or"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-December 2010)or subsequent versions.The tests will be rformed during the months of February,May,August,and November.These moms signify the f. onth of each three-month toxicity testing quarter assigned to the facility.Effluent sampling sting mustte obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. vi If the test procedure performed as the first test of any single qu er results in a failure or ChV below the permit limit,then multiple-concentration testing shall be performed at a minimum,in each of the two following months as described in"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"(Revised-December 2010)or subsequent versions. All toxicity testing results required as part of this permit condition will be entered electronically using the Division's eDMR system for the month in which tests were performed,using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Comple. ' quatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after + ,d of the reporting period for which the report is made. Test data sha omplete,accurate,include all supporting chemical/physical measurements and all concentration/re'ponse data,and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,the permittee will complete the information located at the top of the aquatic toxicity(AT)test form indicating the facility name,permit number,pipe number,county,and the month/year of the report with the notation of"No How"in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above Page 6 of 13 Permit NC0085359 Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter,which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream,this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document,such as minimum control organism survival,minimum control organism reproduction,and appropriate environmental controls,shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A.(5.) TOTAL PHOSPHOROUS (TP) MONITORING [G.S. 143-215.1(b)] The Permittee shall calculate a 12-month rolling average mass loading as the sum of monthly loadings, according to the following equations: (1) Monthly Average(pounds/day) =TP x Qw x 8.34 Where: TP=the arithmetic average of total phosphorus concentrations (mg/L) obtained via composite samples (either daily,weekly,or monthly average values)collected during the month Qw=the average daily waste flow(MGD) for the month 8.34=conversion factor,from (mg/L x MGD) to pounds The 12-month rolling average mass loading is defined as the sum of the monthly average loadings for the previous 12 months inclusive of the reporting month: 1, TPma+12 (2) onth Average Mass Loading(pounds/day)= 1 (inclusive of reporting month) Where: TPma is d as the tota phosphorus monthly average mass loading(calculated above). The monthly average d 12-month average mass loadings shall be reported electronically using the Division's eDMR system for Twelve Mile Creek WWTP. The Permittee shall report the TP concentration for each sample electronically using the Division's eDMR system. Reporting of and compliance with the TP limit shall be done on a monthly basis. Page 7of13 Permit NC0085359 A.(6.) EFFLUENT POLLUTANT SCAN (Municipal POTWs) [G.S.143-215.1(b)] a. The Permittee shall perform a total of three(3)Effluent Pollutant Scans for all parameters listed below. One scan must be performed in each of the following years: 2022,2023,and 2024. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly toxicity test each year,and must represent seasonal variation[i.e.,do not sample in the same quarter every year]. Unless otherwise indicated,metals shall be analyzed as"total recoverable."
