However, additional information is required before the review may be completed. Please address the items on the attached pages no later than the close of business on October 22, 2020. Design Criteria: The permit modification request received on April 13, 2020 specifies a loading rate of 1.59 gallons per day per square foot (GPD/ft2) for Basin #2. Increasing the loading rate from 1.099 to 1.59 GPD/ft2 means that Basin #2 is no longer grandfathered under 15A NCAC 02H .0219(k), and shall meet the requirements for high -rate infiltration systems pursuant to 15A NCAC 02T .0700. Accordingly, demonstrate that Basin 92 meets the design criteria requirements in 15A NCAC 02T .0705. Please update the application, plans, specifications, and calculations, as necessary. B. Compliance and Review Boundaries: In the Additional Information Response dated July 24, 2020, it was stated that the review and compliance boundaries for Basin 92 would be unchanged from the original permit. The proposed modification to Basin 42 makes it subject to the compliance and review boundaries specified by 15A NCAC 02L .0107(b) and 15A NCAC 02L .0108 instead of those established by original permit issuance under 15A 02H .0219(k). As these boundaries have been changed, a modified site map is required. Revised site plans and maps must depict the location, orientation, and relationship of facility components including (at a minimum): a) Scale no greater than 1-inch equals 100 feet (special provisions may be granted upon prior approval for large properties) b) Legend, north arrow, scale, and legible in black and white c) Topographic contour intervals not exceeding two feet d) All facility -related structures and fences within the treatment, storage, and disposal areas e) All habitable residences and places of assembly within 500 feet of all treatment, storage, and irrigations sites f) Location of all wells, streams (ephemeral, intermittent, and perennial), springs, lakes, ponds, ditches, and other surface drainage features within 500 feet of all waste treatment, storage, and disposal site(s) g) Location and identification of each monitoring well (identify any background/upgradient wells) h) Latitude and longitude coordinates of all monitoring wells (decimal degrees to 6 digits and in NAD83) i) Location and identification of major components of the waste disposal system j) The wetted perimeter of Basin 92 k) Location and ownership of property boundaries within 500 feet of the disposal area (including road/rail right-of-way and easements) 1) The delineation of compliance and review boundaries (as defined by 5A NCAC 02L .0107(b) and 15A NCAC 02L .0108) m) Distance measurements verifying all setbacks provided by 15A NCAC 02T .0706 are being met n) Stormwater drainage controls o) 100-year floodplain Please note, that boundaries and physical features not under purview of other licensed professions shall be provided by a professional land surveyor. Compliance and Review Boundaries (continued): Pursuant to 15A NCAC 02T .0705(y), subsurface groundwater lowering drainage systems are prohibited within the compliance boundary. Please demonstrate how the system can be modified to meet these requirements. Alternatively, you may request the compliance boundary be established closer to the waste disposal area, provided the groundwater standards can be met at the newly established compliance boundary pursuant to 15A NCAC 02T .0105(h). Facilities utilizing subsurface groundwater lowering drainage systems must demonstrate that groundwater and surface water standards will be protected pursuant to 15A NCAC 02T .0704(1). Please provide supporting information that this condition is being met with the proposed loading rate. This may include submission of a hydrogeologic modeling report. C. Setbacks: 1. Increasing the infiltration rate requires that Basin #2 meet the setback requirements listed in 15A NCAC 02T .0706. This includes: I. Each habitable residence or place of assembly under separate ownership: 100 ii. Each habitable residence or place of assembly owned by the Permittee: 50 iii. Each private or public water supply source: 100 iv. Surface waters: 200 v. Groundwater lowering ditches: 200 A. Surface water diversions: 50 vii. Each well with exception of monitoring wells: 100 viii. Each property line: 50 ix. Top of slope of embankments or cuts of two feet or more in vertical height: 100 x. Each water line: 10 xi. Subsurface groundwater lowering drainage systems: 200 xii. Public right of way: 50 xiii. Nitrification field: 20 xiv. Each building foundation or basement: 15 xv. Each impounded public surface water supply: 500 xvi. Each public shallow ground water supply (less than 50 feet deep): 500 Review of the provided plans show that Basin #2 does not meet (i) and (xi) above. Please verify that all setbacks are met. 2. Setback waivers will be required for residential dwellings under separate ownership (i.e., item i. above). The owners of properties PIN 069149 and PIN 069150 shall execute and file with the Onslow County Register of Deeds the attached setback waivers. Setback waivers shall be written, notarized, signed by all parties involved, and recorded with the county Register of Deeds. Waivers involving the compliance boundary shall be in accordance with 15A NCAC 02L .0107. If the setbacks to surface waters, groundwater lowering ditches, and subsurface groundwater lowering drainage systems meet the requirements of 15A NCAC 02T .0706(c), these setbacks may be reduced to be 50 feet. To meet this requirement, a demonstration that the treatment units are designed to meet effluent limits of 4 mg/L of Total Nitrogen and 2 mg/L of Total Phosphorus must be provided. This should include a supporting wastewater chemical analysis.
