Rex Gleason NO ' PREPARED BY: Richard Bridgeman�"._� SUBJECT: Gaston County Schools EMC SOC WQ 91-09 Gaston County During November, 1995 Gaston County Schools submitted an SOC amendment application and requisite processing fee, thinking that the -incomplete construction toward elimination of the discharge by connection to the City of Gastonia required a revised SOC schedule. W. A. Bess Elementary is the only remaining school of the original four which has not completed its construction/compliance schedule.. Review of the subject SOC revealed that the relevant date for W. A. Bess actually requires the school system to either begin operation of a non -discharge system or attain full compliance with NPDES final effluent limitations by December 1, 1995. The SOC is scheduled to expire on March 1, 1996. A review of the last 12 months (10/94 - 9/95) of self - monitoring data disclosed total effluent limitations compliance. Such being the case, this Office recommends that the SOC not be amended; rather, it is recommended that the SOC either be allowed to expire on March 1, 1996 or be rescinded immediately, and .that the processing fee be returned to the school system. An amendment is.needed to the above Special Order by Consent because of construction delaysi. beyond the control of the Gaston County Schools. The construction project consistof approximatel] 15,000 LF of 12-inch and 8=inch gravity sewer lines serving the drainage basin along with a pump station and 900,LF of force main serving the school. The force main is completed and tested. The -pump station is completed ,'but not tested. A portion of the gravity system crosses and is parallel with a Duke Power Company right-of-way containing a 44,000 volt transmission line. Also in this area is a crossing of Kendrick.Road (SR2445) at a depth of approximately 17-feet. The rock surface ranges from 0 to 10 feet below grade: mostly close to 0 feet' -Explosive charge size is restricted.by the proximity of the power lines and houses. Seismographs are in use. We have experienced. approximately 8 weeks delay in dealing with Duke Power -and ,NCDOT officials. Interim dates for this project have been' met. The delays experienced with Duke Power Company and NCDOT will allow inclement weather to have an additional negative impact. VI. I. Request the Effluent Limits of the SOC be continued: 2. Bess Elementary for making outlets to waters of this State as required pursuant to NCGS 143-215.1a; (b) That the GCSS is unable to comply with the final effluent limitations for BOD, Dissolved Oxygen and Ammonia, found in Part I.A. of the Permits without construction and proper operation of additional wastewater treatment facilities; (c) That noncompliance with the conditions of the Permits identified in l(b) above constitutes causing/contributing to pollution of waters of this State named above; (d) That -the GCSS is within the jurisdiction of the Commission as set forth in Chapter 143, Article 21 of the North Carolina General Statutes; (e) That the GCSS hereby waives its right to an administrative hearing authorized by NCGS 143-215.2 on the terms*of this Special Order by Consent, and also hereby waives its rights to seek judicial review of this Special Order by Consent as provided in accordance with NCGS 143-215.5. 2. The GCSS, desiring to comply with the permit identified in paragraph 1(a) above, hereby agrees to do the following: (a) Comply with all terms and. conditions of the permit except those effluent limitations identified in paragraph I* above. See Attachments A-E for all monitoring requirements and effluent limitations. The permittee•may also be required to monitor for other parameters as deemed necessary by the Director in future permits or administrative letters. (b) Undertake the following activities in accordance with the indicated time schedule: 1. South Gastonia Elementary School - NC0062227 a. Submit plans and specifications on or before October 1, 1991 for the installation of a sanitary sewer to the City of Gastonia's Crowders Creek Wastewater Treatment Plant sewage collection V system. b. Upon receipt of an Authorization to Construct, begin construction by no later than April 1, 1992. C. Make connection to the City of Gastonia's Crowders Creek Wastewater Treatment Plant sewage collection system, thus eliminating the discharge, on or before August 31, 1992. 2. Tryon Elementary School - NC0041271 a. Apply for a non --discharge permit or request permit modification for relocation of the outfall (if non -discharge alternatives are not feasible) on or before October 1, 1991. b. For relocation of outfall option, submit plans and specifications upon approval of NPDES permit modification. C. Upon receipt of an Authorization to Construct, begin construction'by no later than July 1, 1992. d. Begin operation of the non -discharge system or attain full compliance with final effluent limits by November 1, 1992. 3. Chapel Grove Elementary - NCO041351 a. (d) During the time in which this Special Order by Consent is effective, comply with -the interim effluent limitations contained in Attachments A-E. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. 3. The GCSS agrees that unless excused under paragraph 4, the GCSS will pay the Director of DEM, by check payable to the North Carolina Department of Environment, Health and Natural Resources, according to the following schedule for failure to meet the deadlines set out in paragraphs 2(b) and 2(d), or failure to attain compliance with the effluent limitations/monitoring requirements contained in Attachment A. Failure 'to meet a schedule date $100/day for the first 7 days; $500/day thereafter Failure to maintain compliance with $1000/violation any modified limit contained in the SOC. Failure to achieve compliance with final effluent limits at expiration of the SOC Monitoring frequency violations Failure to submit progress reports $2000/violation $100 per omitted value per parameter $50/day for the first 7 days; $250/day thereafter 4. The GCSS and the Commission agree that the stipulated penalties are not due if the GCSS satisfies the DEM that noncompliance was caused solely by: a. An act of God; b. An act of war; c. An intentional act or omission of a third party, but this defense shall not be available if the act or omission is that of an employee of agent of the defendant or if the act or omission occurs in connection with a contractual relationship with the permittee; d. An extraordinary event beyond the permittee's control. Contractor delays or failure to obtain funding will not be considered as events beyond the permittee's control; or e. Any combination of the above causes. Failure within 30 days of receipt of written demand to pay the penalties, or challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection action, which the Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the 30 days has elapsed. 5. Under paragraph 2(d) of the Special Order by Consent, the GCSS was required to maintain compliance with interim limits set forth in the Consent Order. In March, 1992 the GCSS reported the BOD as being 29.0 mg/1 at South Gastonia Elementary. Although we are concerned by this violation, the Commission will .not assess a penalty for exceeding the final winter BOD permit limit of 22.0 mg/1 for the month of March, due to the fact that it was only a single violation and that the discharge from the school was eliminated ahead of schedule. The speculative discharge to Catawba Creek from W.A. Bess Elementary School will not be modeled right away. Flow in Catawba Creek is dominated by the City of Gastonia's Catawba Creek WWTP. This arm of Lake Wylie is one of the most eutrophic segments in the reservoir and will be included in an ongoing effort to model the entire reservoir. Since a level B model may not adequately assess the effects of nutrients on the embayent, it is recommended that this proposed discharge be considered during the level C modeling effort. We have recently made the necessary arrangements to install outfall piping of our waste at one facility, South Gastonia Elementary, to a new treatment facility under construction by the City of Gastonia. The piping will be complete in 1991 and the City's plant is scheduled to begin operations in early 1992. The other four plants; New Hope, W. A. Bess, Tryon, and Chapel Grove, are candidates for either subsurface drain fields or extended outfall piping. We have contracted with Frank C. Cockinos & Associates, Inc. to help us evaluate our options. The first phase of this will be an evaluation of the soil.characteristics at four of the sites by our local sanitarian. This is scheduled in mid October. Following this evaluation we will be able to evaluate the alternatives of subsurface distribution verses extended outfall piping.
