Dear David and Sue, Attached is a complete set of updated Buffer Impact Drawings that includes the wetlands impacts along NC61 as well as an updated Erosion Control Sheet (Sheet 20). The updated erosion control sheet now includes a stream restoration detail and updated Temporary Stream Crossing Notes in addition to addressing the items below. 1) The review area for the Jurisdictional Determination for the project, dated 5/26/2020, did not cover the proposed project area in the following locations: 1) the proposed corridor on Sheet 15 from approximately STA 9+00 to 13+81 and 2) the proposed waterline along NC Highway 61. Have these areas been evaluated/delineated by a qualified environmental consultant? If so, please provide the appropriate documentation. Note that the Corps may require a site visit to verify the delineation, and additional revisions may be required on the PCN and plans based on the final Corps -verified boundaries of potential waters of the US; Pilot personnel delineated the proposed waterline corridor. The attached exhibits depict the delineated features and include updated impacts to the delineated features and associated buffers. 2) Please confirm that no permanent rip rap is proposed in stream channels below the Ordinary High Water Mark. If otherwise, please correct the PCN and show on the plans. Any rip rap placed in the streambed must be keyed in/depressed into the stream bed such that the top of the rip rap is no higher than the stream bed, and the profile views should clearly show that; No permanent rip rap is proposed in stream channels below the Ordinary High Water Mark. Temporary rip rap placed in stream bed shall be removed by contractor following the temporary stream crossing, with permanent rip rap for maintenance access to remain on banks and above the Ordinary High Water Mark. 3) Sheet 17 near STA 49+00 shows rip rap in the stream channel. Please confirm whether this is existing or proposed rip rap; The above referenced rip -rap is existing. Located in a ditch conveying stormwater runoff from a 15" RCP leading to a 24" RCP culvert traveling under highway US 70. 4) Sheet 20, under "Temporary Stream Crossing Notes", item 7 references "restore stream banks in accordance with details shown on Sheet 13." However, Sheet 13 does not appear to provide such detail. Please provide a restoration plan for proposed temporary impacts to streams, ensuring that this plan complies with NWP 12 Regional Conditions 3.10 and 3.11; Stream Restoration Detail has been added to Sheet 20 and Temporary Stream Crossing Notes have been updated to reference correct detail. 5) Per NWP General Condition 18, and given recent USFWS concerns regarding suitable small whorled pogonia habitat and the fact that the nearest known population of this species is less than 3 miles to the north, please complete a pedestrian survey for this species within the Corps ESA action area during the appropriate field survey season. In this case, the Corps ESA action area would be contained within a 100 foot radius of the extent of each footprint of proposed impacts to waters of the US, including the currently proposed footprint and any revised footprint if project plans are changed per the above items. Following the survey, please provide the survey report to the Corps (copy also the USFWS) for review. Of course, if you do not believe that any suitable habitat exists in the Action area for these species, please provide a more specific justification than what was provided in the PCN so that the Corps could evaluate the potential for a No Effect determination. For reference, habitat requirements for this species can be found on pages 23-29 of the species' Recovery Plan (https://ecos.fws.gov/docs/recovery plan/921113b.pdf); Pilot returned to the site and completed a detailed habitat assessment at the required locations. A copy of the report is attached. 6) Note that the owners of properties on Sheet 13 (specifically Ingle and Turner) have been working to resolve a stream and buffer violation with NCDWR, and stream restoration has been proposed in this area that may conflict with the proposed sewer installation project. It may be beneficial for the applicant and these property owners to coordinate to avoid potential conflicts that may be detrimental to the success of both projects. The town has communicated with the stream restoration agency regarding the location and timeline of all work and it was determined that the area of concern is located within a section of Phase 2 of the proposed project. Since this is a future Phase, there are no immediate concerns for conflict, but correspondence will continue ensure future impacts are avoided. (Pilot) has completed a habitat assessment for small whorled pogonia (Isotria medeoloides) at the above -referenced site. The habitat assessment was conducted at stream and wetland impact areas. The stream and wetland impact areas are depicted on the attached USGS Topographic Map (Drawing 1) and Overall Utility Plan (attached).). Background Pilot previously submitted a Pre -Construction Notification (PCN) to your office requesting a Nationwide Permit 29 Verification. PO Box 128, Kernersville, NC 27285 www.pilotenviro.com Small Whorled Pogonia Habitat Assessment Report Pilot Project 5168.2 February 8, 2021 Additionally, we received an e-mail from Olivia Munzer with the NC Wildlife Resources Commission dated January 11, 2021. The e-mail indicates that based on her review of the PCN, suitable habitat for small whorled pogonia habitat appearto be present within the area of impact. A summary of the species/habitat description, our methodology and our findings is provided below. Species/Habitat Description Small Whorled Pogonia (Isotria medeoloides) Description: Small -whorled pogonia has a greenish -white stem that grows between 3 —13 inches (7.6 - 33 centimeters) tall. It gets its common name from the five or six grayish -green leaves that are displayed in a single whorl around the stem. When the leaves are well developed, a single flower or sometimes a flower pair rises from the center of the circle of leaves. The flowers are yellowish -green with a greenish -white lip. Each flower has three sepals of equal