The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8 991141 to Hampton
Inn, Sunset -Beach, NC for a High Density Project on June 19, 2001, This permit expires on June 19, 2011. Per 15A
NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the
expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still
an active project please complete and submit the enclosed renewal application prior to December 19, 2010. If this
project has not been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing address
and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the properly has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted stormwater
treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type
of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the
approved plans, specifications and supporting documentation. Please include a copy of the certification with your
permit renewal request and processing fee. Enclosed is a copy of a sample certification. Also enclosed is a new
Operation and Maintenance agreement that should be completed and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment
facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate
enforcement action including the assessment of civil penalties of up to $10,000 per day.

construction, operation and maintenance of a wet detention basin in compliance with the provisions of 15A NCAC
2I-1 .1000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by the Division of Water Quality
and considered a part of this permit.
This permit shall be effective from the date of issuance until June 19, 2011 and shall be subject to the following
specified conditions and limitations:
1. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page
3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff'I'rom
203,425 square feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts
of the permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per
approved plans.
5. The built -upon area for the future development is limited to 136,778.
6. The runoff from all built -upon area within the permitted drainage area of this project must be directed into
the permitted stormwater control system. A permit modification must be submitted and approved prior to
the construction of additional built -upon area from outside of the approved drainage area.

H. SCHEDULE OF COMPLIANCE
']'lie stormwater management system shall be constructed in it's entirety, vegetated and operational for its
intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited
to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catell basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what actions
were taken.
Decorative spray fountains will not be allowed in the stormwater treatment system.
The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless
the facilities are constructed in accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of
this permitted facility, a certification must be received from an appropriate designer for the system installed
certifying that the permitted facility has been installed in accordance with this permit, the approved plans
and specifications, and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification.
I f the stormwater system was used as an Erosion Control device, it must be restored to design condition prior
to operation as a stormwater treatment device, and prior to occupancy of the facility.
9. A modification must be permitted prior to any construction. The following items will require a modification
to the permit. The Director may determine that other revisions to the project should require a modification
to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. "Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
C. Further subdivision, acquisition, or sale ofthe project area. The project area is defined as all property
owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
10. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
of ten years from the date of the completion of construction.

11. The permitter shall submit final site layout and grading plans for any permitted future areas shown on the
approved plans, prior to construction. If the proposed BUA exceeds the pemitted amount, a modification
to the permit must be submitted and approved prior to construction.
12. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities
shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale
of any portion of the property.
13. The permittec is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements ofthe permit. Within the time frame specified in the notice, the permittee sliall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittec shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
15. The permittee shall notify the Division of any name, ownership or mailing address changes within 30 days.
16. Deed restrictions must be recorded prior to the sale of any outparcel or future area shown on the approved
plans to ensure that future owners are made aware of the built -upon area limitations. The following
statements must be recorded:
a. "To ensure continued compliance with the NC Division of Water Quality Stormwater Management
Permit Regulations, 15A NCAC 2H.1000, the maximum built -upon area for outparce](s) and future
areas shown on the approved plans is 136,778 square feet. This allotted amount includes any built -
upon area constructed within the property boundaries, and that portion of the right-of-way between
the lot lines and the edge of the pavement. Built upon area includes, but is not limited to, structures;
asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised,
open wood decking, or the water surface of swimming pools."
b. "The runoff from all built -upon area on the outparcel or future area must be directed into the
permitted stormwater control system."
C. 'Built -upon area in excess of the permitted amount will require a permit modification."
"The connection into the stormwater control shall be made such that short-circuiting of the system
does not occur."
17. A copy of the recorded deed restrictions with all statements as listed above, must be submitted to the DWQ
within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated,
stamped with the deed book number and page, and bear the stamp/seal of the Register of Deeds.
lit. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the Division of Water
Quality accompanied by an application fee, documentation from the parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits and may or
may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.

3. The issuance of this permit does not preclude the Permittee from complying; with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including; the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing; of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual.

Enclosed are copies of letters dated May 1, 2000 and June 5, 2001 from Mr. Paul M. Farley
of Land Management Group regarding the issue of wetlands on the subject project.
As you will note, Mr. Farley's May 1, 2000 letter stated that Allen Davis of the Corps of
Engineers was severely backed up and "we could not expect confirmation any time soon". Mr.
Farley also stated that Mr. Rob Moul of their office would confirm Mr. Farley's earlier
delineation that no jurisdictional wetlands are present on the Hampton Inn property. Also,
Mr. Farley states that the pond that we desire to divert stormwater was excavated from non-
hydric soil and is not therefore considered a wetland, Mr. Farley's June 5, 2001 letter states
that Allen David continues to have a backed up schedule and that he (Mr. Farley) and Rob
Moul both have visited the site and found that no wetlands are present on the site.
It is our understanding that this additional information will allow you to issue the
stormwater permit for this project. Since I am forwarding you this information today via
facsimile, the originals will follow by mail. Again, we appreciate your attention to this matter.

