Dear Mr. Mohr:
This letter is in reference to your permit major modification request received April 13, 2020, and
subsequent additional information received July 27, 2020.
In a letter dated September 21, 2020, Poonam Giri of the Water Quality Permitting Section's Non -
Discharge Branch asked you to provide additional information (copy of letter attached) no later than the
close of business on October 22, 2020. This deadline was extended to November 21, 2020 in an email to
Mr. Miles Galloway of The Wooten Company on October 16, 2020. As of today, this information has not
been received, therefore, the Division of Water Resources must return your application as incomplete
pursuant to 15A NCAC 02T .0107(e)(2).
The proposed major modification is considered an expansion; therefore this permit shall be issued
pursuant to G.S. 143-215.313(d). This requires that the facility be compliant with 15A NCAC 02T .0700
readopted September 1, 2018. There are several outstanding 15A NCAC 02T requirements, including
design criteria and setbacks to infiltration sites [see 15A NCAC 02T .0705(y) and 02T .0706(a)], which
shall be addressed before a modified permit can be issued. As noted in the Division's November 20, 2020
letter (attached), there are mechanisms within the 15A NCAC 02T regulations to address alternatives to
both the 15A NCAC 02T .0705(y) and 02T .0706(a) requirements.
When the requested additional information has been obtained, a new major modification
application package and appropriate permit processing fee may be submitted.
Please be advised that construction and/or operation of the subject facilities without a valid
permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions in
accordance with G.S. 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be
assessed for failure to secure a valid permit.
