Dear Mr. Potter:
On February 9, 2010, Angela Hammers, with assistance of Vincent Lewis, of the Wilmington
Regional Office of the Division of Water Quality (DWQ) inspected Arby's Restaurant on
Shipyard Boulevard in Wilmington, New Hanover County to determine compliance with
Stormwater Management Permit Number SW8 991224 issued on March 31, 2000. DWQ file
review and site inspection revealed that the site is not compliant with the terms and conditions
of this permit. Please find a copy of the completed form entitled "Compliance Inspection
Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
A certification of the stormwater system from a professional engineer was not found in
the file. Submit the certification to this Office.
Please inform this Office in writing before March 19, 2010, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the
assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by March 19, 2010 then DWQ staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.
Please be reminded that if any ownership or name change has occurred it is the permittee's
responsibility to notify this office in writing. If you have any questions please contact me at the

Site Description
The project site is located on the south side of Shipyard Boulevard, between 171h
Avenue and New Kirk Boulevard in Wilmington, New Hanover County, North
Carolina. The site is bounded to the north by Shipyard Boulevard, to the east by
New Kirk Boulevard, to the west by an existing Wendy's Restaurant, and to the
south by Shipyard retail shopping center.
The site is currently undeveloped with a fair stand of grass vegetation with
several mature pines trees.
Ground surface topography is nearly level with gentle downward slope of less
than 1 percent across the site in the east west direction.

• City Design Requirements
The peak storm runoff from the 10-yr.,6-hr. rainfall after development
shall not exceed the peak discharge for the same rainfall event before
any development has occurred.
2. Check the 50-yr., 6 hr. event to insure no flooding of buildings is
induced by the facilities to be built.
Storm Design Concept
There is no storm sewer system on this site, which can serve as outlet for
the proposed pond. However, the general characteristic of the soil is
sandy with high percolation rate. Therefore, the concept of providing
enough storage volume to detain the storm runoff, and allow it to exfiltrate,
or exit the basin by infiltrating into the soil ground is the main basis for the
storm design. Thus, the assumption used is detain the entire volume
generated by a 10 year - 6 hour storm duration.
Based on the information provided to us by the Geotechnical Engineer,
the native sandy soils has a percolation rate of 2.2 to 2.5 inches per
minute (or 0.12 gals/min/sq.
First Flush Volume Calculations
On a typical storm routing design i.e. detention pond with outlet structure,
the first inch of storm is not allowed to drain to the structure. Thus, the
detention pond volume is increased the first flush volume.
• In this particular design however, there is no storm outlet for the pond
except by percolation, detaining not only the first inch of rain but also the
entire storm runoff. Thus, the first flush volume was considered part of the
detention storage volume.

The curb inlet design procedure is based on a standard City of Wilmington curb inlet
with a 4-foot opening. The following procedure is used to locate inlets, however,
other factors shall be considered such as location -of low points, intersection and
layout of pipe system.
a. Determine maximum gumer flow from the nomograph "Flow in triangular gutter
sections_" The known values of street longitudinal slope, S; street cross slope,
Sx; allowable spread, T=8 feet; and roughness coefficient, n: are used to solve for
the gutter capacity, Q.
b. Determine location of inlet using the rational formula rearranged such that:
A - Q/CI
Locate first inlet. by trial and error with planimeter and topograpbic map such that
gutter flow does not exceed capacity determined above. Check selection of "C"
and "I" for the actual area determined.
c. The next inlets are located utilizing Charts F-1 and F-2. Determine the required
curb opening length, Lt and enter in Chart F-2, with the ratio L/Lt where L is the

Professional Service Industries, Inc. (PSI) has completed the requested testing of the in -place
soils at the proposed Arby's Restaurant located,along Shipyard Boulevard in Wilmington, North
Carolina. Our role on this site was to perform soil percolation testing to be used in the design of
an effective storm water sewer system.
Our testing consisted of performing one hand auger boring to a depth of three feet in four
locations, as outlined in DS Atlantic's request dated June 18, 1999. 'Our hand auger borings
were performed using a four -inch diameter hand auger. Groundwater levels, soil types, and soil
percolation rates can be found in the following chart.