Dear Mr. Gibson:
The Wilmington Regional Office received a Stormwater Management Permit Application for Hampton
Inn, Sunset Beach, NC on November 29, 1999 with additional information on March 27, 2000. A preliminary
review of that information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
When information regarding wetlands becomes available from Mr. Allen Davis, of the U.S.
Army Corp of Engineers, please forward copies of the correspondence from both Mr. Davis and
Mr. Paul Farley, of Land Management Group, Inc., to this Office and provide copies of plans
noting either the delineation of wetlands or the note that no wetlands exist within the project
area.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to February 5, 2000, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the
application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.

Your January 5, 2000 letter to Mr. Fleming Gibson listed four comments relative to your
review of the subject project. Our responses follow and are numbered to correspond to the
number of your comments.
1. Mr. Paul Farley of Land Management Group, Inc. has provided us with a written
statement that he does not believe that there are wetlands on the subject site. He is in
the process of obtaining concurrence from Mr. Allen Davis of the US Army Corps of
Engineers. Once we get subject concurrence, we will be able to specifically address
this issue with a note on the plans.
2. Plan Sheet C3 has been revised to show the patio areas as being concrete. The
resultant BUA is already included in the calculations.
3. Plan Sheet C5 has been revised by adding a trash screen to the top of the trash guard.
4. Your request to reference the project number on all correspondence is noted.
Enclosed are two copies each of Plan Sheets C4 and C5. As soon as we receive written
documentation from Mr. Farley about wetlands, we will add a note to the plans which present
the findings. We will at that time send two copies of the affected plan sheet to you for review.

Inn, Sunset Beach, NC on November 29, 1999. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
Delineate all wetlands on site, or note on the plans that none exist.
2. Please note wether the patio areas on the eastern and southern sides of the Inn are to be grassed,
paved, or open wood decking. If they are to be impervious areas please show on plans and
include in application and calculations.
3. For the pond outlet structure detail please include a trash screen on top of the 48" trash guard.

requested information should be received by this Office prior to February 5, 2000, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the
application fee. The Division is allowed 90 days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation ofNCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.

Dear Ms. Lewis:
We are pleased to submit the subject project for your review and approval. Enclosed
are two sets of Plan Sheets C I through C8 and two (2) sets of the hydrologic and hydraulic
calculations. Also enclosed is one (1) original executed Stormwater Management Permit
Application Form (stamped "original") and one (1) copy (stamped "copy"), one (1) original
executed Wet Detention Basin Supplement form (stamped "original") and one (1) copy
(stamped "copy"). Enclosed is a check in the amount of $420 we are providing on behalf of
our Client to cover the required application fee.
Your review of this project will show that we propose to convert an existing golf
course (Lion's Paw at Ocean Ridge Plantation) pond to a stormwater detention pond. We
request that the pond be approved for use as a stormwater detention pond even though it
does not have a 6:1 vegetated shelf around its perimeter. Our basis for making this request
lies in three factors which will lead to stormwater treatment superior to that which would
otherwise be accomplished with strict conformance with the "rules". These three factors
are: 1) the existing pond has almost three times the surface area required by the "rules"; 2)
the pond is upstream of a larger, well -maintained golf course pond; and, 3) the pond has
existing stabilized banks which if disturbed would result in greater contribution of sediment
to the pond than if left in their current condition.
It is important to note that our Client, Carolina Lodging Group, Inc. is closely
affiliated with the owner of Lion's Paw Golf Course, Ocean Ridge Corporation. Mr.
Fleming Gibson is president of both corporations. Ocean Ridge Corporation will provide
to Carolina Lodging Group, Inc. any necessary easement for perpetual operation and
maintenance as required for the stormwater detention pond (see Special Note #3 on Sheet
C5).
We trust that you will find the information contained within this submittal package to
be in order and the project warrants approval by your department. Please note that we are
also making submittal today to Mr. Dan Sams, P.E. of the NCDENR - Land Quality
Section regarding the required Sedimentation and Erosion Control approval.
