On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 991125 which has already expired on March 7,
2010, is now in effect until March 7, 2014. Please resubmit the renewal application and
fee at least 180 days prior to March 7, 2014, which would be September 7, 2013. A
copy of the Renewal Application can be obtained from the following website:

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8991125 to NCDOT Division
3 Maintenance Yard for a High Density Project on March 7, 2000. This permit expires on March 7, 2010. Section .1003(h)
of 15 A NCAC 2H .1000 (the stormwater rules) requires that applications for permit renewals shall be submitted 180 days
prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this
is still an active project please complete and submit the enclosed renewal application in a timely manner. If this project
has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you
have sold the project, or are no longer the permittee, please provide the name, mailing address and phone number of the
person or entity,that is now responsible for this permit. Enclosed is a form for change of ownership, which should be
completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted treatment units a
certification of completion be submitted to the Division from an appropriate designer for the system installed. This is to
certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and
supporting documentation. Please include a copy of the certification with your permit renewal request and processing fee.
Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance agreement that should
be completed and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a stonnwater treatment
facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement
action including the assessment of civil penalties of up to $10,000 per day.

construction, operation and maintenance of 3 wet detention ponds in compliance with the provisions of 15A NCAC
2H .1000 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by the Division of Water Quality
and considered a part of this permit.
This permit shall be effective from the date of issuance until March 7, 2010 and shall be subject to the following
specified conditions and limitations:
1. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stonnwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stwmwater runoff as described on page
3 of this permit, the project Data Sheet. The stormwater control has been designed to handle the runoff from
185,896 square feet of impervious area.
Approved plans and specifications for this project are incorporated by reference and are enforceable parts
of the permit.
4. The tract will be limited to the alanount of built -upon arcs indicated on page 3 of this perrnit, and per
approved plans.

revisions on the project and offer the following responses to your comments:
1. We added the NCDOT project boundary to the wetlands map and included a copy of the
survey for this property.
2. Wo have added this information to the plan. All plans are to scale. We included drawings
with plan views of each building to scale and a site plan that shows more details of the site.
We should have sent these drawings earlier, but it was our intent not to inundate your office
with too many sheets.

The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for NCDOT Division 3 Maintenance Yard on November 19, 1999. A
preliminary review of that information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
Please show the project boundary on the wetlands map. I am unable to correlate the proposed
site with the wetlands map with any accuracy.
2. The staking plan will provide the locations of two corners of the building, or the mid -line of the
parking lot, but it doesn't tell me how big the building is, or how wide the parking lot access
drive is, or how long the parking spaces are, or how wide the sidewalks are. Please provide
dimensions for the above items, as previously requested.

pursuant to NCGS 143-215.6A.

The Wilmington Regional Office received a Stormwater Management Permit Application for NCDOT
Division 3 Maintenance Yard on November 19, 1999. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater review:
Delineate all wetlands on site, or note on the plans that none exist.
2. Please provide a vicinity map on the plans.
Please dimension the buildings, parking, walks, etc.
4. Please provide 2 sets of plans that show the entire 22.26 acre drainage area for Pond 3. The
plans submitted cut off the drainage area at both sides.
5. Please provide maps of the 240,000 ft2 of offsite impervious area for Pond 3. Is this area under
DOT control, le., can DOT control the amount of impervious surface constructed in the future
on the offsite area? The rules require that the offsite area be accounted for at the full build -out
potential.
6. Please provide a pond section detail that includes specific pool and shelf elevations for each
pond. There is a small section detail included as apart of the outlet structure details, but it does
not show the elevations and is useless as far as figuring out where the vegetated shelf is
supposed to go.
The calculations submitted do not address all of the State's pond design criteria. Please provide
calculations that show the required and provided volumes, and the orifice sizing to achieve a
2-5 day drawdown. The hydrographs submitted are unclear as to what size orifice is used and
how long it takes to drawdown. Please summarize those results clearly.
Please provide a trash screen at the top of the 24" CMP half -round pipe that shields the orifice.
Without a screen, trash has a very good chance of accumulating in that space and clogging the
orifice.

9. Please seal the design calculations.
10. Please dimension all sides and arcs of the figure created by the permanent pool contour.
11. Please fill in the latitude and longitude of the project in the space provided on the application.
12. Please provide the overall project acreage in the space provided on the application.
13. If you wish for Mr. Warren Mitchell to act as your agent for the purposes of submitting the
stonnwater application and answering questions, please fill in Section VII of the application.
14. The SA/DA ratios used are very low. Please check to be sure you used the tables for the coastal
counties, and not- the Piedmont or Mountains. Enclosed is the correct SA/DA table for the
coastal counties.
15. Use of the 85% TSS chart requires a vegetated filter after the outlet structure. Please provide in
' accordance with the enclosed sketch. Please provide a detail on the plans complete with
-proposed grading and elevations for the flow spreader mechanism. In lieu of the filter, you can
use the 90% TSS chart. This chart has higher SAMA ratios.
16. , The supplements indicate that the design storm is .65". The regulations require that the volume
of runoff from the first 1 " of rain be accounted for and treated in the system. Based on the 1 "
storm, none of the ponds provide sufficient volume. Please revise.
17. The 3" orifice specified is too large. The ponds will draw down in less than 2 days. The
regulations require that the minimum 1" volume be released in 2-5 days. Please revise.
Please note that this request for additional information is in response to arpreliminary review. The

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
s construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed -in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ).
A complete package includes all of the items listed below. The complete application package should be
submitted to the appropriate DWQ Regional Office.