length that spread outward. The flowers are scentless, lack nectar, and are primarily self -pollinating. It produces fruit which ripens in the fall. The seeds contain very little food reserves and therefore need to fall on soil containing mycorrhizal fungi in order for the seed to germinate and seedlings to become established. An over -wintering vegetative bud may form in late August or September. Occasionally small whorled pogonia will reproduce vegetatively, without the use of seeds. Habitat: Small whorled pogonia can be limited by shade. The species seems to require small light gaps, or canopy breaks, and generally grows in areas with sparse to moderate ground cover. Too many other plants in an area can be harmful to this plant. This orchid typically grows under canopies that are relatively open or near features that create long -persisting breaks in the forest canopy such as a road or a stream. It grows in mixed -deciduous or mixed-deciduous/coniferous forests that are generally in second- or third -growth successional stages. The soils in which it lives are usually acidic, moist, and have very few nutrients. Regarding habitat, the USFWS Fact Sheet indicates that: "This orchid grows in older hardwood stands of beech, birch, maple, oak and hickory that have an open understory. Sometimes it grows in stands of softwoods such as hemlock. It prefers acid soils with a thick layer of dead leaves, often on slopes near small streams." Methodology Pilot conducted a literature review to determine specific habitat requirements for this species. Pilot personnel conducted the habitat assessment within the specified 100-feet of impacts to waters of the US on January 16, 2021 to assess and document potential habitat for this species. The assessment was conducted via pedestrian transects within the assessment areas. Each of the areas assessed are documented below and correspond with the locations of features identified on the attached exhibit. Small Whorled Pogonia Habitat Assessment Report Pilot Project 5168.2 February 8, 2021 Stream Crossing 1—Stream Crossing 1 contains a maintained NCDOT right-of-way (mowed grass) with a wooded fringe. The dominant tree species within the wooded fringe include Northern red oak, tulip poplar, American beech and red maple. The dominant saplings include Russian olive and American beech. The understory is dense and is dominated by Japanese honeysuckle, green briar and blackberry. The understory is not open and is not considered to be potential habitat for small whorled pogonia. Photographs 1 & 2 show the area to be impacted by the proposed project (within 100 feet of the proposed impact). Stream Crossing 2/Permanent Wetland Impact — Stream Crossing 2/Permanent Wetland Impact Area contains a maintained NCDOT right-of-way (mowed grass) and a wooded fringe. The dominant tree species within the wooded fringe include sweet gum, green ash, tulip poplar and red maple. The dominant saplings include Chinese privet, autumn olive, American horn beam, red elm and sweet gum. The understory is dense and is dominated by Japanese stilt -grass, Japanese honeysuckle, green briar and blackberry. The understory is not open and is not considered to be potential habitat for small whorled pogonia. The trees/wooded land that are being disturbed are younger than 50 years old. The age structure and dense understory are not considered to be potential habitat for small whorled pogonia. Photographs 3 & 4 show the area to be impacted by the proposed project (within 100 feet of the proposed impact). Stream Crossing 3 — Stream Crossing 3 contains wooded land. The dominant tree species within the wooded area include tulip poplar, red maple, Virginia pine, sweet gum, sourwood and hickory. The dominant saplings include American hornbeam, Chinese privet, mockernut hickory, mahonia and American holly. The understory is relatively open and is dominated by Japanese honeysuckle, Japanese stilt -grass, ebony spleenwort, Christmas fern and meadow onion. Muscadine vines are present. In the areas immediately adjacent to the crossing, the leaf litter is sparse and absent in most areas from frequent flooding. The trees/wooded land that are being disturbed are younger than 50 years old. Based on the age structure of the trees, the species observed and the lack of a thick layer of leaf litter, the area is not considered to be potential habitat for small whorled pogonia. Photographs 5 & 6 show the area to be impacted by the proposed project (within 100 feet of the proposed impact). Stream Crossing 4 — Stream Crossing 4 contains wooded land. The dominant tree species within the wooded area include tulip poplar and sweet gum. The dominant saplings include American hornbeam, sweet gum, boxelder, sourwood and red maple. The understory is relatively dense and is dominated by Japanese honeysuckle, Japanese stilt -grass, multiflora rose, Chinese privet and wood oats. In the areas immediately adjacent to the crossing, the leaf litter is sparse and absent in most areas from frequent flooding. Additionally, overstory trees are sparse due to historic beaver activity. The trees/wooded land that are being disturbed are younger than 50 years old. Based on the age structure of the trees, the species observed, the lack of a thick layer of leaf litter and the dense understory the area is not considered to be potential habitat for small whorled pogonia. Photographs 7 & 8 show the area to be impacted by the proposed project (within 100 feet of the proposed impact). Small Whorled Pogonia Habitat Assessment Report Pilot Project 5168.2 February 8, 2021 Temporary Wetland Impact Areas — The temporary wetland impact areas are emergent wetlands that are routinely mowed. There is no habitat for small whorled pogonia present. Photographs 9 & 10 show the area to be impacted by the proposed project (within 100 feet of the proposed impact). Findings and Conclusions We did not observe suitable habitat for small whorled pogonia within 100 feet of the impacts associated with the proposed project. Based on our observations, impacts to streams and wetlands are not likely to adversely affect the small whorled pogonia and it is our opinion that a detailed survey is not warranted.
