On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval. issued by the Division of Water Quality under Article 21 of .
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 991140 which has already expired on March 6,
2010, is now in effect until March 6, 2014. Please resubmit the renewal application and
fee -at least 180 days prior to March 6, 2014, which would be September 6, 2013. A
copy of the Renewal Application can be obtained from the following website:

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8991140 to Wilmington
Bridge Maintenance Yard Division III, East Side for a High Density Project on March B, 2000. This permit expires on
March 8, 2010. Section .1003(h) of 15 A NCAC 2H .1000 (the stonnwater rules) requires that applications for permit
renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee,
which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal
application in a timely manner. If this project has not been constructed and a permit is no longer needed, please submit a
request to have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide the
name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed Is a
form for change of ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a
certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to
certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee.
Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should
be completed and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment
facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement
action including the assessment of civil penalties of up to $10,000 per day.

We have revised the plans to include the items in your review letter as follows:
1. The permanent pond dimensions are shown on Sheet C-6.
2. The 30-foot vegetative filter has been relocated to an area farther from the
wetlands and we now have the required length.
3. The amount of existing impervious area that presently flows untreated to the
river is 1.1.3 acres (see Sheet C-1). The new project intercepts all but 0.15 acres of
the existing impervious area and directs it to the pond for treatment (see Sheet
C-4). We had to extend the collection system to the location shown. The grades
do not allow us to put it farther down the ramp.
4. We have initialed Page 4.
5. We used the minimum 1" volume in the revised calculations.
6. The revised impervious percentage is based on the new impervious area and
deletes the existing impervious areas.
7. The figures for impervious are now in square feet.
8. The area of the project (4.3 acres) is highlighted on Sheet C-4.
9. Spot elevations are highlighted on Sheet 4.

The Wilmington Regional Office received a Stormwater Management Permit Application far NCDOT
Division 3 Bridge Maintenance Yard, Belville on January 18, 2000. A preliminary review of that information
has determined that the application is not complete. The following information is needed to continue the
stormwater review:
The grading shown for the vegetated filter suggests that it will be more of a swale rather than
a flat grassed area. A swale is not acceptable for a vegetated filter. Please show the 7 contour
straight across the filter, at right angles to the sides, not pointing upstream. The idea is to spread
the flow out over the grass, not channelize it.
2. The total impervious area shown on the application appears to be a typo- 94,691, is reported,
but if you add up the numbers shown in the breakdown area, they total 94,962 ftz. The total
BUA reported in the lower section of the breakdown area is what gets carried to the upper
section. If 94,691 is the total BUA that will drain to the pond, please revise the breakdown
portion of the application to add up to 94,691. If 94,962 is the actual BUA to the pond, please
correct the total on the application. Please note that the calculations use 94,961 ft2, so if you
change the total to 94,691, you will also need to revise the calculations.
The minimum required surface area is 5,123 ft2, but you now show on the supplement that only
5,103-ft2 is provided, rather than the 5,791 ft2 previously reported. Please provide additional
surface area. Additionally, if you calculate the area as shown in the permanent pool dimension
detail, it adds up to 5,362 ft', not 5,103. Please clarify, recalculate, and revise where needed.

Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to March 11, 2000, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the
application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must indicate
the date by which you expect to submit the required information. The Division is allowed 90 days from
the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS I43-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original documents that
need to be revised have been sent to the engineer or agent. All original documents must be returned or new
originals must be provided. Copies are not acceptable. If you have any questions concerning this matter please

Footnotes:
When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious 9v and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR Bi1P manual provides design tables for both 85`!o TSS removal and 90% TSS removal.
II. REQUIRED ITEMS CHECKLIST EAST SIDE — WET POND
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

In reference to your review letter of February 11, 2000, we have revised the
drawings and permit data as follow:
1. The Elevation 7 contour has been drawn at the end of the vegetated filter.
2. I did transpose the numbers on the permit. The data in the calculations is correct.
The total is 94,962 square feet.
3. In the last review letter, the impervious area was changed to account for the
existing impervious area and the percent impervious was adjusted from 52.23%
down to 50.7%. The surface area (5,791 sf) of the permanent pool was reduced
accordingly after we re -drew the pond.
When we use the acreage of 4.3 and interpolate for the 50.7% and recalculate the
minimum surface area, we get 5,188 sf which is near your 5,123 sf. The dimensions on
the detail sheet show 5,362 sf. When AutoCAD checks the areas with the radii at the
ends of the contours, the surface area is slightly less but is more than 5,188.
Please advise if you need more data.

The Wilmington Regional Office received a Stormwater Management Permit Application for NCDOT
Division 3 Bridge Maintenance Yard-Belville on November 29,1999. A preliminary review of that information
has determined that the application is not complete. The following information is needed to continue the
stormwater review:
Please provide the dimensions for each side of the figure created by the permanent pool contour.
2. The 30' of vegetated filter should be provided parallel with the flow. The detail provided
2 indicates only 20' of grass after the riprap, but a 30' width. The width is determined by.the
flowrate, and is not automatically set at 30'. See the enclosed detail.
3. The area around the rear of the site at the boat ramps is allowed to sheet flow into the river
without treatment. The rules require that all runoff from impervious areas be treated, however,
0j the site is being partially redeveloped. Please provide a calculation which demonstrates that the
new runoff volume into the river is less than or equal to the existing amount of runoff into the
river. Please delineate the before and after drainage areas for this calculation. If this requirement
cannot be met, please provide additional stormwater control measures for the runoff. You may
want to consider a sand filter, which is ideal for this type of application. Sand filters are small
and do not need to meet the 2' separation from the water table because they have an impervious
bottom. The BMP document distributed at the workshops outlines all the design requirments.

5. As discussed at the workshops, please use the minimum 1" volume to size the orifice, not the
volume actually provided.
,/ 6. Please recalculate the percent impervious and required volume. Based on 2.18 acres of
impervious and a4.3 acre drainage area, the percent impervious is only 50.7%, not 52.23%. This
will then reduce the required volume, and ultimately the orifice size needed.

application in square feet. For small numbers, it is more accurate, and easier for us to verify a
square footage.

,/. 9. Please provide proposed spot elevations to indicate the elevations of the parking lot edges, high
points and low points, and to help me determine drainage flow patterns.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to January 21, 2000, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the .
application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must indicate
the date by which you expect to submit the required information. The Division is allowed 90 days from
the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a -violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.
Please reference the State assigned project number on all correspondence. Any original documents that
need to be revised have been sent to the engineer or agent. All original documents must be returned or new
originals must be provided. Copies are not acceptable. If you have any questions concerning this matter please
